About approval of Rules of development and assessment of memorandums of state bodies, directly subordinate and accountable to the President of the Republic of Kazakhstan

4. This order becomes effective after ten calendar days from the date of state registration in the Ministry of Justice of the Republic of Kazakhstan and is subject to official publication.

Rules of development and assessment of memorandums of state bodies, directly subordinate and accountable to the President of the Republic of Kazakhstan

1. General provisions

1. These rules of development and assessment of memorandums of state bodies, directly subordinate and accountable to the President of the Republic of Kazakhstan (further - Rules), are developed according to Item 6 of Article 62 of the Budget code of the Republic of Kazakhstan of December 4, 2008.

2. In these Rules the following concepts are used:

1) accountable bodies - state bodies, directly subordinate and accountable to the President of the Republic of Kazakhstan, except for special state bodies;

2) special state bodies - bodies of homeland security of the Republic of Kazakhstan, Service of foreign intelligence of the Republic of Kazakhstan Syrbar, Service of the state protection of the Republic of Kazakhstan.

2. Procedure for development of the memorandum of accountable body

3. Accountable bodies annually till November 1 of the current financial year develop drafts of memorandums for the next financial year.

4. Memorandums are developed in implementation of the Strategic plan of development of the Republic of Kazakhstan for 10 years and contain key target indicators, achievement (accomplishment) of which the first head of accountable body shall provide in planning period.

Key target indicators represent the main indicators which are guided by increase in level of satisfaction of citizens and reflect positive changes in social and economic development.

5. The memorandum is developed in the state and Russian languages in form, according to appendix 1 to these rules.

The memorandum contains the following:

1) surname, name, middle name of the official assuming the corresponding obligations;

2) name of the key target indicator;

3) units of measure;

4) the actual value of the key target indicator on previous year;

5) planned value of the key target indicator of the current year;

6) target value of the key target indicator for the planned year;

7) measures necessary for achievement (accomplishment) of key target indicators.

In case of decrease in value of the key target indicator of the planned year from planned value of the current year reasons by key target indicators are applied to the draft of the memorandum.

6. The memorandum is signed by the first head of accountable body and submitted for consideration in Administration of the President of the Republic of Kazakhstan (further - Presidential Administration).

7. In Presidential Administration the draft of the memorandum is considered by the structural division of Presidential Administration assigned to the relevant accountable organ according to appendix 2 to these rules (further - responsible structural division).

8. The responsible structural division carries out succession analysis, justification, reality of achievement, balance on resources, achievements of key target indicators of the memorandum of the planned year and their agreement (dynamics of growth of values) with previous year and with the relevant strategic documents.

9. The draft of the memorandum is considered by the Center of strategic developments and analysis of Presidential Administration which performs project appraisal of the memorandum within the competence and within five working days represents the conclusion to responsible structural division in any form.

10. The responsible structural division introduces to the Head of Presidential Administration the agreed project of the memorandum.

In case of availability of notes, analysis results and project proposals of the memorandum within ten working days from the date of its receipt go to accountable body for the subsequent completion.

The accountable body within five working days finishes, signs and the cover letter repeatedly introduces the draft of the memorandum to Presidential Administration.

The memorandum affirms from the date of signing of the law on the republican budget in a month.

11. Modification and amendments in the memorandum of accountable body is allowed in cases:

1) acceptances new or modification and amendments of higher documents of System of state planning in the Republic of Kazakhstan;

2) changes of functions, structures of accountable body;

3) changes of the parameters of the republican budget influencing achievement of key target indicators.

12. Changes and amendments in cases, stipulated in Item 11 these rules, are brought in the memorandum of accountable body after their approach in a month.

In case of modification and amendments in the memorandum of accountable body the requirements established by these rules in case of its development are observed.

3. Evaluation procedure of the memorandum of accountable body

13. Accountable bodies till February 20 of the year following after accounting year submit in Presidential Administration the report on accomplishment of the memorandum with analytical note.

14. The report on accomplishment of the memorandum contains:

1) name of accountable body;

2) name of the key target indicator;

3) planned value of the key target indicator for accounting year;

4) actual value of the key target indicator;

5) percent of execution of the key target indicator;

6) conclusion of accountable body for achievement and not achievement of key target indicators, and also proposed measures on achievement of key target indicators.
