According to Article part one 8, to Item 12, to article 49 of the Law of Ukraine "About prevention of corruption" the National agency according to the prevention of corruption SOLVED 5 parts one of Article:

1. Approve the Procedure for test of the fact of provision by subjects of declaring of declarations according to the Law of Ukraine "About prevention of corruption" and notifications of the National agency concerning prevention of corruption about cases of non-presentation or untimely submission of such declarations which is applied (further - the Procedure).

2. Determine that state bodies, authorities of the Autonomous Republic of Crimea, local government bodies, and also legal entities of the public law in whom work (worked) persons, according to article 50 of the Law of Ukraine "About prevention of corruption" hold responsible and especially responsible position and give according to Item 1 of the decision of the National agency concerning prevention of corruption of June 10, 2016 No. 2 "About the beginning of system operation of giving and promulgation of declarations of persons authorized on accomplishment of functions of the state or local self-government" registered in the Ministry of Justice of Ukraine on July 15, 2016 for No. 958/29088, annual declarations for 2015 shall check the fact of giving by such subjects of declaring of the specified declarations according to the Procedure approved by Item 1 of this decision within 10 calendar days from the date of entry into force of this decision.

3. To submit to department of financial control and monitoring of conduct of life together with department of legal support this decision on state registration to the Ministry of Justice of Ukraine.

4. This decision becomes effective from the date of its official publication.

5. Control over the implementation of this decision to assign to the vice-chairman of the National agency concerning prevention of corruption Radetsky R. S.

Procedure for test of the fact of provision by subjects of declaring of declarations according to the Law of Ukraine "About prevention of corruption" and notifications of the National agency concerning prevention of corruption about cases of non-presentation or untimely submission of such declarations

1. This Procedure determines the procedure of check by state bodies, authorities of the Autonomous Republic of Crimea, local government bodies, and also legal entities of the public law (bodies in which works (worked or enters or was part of the tender committee created in body, structure of Public council of virtue) the subject of declaring (further - relevant organ)) the fact of representation by subjects of declaring who in them work (worked or enter or were part of the tender committee formed in body, structure of Public council of virtue), declarations of persons authorized on accomplishment of functions of the state or local self-government (further - the declaration), according to the Law of Ukraine "About prevention of corruption" (further - the Law), and also the procedure of the notification relevant organ of the National agency concerning prevention of corruption (further - the National agency) about cases of non-presentation or untimely submission of such declarations.

2. In this Procedure terms are used in the values given in the Law and regulatory legal acts adopted according to it.

The termination of the activities connected with accomplishment of functions of the state or local self-government is the last day of execution by the subject of declaring of the specified functions.

3. Check of the fact of submission of declarations and the notification of the National agency on cases of non-presentation or untimely submission of declarations are assigned to authorized division (face) concerning prevention and identification of corruption of relevant organ or other structural division of such body (further - responsible division (authorized person)) determined by the head of body.

The head of relevant organ, determines order of interaction of responsible division (face) with other divisions for the purpose of accounting of subjects of declaring which had obligation to submit declarations according to requirements of the Law.

4. The responsible division (face) of relevant organ checks the fact of submission of declarations in the following terms:

1) annual declarations of subjects of declaring - within 10 working days from limiting date of submission of such declarations;

2) declarations of subjects of declaring which stop the activities connected with accomplishment of functions of the state or local self-government - within five working days after the expiration in twenty working days from the date of the termination by the subject of declaring of the specified activities;

3) declarations of the subjects of declaring which stopped the activities connected with accomplishment of functions of the state or local self-government - within 10 working days from limiting date of submission of such declarations of the following for reporting year in which such activities were stopped;
