1. Approve the enclosed Criteria of reference of consumer wastes to secondary raw materials.

2. To provide to department of waste management of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan" within five working days from the date of receipt of the registered order;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Criteria of reference of consumer wastes to secondary raw materials

Chapter 1. General provisions

1. These Criteria of reference of consumer wastes to secondary raw materials (further - Criteria) are developed according to Item 2 of article 297-1 of the Ecological code of the Republic of Kazakhstan of January 9, 2007 (further - the Code).

2. Consumer wastes acquire the status of secondary raw materials, being subjected to transactions as a result of which waste will serve the purpose of partial or complete substitution of raw materials and (or) other materials in products production process, according to Item 1 of article 297-1 of the Code.

3. The terms and determinations used in these Criteria are applied according to the Code.

Chapter 2. Criteria of reference of consumer wastes to secondary raw materials

4. Criteria are:

1) the consumer wastes suitable for further application as secondary raw materials *;

2) consumer wastes which are used as raw materials for further conversion;

3) the consumer wastes which are not containing materials (impurity) exceeding 2% on weight.

Materials (impurity) are: the dust, soil, isolation, chemical or biodegradable substances, concrete and pipes (filled with concrete, wooden fragments or soil), the remaining balance resulting from steel-smelting processes, processes of heat treatment of steel, processing of surface (including cleaning, grindings, sawings up, welding and fire cutting), such as slag, scale, dust of systems of pyleulavlivaniye, grinding dust, slime;

4) the consumer wastes which are not containing oil, oil emulsions, lubricant oils and fats, except for insignificant quantities which are not followed by teardrop;

5) the consumer wastes which are not containing the substances specified in Item 1 of article 287 of the Code.

6) the consumer wastes which are not containing polyvinylchloride in the form of coverings, paints.
