ORDER OF THE MINISTRY OF SOCIAL POLICY OF UKRAINE AND MINISTRY OF FINANCE OF UKRAINE

About approval of the Procedure for provision by the Public fiscal service of Ukraine of information from the State register of physical persons - taxpayers about availability of the income and sources of their obtaining by physical persons which provide social services

According to Item 6 (1) the Procedure for appointment and payment of compensation to physical persons which provide social services, the Cabinet of Ministers of Ukraine approved by the resolution of April 29, 2004 to No. 558 (with changes), PRIKAZYVAYEM:

1. Approve the Procedure for provision by the Public fiscal service of Ukraine for information from the State register of physical persons - taxpayers about availability of the income and sources of their obtaining by physical persons which provide social services which is applied.

2. Determine the parties of exchange of information structural divisions concerning social protection of the population of district, district public administrations, executive bodies in the city of Kiev city, district in the cities (in case of their creation) councils and the Public fiscal service of Ukraine.

Determine administrators of exchange who provide and perform technical support of the procedure of giving of requests and receipt of answers, the state company "Data Processing Center of the Ministry of Social Policy of Ukraine" and the Public fiscal service of Ukraine.

3. And to provision of social services of the Ministry of social policy of Ukraine (Sulim O. V.) in accordance with the established procedure to provide to management for elderly people submission of this order on state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on deputy ministers according to distribution of obligations.

Procedure for provision by the Public fiscal service of Ukraine for information from the State register of physical persons - taxpayers about availability of the income and sources of their obtaining by physical persons which provide social services

I. General provisions

1. This Procedure is developed for the purpose of realization of the mechanism of receipt of information from the State register of physical persons - taxpayers about availability of the income and sources of their obtaining by physical persons according to Item 6 (1) the Procedure for appointment and payment of compensation to physical persons which provide social services, the Cabinet of Ministers of Ukraine approved by the resolution of April 29, 2004 to No. 558 (further - the Procedure for appointment).

2. This Procedure regulates exchange of information between structural divisions concerning social protection of the population of district, district public administrations, executive bodies in the city of Kiev city, district in the cities (in case of their creation) councils (further - social security authorities of the population) and the Public fiscal service of Ukraine (further - GFS), rules of creation and representation by social security authorities of the population of requests for receipt of information from the State register of physical persons - taxpayers (further - GRFL) about availability of the income and sources of their obtaining by physical persons which provide social services.

3. The structure, format of the data provided in Item 2 of Chapter 1 and Item 2 of Chapter 2 of the Section III of this Procedure form of register of requests and answers, requirements of information security and order of interaction of information systems are determined jointly by Minsotspolitiki of Ukraine and GFS and drawn up by the protocols of exchange of information prepared according to this Procedure.

II. Regulations of exchange of information between Minsotspolitiki of Ukraine and GFS

1. Social security authorities of the population provide requests in GFS, and GFS gives replies to the requests to social security authorities of the population exclusively electronically with use of means of technical and cryptographic information security according to requirements of the legislation concerning information security.

2. Social security authorities of the population and GFS register requests and replies to the requests in registers of requests and replies to the requests.

3. The digital signature by the authorized person of body which provides such request or the answer (further - the authorized person) is imposed on request and the answer. Authorized persons are determined by orders of heads of relevant organs of social protection of the population and/or the order of the head of GFS.

4. In case of circumstances which make impossible accomplishment of provisions of this Procedure subjects of information exchange shall inform on this each other within two working days from the date of emergence of these circumstances.

III. Procedure for forming of request and answer

1. Procedure for forming of request

1. Social security authorities of the population quarterly create request and give it to GFS.

2. The request shall contain the following data:

code from the Unified state register of the companies and organizations of Ukraine (further - EGRPOU) structural division concerning social protection of the population of district, district public administrations, executive body in the city of Kiev of city, district council in the city (further - social security authority of the population) which initiated request;

name of social security authority of the population;

registration number and date (number, month, year) of request;

registration number of accounting card of the taxpayer or series and passport number (for person having mark in the passport about the right to make any payments on series and passport number);

surname, name, middle name (in the presence) physical person;

place of registration (accommodation) of physical person (area, district of the area, settlement, street type, name of the street, house number, cases (in the presence) and apartments (in the presence));

the period for which information is requested (it is determined according to Item 6 (1) the Procedure for appointment).
