Approve the enclosed Rules of the choice of obligatory public TV channel of the subject of the Russian Federation.

Rules of the choice of obligatory public TV channel of the subject of the Russian Federation

1. These rules determine the procedure of the choice of obligatory public TV channel of the subject of the Russian Federation (further - the procedure of the choice of TV channel).

2. The choice of obligatory public TV channel of the subject of the Russian Federation is performed by the Federal tender committee on TV and radio broadcasting, educated Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications according to Item 5.3 (2) the Regulations on Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications approved by the order of the Government of the Russian Federation of March 16, 2009 No. 228 "About Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications".

3. The federal tender committee on TV and radio broadcasting makes the decision on holding procedure of the choice of TV channel.

4. After decision making about holding procedure of the choice of Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications TV channel places the information message about holding meeting of the Federal tender committee on TV and radio broadcasting for the purpose of holding procedure of the choice of TV channel (further - meeting).

The information message is posted on the official site of Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications on the Internet (www.rkn.gov.ru) within 5 calendar days from the date of adoption of the specified decision and includes the following data:

a) date, time and place of meeting;

b) subject of the Russian Federation in the territory of which the obligatory public TV channel of the subject of the Russian Federation will extend;

c) list of documents (materials) necessary for participation in the procedure of the choice of TV channel.

5. For participation in the procedure of the choice of TV channel the speaker directs the application for participation in the procedure of the choice of TV channel (further - the statement). The application form is established by Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications.

The following documents (materials) are enclosed to the application:

a) 7-day record of air of TV channel (168 hours), and also the information about producers of products of mass media which aired during the specified period including the data confirming production of the specified products by citizens of the Russian Federation and (or) the organizations registered in accordance with the established procedure in the territory of the Russian Federation;

b) the copy of the register of TV channel with the list of telecasts and TV programs;

c) data on share of the population having opportunity to accept broadcast of TV channel in the territory of appropriate subject of the Russian Federation;

d) data on creation of TV channel according to international treaties of the Russian Federation (in the presence).

6. The statement and documents (materials) attached to it go to Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications within 30 calendar days from the date of placement of the information message specified in item 4 of these rules.

7. The statement and documents (materials) attached to it are submitted to Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications directly or go the registered mail with the assurance of receipt, and also can be directed in electronic form, signed by the strengthened qualified digital signature.

8. The speaker who directed the application and documents (materials) attached to it (further - the applicant), can provide to Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications other documents (materials) in addition to earlier directed before the expiration established in Item 6 of these rules.

9. The Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications by consideration of question of the admission to participation in the procedure of the choice of TV channel performs assessment of documents (materials) provided by the applicant regarding their compliance to Item 5 of these rules and no later than 10 working days from the date of the termination of the term established in Item 6 of these rules makes the decision on the admission of the applicant to participation in the procedure of the choice of TV channel or on refusal in participation in this procedure with indication of causes of failure.

The notification on participation in the procedure of the choice of TV channel or the notification on refusal in participation in the procedure of the choice of TV channel with indication of causes of failure goes to the applicant the registered mail with the assurance of receipt or is handed out to the applicant (the authorized representative of the applicant).

If in the statement there is specifying on need of submission of the notification for form of an electronic document, the Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications directs the adequate notice in electronic form, signed by the strengthened qualified digital signature.

10. Within 3 working days from the date of the decision making specified in Item 9 of these rules, the Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications posts on the official site on the Internet (www.rkn.gov.ru) the list of the speakers allowed to participation in the procedure of the choice of TV channel.

11. The bases for refusal in participation in the procedure of the choice of TV channel are:

a) establishment during verification of the statement and the documents of that fact attached to it that products of TV channel contain less than 75 percent of national products of mass media, and its broadcasting is performed in the territory of accommodation less than 50 percent of the population of appropriate subject of the Russian Federation;

b) discrepancy of products of TV channel to the requirements to national products of mass media established by part five of article 32.1 of the Law of the Russian Federation "About mass media";
