About some questions of confirmation of conformity in National system of confirmation of conformity of the Republic of Belarus

Based on subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of July 20, 2016 "About measures for obligatory confirmation of conformity" the Council of Ministers of the Republic of Belarus DECIDES: No. 278

1. Approve the list of objects of obligatory confirmation of conformity of National system of confirmation of conformity of the Republic of Belarus (further – the list) it (is applied).

2. Determine that obligatory confirmation of conformity becomes effective in the relation:

products specified in subitems 3.1-3. 5, 3.8, 3.10 (except for products "microwave ovens") Item 3 of the list, – since July 1, 2018;

products specified in subitem 3.7 of Item 3 and item 4 of the list – since September 1, 2017;

products specified in subitem 3.9 of Item 3 of the list, products "microwave ovens" specified in subitem 3.10 of Item 3 of the list – since January 1, 2019;

products specified in Items 5 and 9 of the list – since February 1, 2017;

products specified in Items 6 and 7 of the list – since April 1, 2022;

the professional competence of personnel specified in Item 13 of the list – since January 1, 2018;

the services specified in Item 12 of the list – since September 22, 2022.

 2-1. Determine that the manufacturer or person authorized by the manufacturer or the seller (supplier) adopting the conformance statement, having the right to choose instead of the form of confirmation of conformity established by the list "declaring of compliance" form of confirmation of conformity "certification".

3. Operation of this resolution does not extend on:

products which were in operation (consumption);

products imported by legal entities and individual entrepreneurs as components, materials and raw materials for use in own production in the presence at them certificates of conformity of National system of confirmation of conformity of the Republic of Belarus on the finished goods made using the specified components, materials and raw materials;

products imported as samples, exhibits and promotional materials for holding exhibitions, fairs, advertizing campaigns;

products imported as tests and samples for carrying out testing for the purpose of certification or adoption of the declaration of conformity, testing and researches in other purposes;

products imported in single copies (quantities) provided by one agreement in foreign trade only for own use by the legal entities and individual entrepreneurs (including for research, studying and testing) who imported the specified products;

the nonfood products imported as raw materials, materials and accessories for accomplishment of orders of the foreign organizations for production of products according to the signed agreements, not intended for realization in the territory of the Republic of Belarus;

products imported for use in the research purposes including for accomplishment of research programs;

the products sold in commission trade, accepted from citizens;

the goods (property) which arrived as foreign free aid and the international technical assistance;

the property withdrawn, arrested, and also confiscated under sentence (resolution) of court or turned into the income of the state otherwise, property on which collection on account of the unexecuted tax liability, unpaid penalty fee, and the property exempted from arrest by the body conducting criminal procedure addresses;

the goods intended for the prevention and liquidation of natural disasters and other emergency situations;

products intended for realization in duty-free shops;

the products imported for use of foreign states by diplomatic or consular representations, representative offices of the international organizations or intended only for ensuring activities of representative offices of the foreign organizations located in the territory of the Republic of Belarus;

the products made in the territory of the Republic of Belarus or imported on this territory before the term from which obligatory confirmation of conformity of specific type of products is entered;

products exported according to contracts in foreign trade.

4. Suggest the State committee of judicial examinations to develop together with the State committee on standardization the state standard of the Republic of Belarus establishing criminalistic requirements to hunting and sports weapon till February 1, 2017.

5. Determine what in case of enforcement of technical regulatory legal acts instead of specified in the list obligatory confirmation of conformity is performed on compliance to the enacted technical regulatory legal acts before entering of corresponding changes into the list.

6. This resolution becomes effective since October 23, 2016.
