According to Item 10 parts three of article 13 of the Law of Ukraine of December 10, 2015 No. 889-VIII "About public service", order to the Regulations on the National agency of Ukraine concerning public service approved by the resolution of the Cabinet of Ministers of Ukraine of October 1, 2014 No. 500,:

1. Approve the Procedure for carrying out by the National agency of Ukraine concerning public service and its territorial authorities of checks of condition of observance of the Law of Ukraine by state bodies "About public service" and other regulatory legal acts in the sphere of public service which is applied.

2. And interactions with authorities of the National agency of Ukraine concerning public service in accordance with the established procedure to provide to inspection department submission of this order on state registration in the Ministry of Justice of Ukraine.

3. Declare invalid the order of Glavgossluzhby of April 29, 2011 No. 116 "About approval of the Procedure for carrying out Glavgossluzhboy of checks", registered in the Ministry of Justice of Ukraine on May 23, 2011 on No. 620/19358.

4. To impose control of execution of this order on the vice-chairman of National civil service according to distribution of functional powers.

5. This order becomes effective from the date of its official publication.

Procedure for carrying out by the National agency of Ukraine concerning public service and its territorial authorities of checks of condition of observance of requirements of the Law of Ukraine by state bodies "About public service" and other regulatory legal acts in the sphere of public service

I. General provisions

1. This Procedure is developed according to the Law of Ukraine "About public service" (further - the Law), the Regulations on the National agency of Ukraine concerning public service approved by the resolution of the Cabinet of Ministers of Ukraine of October 1, 2014 No. 500, and determines tasks and procedure for carrying out NAGS and its territorial authorities of scheduled and unscheduled inspections of condition of observance by state bodies of requirements of the Law and other regulatory legal acts concerning public service.

2. Subject of checks are administrative and other documents on observance by state bodies of the sales terms determined by the Law by citizens of Ukraine of the right to public service.

3. Objects of check are state bodies, structural divisions, educated as legal entities of the public law, and territorial authorities of state bodies.

4. Subjects of check are officials of NAGS (territorial authority), persons involved from their consent of NAGS (territorial authority) according to the tasks assigned to them in conducting check.

5. NAGS (territorial authority) performs scheduled and unscheduled inspections.

The check of object of check provided by the plan of control activities of NAGS (territorial authority) is considered scheduled inspection.

Scheduled inspection is carried out in a complex or on single questions which are check subject.

Check during which all activities concerning observance by state body of requirements of the Law and other regulatory legal acts concerning public service provided by the program of conducting check are checked is considered complex check.

During conducting planned inspection on single questions the questions provided by the program of conducting check are checked.

Check of object of check which is not provided by the plan of control activities of NAGS (territorial authority) is considered unscheduled inspection.

6. NAGS (territorial authority) performs permanent and exit checks.

Exit check - the scheduled or unscheduled inspection of object of check connected with stay of subjects of check on the location of object of check.

Check not eligible to travel abroad - the unscheduled inspection of object of check which is not connected with stay of subjects of check on the location of object of check.

7. The main objectives of check are:

installation on object of check of actual state on realization of state policy in the sphere of public service, organization of management of public service;

check of condition of observance by state bodies of requirements of the Law and other regulatory legal acts concerning public service;

the prevention, identification and taking measures to elimination of the established violations of the current legislation and the reasons of inadequate level of the organization of management of public service;

provision to object of check based on the analysis of materials of verification of offers on increase in efficiency of activities for questions which were subject of check, elimination of the revealed shortcomings and prevention them in the future.

II. Organization and preparation for conducting check

1. It is performed:

NAGS - in any state body;

territorial authority of NAGS - in state bodies which jurisdiction extends to the territory of one or several areas, the Autonomous Republic of Crimea, the cities of Kiev and Sevastopol, one or several areas, cities of regional value in the corresponding territory or in any other at the request of NAGS.

It is performed by order of NAGS (territorial authority).

2. The basis for carrying out NAGS (territorial authority) scheduled inspection is inclusion of object of check in the plan of control activities of NAGS.

The plan of control activities of NAGS affirms the order NAGS prior to the beginning of the control period.

The plan of control activities is posted on the NAGS official website within five working days after approval.

Scheduled inspection of object of check is carried out not more often than once in two years.

Date from which term for determination of the beginning of the following scheduled inspection is reckoned end date of the previous scheduled inspection is.
