About approval of the Procedure for electronic interaction of subjects of primary financial monitoring and Public service of financial monitoring of Ukraine

According to Article part one 12, to article 13 of the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction", to the Regulations on the Ministry of Finance of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 375, to Regulations on Public service of financial monitoring of Ukraine, approved by the resolution of the Cabinet of Ministers of Ukraine of July 29, 2015 No. 537, and for the purpose of determination of formats of electronic interaction of subjects of primary financial monitoring and Public service of financial monitoring of Ukraine by PRIKAZYVAYU:

1. Approve the Procedure for electronic interaction of subjects of primary financial monitoring and Public service of financial monitoring of Ukraine which is applied.

2. Declare invalid the order of the Ministry of Finance of Ukraine of April 1, 2013 No. 436 "About approval of the Procedure for electronic interaction of subjects of primary financial monitoring and Public service of financial monitoring of Ukraine", registered in the Ministry of Justice of Ukraine on April 19, 2013 on No. 649/23181.

3. To department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine (Chmeruk N. A.) together with Department of information technologies of Public service of financial monitoring of Ukraine (Davidyuk V. S.) in accordance with the established procedure to provide:

provision of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

4. This order becomes effective in 30 days from the date of its official publication.

5. To impose control over the implementation of this order on the Deputy Minister of Finance of Ukraine Makeeva A. L. and vice-chairman of Public service of financial monitoring of Ukraine Zubriya V.P.

Procedure for electronic interaction of subjects of primary financial monitoring and Public service of financial monitoring of Ukraine

I. General provisions

1. This Procedure determines the mechanism of interaction between subjects of primary financial monitoring (further - SPFM) and Public service of financial monitoring of Ukraine (further - Gosfinmonitoring), and also requirements and formats of messages of electronic exchange of information by financial monitoring.

2. Electronic information interaction of SPFM and Gosfinmonitoring is performed according to the Laws of Ukraine:

"About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of weapons of mass destruction";

"About electronic documents and electronic document management";

"About the digital signature";

"About information security in information and telecommunication systems";

"About banks and banking activity".

II. Files of information exchange

1. For information interaction between Gosfinmonitoring and SPFM, their separate divisions such types of information (types of files of information exchange) are used:

the file message about financial transactions - the electronic document (data set of certain structure) which is created by SPFM and goes Gosfinmonitoring and contains information on financial transactions (further FO). One file message may contain information on several financial transactions;

the file message about capture (refusal in statement) information on FO - the electronic document (data set of certain structure) which is created by Gosfinmonitoring and goes for accounting SPFM and contains information on information processing on FO and on the conclusion (refusal in statement) it on accounting;

the file message about SPFM - the electronic document (data set of certain structure) which is created by SPFM and goes Gosfinmonitoring and contains data about SPFM (separate divisions), responsible persons of SPFM necessary for capture of SPFM on accounting, removals of SPFM from accounting, and also modification of information on SPFM in the Unified information system;

the file request - the electronic document (data set of certain structure) which is created by Gosfinmonitoring and goes SPFM and contains request for receipt of information (copies of documents) necessary (necessary) for accomplishment tasks assigned to Gosfinmonitoring.
