Rules of the address with solid utility waste

I. General provisions

1. These rules establish procedure of accumulating, collection, transportation, processing, utilization, neutralization and burial of solid utility waste, the conclusions of the service provision agreement according to the address with solid utility waste, and also the bases on which the legal entity can be deprived of the status of the regional operator according to the address with solid utility waste (further - the regional operator).

To the relations arising between owners and (or) users of premises in apartment houses and management companies, condominiums, housing cooperatives, other specialized consumer cooperatives between owners of rooms, users of premises in apartment houses, owners of apartment houses and regional operators, between owners of apartment houses and the organizations (including non-commercial associations) which on its own behalf and for the benefit of the owner of the apartment house sign service provision agreements according to the address with solid utility waste with the relevant regional operators, to the specified owners connected with ensuring provision and users of utility according to the address with solid utility waste, provisions of these rules are applied in the part which is not settled by the housing legislation of the Russian Federation.

2. In these rules the following concepts are applied:

"bunker" - the dustbin intended for warehousing of large-size waste;

"export of solid utility waste" - transportation of solid utility waste from places (platforms) of their accumulating to the objects used for processing, utilization, neutralization, burial of solid utility waste;

"container" - the dustbin intended for warehousing of solid utility waste, except for large-size waste;

"container area" - the place (platform) of accumulating of solid utility waste equipped according to requirements of the legislation of the Russian Federation in the field of environmental protection and the legislation of the Russian Federation in the field of ensuring sanitary and epidemiologic wellbeing of the population and intended for placement of containers and bunkers;

"large-size waste" - solid utility waste (furniture, household appliances, waste from running repair of premises, etc.) which amount does not allow to perform their warehousing in containers;

"garbage truck" - the category N vehicle used for transportation of solid utility waste;

"loading of solid utility waste" - movement of solid utility waste from places (platforms) of accumulating of solid utility waste or other places from which loading of solid utility waste, in the garbage truck for the purpose of their transportation, and also cleaning of shipping places of solid utility waste is performed;

"consumer" - the owner of solid utility waste or the person authorized by him who concluded or obliged to sign with the regional operator the service provision agreement according to the address with solid utility waste;

"cleaning of shipping places of solid utility waste" - actions for matching dropped (waking up, etc.) when loading solid utility waste and to their moving to the garbage truck.

3. Accumulating, collection, transportation, processing, utilization, neutralization, burial of solid utility waste are performed taking into account the ecological legislation of the Russian Federation and the legislation of the Russian Federation in the field of ensuring sanitary and epidemiologic wellbeing of the population.

Implementation of accumulating, collection, transportation, processing, utilization, neutralization, burial of solid utility waste shall be safe for the population and the environment.

4. The address with solid utility waste in the territory of the subject of the Russian Federation is provided with regional operators according to the regional program in the field of the address with waste, including with solid utility waste, and the territorial scheme of the address with waste (further - the scheme of the address with waste) based on the service provision agreements according to the address with solid utility waste concluded with consumers.

The regional operator performs collection, transportation, processing, utilization, neutralization, burial of solid utility waste independently or with involvement of operators according to the address with solid utility waste.

5. The service provision agreement according to the address is signed with solid utility waste between the consumer and the regional operator in whose zone of activities solid utility waste are formed and there are places (platform) of their accumulating, according to the procedure, provided by the Section I (1) these rules.
