About procedure for submission by credit rating agencies to the Bank of Russia of documents, information and data, and also form and terms of their representation

1. The credit rating agency to the Bank of Russia submits the following documents (the copy of documents), information and data:

copies of regulations on rating committee and other internal documents regulating work of rating committee;

copies of the internal documents regulating work of methodological committee;

copies of the internal documents regulating work of bodies of internal control;

copies of the applied methodologies, and also all changes made to methodologies;

calendar of review and disclosure of sovereign credit ratings;

information on the revealed mistakes in the applied methodology which affected or can affect credit ratings and (or) forecasts for credit ratings, according to appendix 1 to this Instruction, and information on the taken measures specified in Items 2 and 3 of part 12 of article 12 of the Federal Law of July 13, 2015 to No. 222-FZ;

information on the planned changes of the applied methodology if such changes are essential and exert or can exert impact on credit ratings, according to appendix 2 to this Instruction;

information about persons entering into bodies of internal control according to appendix 3 to this Instruction;

other documents and information connected with implementation of rating activities and necessary for implementation of supervising and other functions by the Bank of Russia, represented by credit rating agency by motivated bank inquiry of Russia according to part 3 of article 15 of the Federal Law of July 13, 2015 to No. 222-FZ.

2. The documents, information and data specified in Item of 1 this Instruction are represented to the Bank of Russia in the form of the electronic documents signed by the strengthened qualified digital signature of person performing functions of sole executive body of credit rating agency (person who is temporarily fulfilling its duties) or person authorized by it through private office according to the Instruction of the Bank of Russia of December 21, 2015 to No. 3906-U "About order of interaction of the Bank of Russia with not credit financial credit institutions and other participants of information exchange when using of information resources of the Bank of Russia, including private office by them, and also procedure and terms of the direction other participants of information exchange of the notification on use or notifications on refusal of use of private office", the registered Ministry of Justice of the Russian Federation on March 1, 2016 No. 41289 ("the Bulletin of the Bank of Russia" of March 16, 2016 No. 26), taking into account the features established by this Instruction.

3. The documents specified in paragraphs the second - the fourth Item of 1 this Instruction, are represented to the Bank of Russia within three working days from the date of introduction of changes in them.

4. The documents specified in paragraphs five and pole of Item of 1 this Instruction are represented to the Bank of Russia within three working days from the date of their acceptance (approval).

5. Information specified in paragraph seven of Item of 1 this Instruction is submitted in the Bank of Russia;

regarding the revealed mistakes in the applied methodology - within three working days from the date of detection of such mistakes;

regarding the taken measures specified in Items 2 and 3 of part 12 of article 12 of the Federal Law of July 13, 2015 to No. 222-FZ - within three working days from the date of acceptance of such measures.

6. Information specified in paragraph eight of Item of 1 this Instruction is submitted in the Bank of Russia within fifteen working days from the date of acceptance by methodological committee of credit rating agency of the decision on change of the applied methodology.

7. The data specified in paragraph nine of Item of 1 this Instruction are represented to the Bank of Russia within fifteen working days from the date of entering of credit rating agency into the register of credit rating agencies, and also in case of change of data - within three working days from the date of change of data.

8. The documents and information specified in paragraph ten of Item of 1 this Instruction are represented to the Bank of Russia in time established in motivated bank inquiry of Russia.

9. Documents, information and data are represented to the Bank of Russia together with the cover letter containing information on the list of the submitted documents, structure of information and data with indication of outgoing date of the letter and its registration number, and also about date and number of motivated bank inquiry of Russia in response to which documents go, information and (or) data, in cases when documents, information and (or) data go credit rating agency in response to the received motivated bank inquiry of Russia.

10. In case of detection of mistakes in the documents submitted to the Bank of Russia, information and (or) data credit rating agency according to Item 2 presents of the Instruction, with observance of requirements of Item 9 of this Instruction within ten working days from the date of identification of mistakes send the corrected documents, information and (or) data to the Bank of Russia.
