About rendering additional paid services by the bodies registering acts of civil status

According to part six of Article 198 and part two of article 199 of the Code of the Republic of Belarus about scrap and family the Council of Ministers of the Republic of Belarus DECIDES:

1. Determine the list of the additional paid services connected with civil registration, rendered by the bodies registering acts of civil status according to appendix (further - the list of services).

2. Determine that:

2.1. the additional paid services connected with civil registration (further - additional paid services), are departments of civil registration of district, city executive committees and local administrations of areas in the cities, Houses (Palaces) of civil ceremonies of city executive committees, city (the cities of district subordination), settlement, both rural executive and administrative organs (further - bodies of registry office), consular establishments, and also diplomatic representations of the Republic of Belarus in case of accomplishment of consular functions by them (further - foreign institutions of the Republic of Belarus) in the place of the request for implementation of the ministerial procedures provided in Items 5.1 and 5.2 of the list of the ministerial procedures performed by state bodies and other organizations for petitions from citizens No. 200 approved by the Presidential decree of the Republic of Belarus of April 26, 2010 "About the ministerial procedures performed by state bodies and other organizations for petitions from citizens" (The national register of legal acts of the Republic of Belarus, 2010, No. 119, 1/11590) (further - the list), according to the Code of the Republic of Belarus about scrap and family.

The additional paid services provided in Item 11 of the list of services are body of registry office in place of registration of persons who addressed for rendering additional paid service, at the place of residence or the place of stay or on the storage location of record of the act of marriage;

2.2. the additional paid services provided:

in Items 1-3, 5-9, 11 and 12 of the list of services, can be bodies of registry office;

in items 4 and the 10th list of services, can be foreign institutions of the Republic of Belarus;

2.3. the solemn situation of registration of marriage provided in Items 1-3, 5 and 6 of the list of services is provided with body of registry office when making the separate actions connected with implementation of the ministerial procedure provided in Item 5.2 of the list and includes holding ceremony which elements are the congratulatory speech of the official of body of registry office, musical registration (proceeding from material opportunities of body of the registry office or person who addressed for rendering additional paid service), signing of record of the act of marriage, delivery of the certificate on marriage (without cover or in cover with the state symbolics), exchange between spouses of wedding rings (in case of their availability), congratulation of spouses guests (in case of their presence);

2.4. the solemn situation of registration of marriage provided in item 4 of the list of services is provided with foreign institution of the Republic of Belarus when making the separate actions connected with implementation of the ministerial procedure provided in Item 5.2 of the list and includes holding ceremony which elements are the congratulatory speech of the official of foreign institution of the Republic of Belarus, musical registration (proceeding from material opportunities of foreign institution), signing of record of the act of marriage, delivery of the certificate on marriage (without cover), exchange between spouses of wedding rings (in case of their availability);

2.5. the solemn situation of registration of the birth provided in Items 7-9 of the list of services is provided with body of registry office when making the separate actions connected with implementation of the ministerial procedure provided in Item 5.1 of the list and includes holding ceremony which elements are the congratulatory speech of the official of body of registry office, musical registration (proceeding from material opportunities of body of the registry office or person who addressed for rendering additional paid service), signing of the birth statement, delivery of the certificate of birth (without cover or in cover with the state symbolics), congratulation of parents of the child guests (in case of their presence);

2.6. the solemn situation of registration of the birth provided in Item 10 of the list of services is provided with foreign institution of the Republic of Belarus when making the separate actions connected with implementation of the ministerial procedure provided in Item 5.1 of the list and includes holding ceremony which elements are the congratulatory speech of the official of foreign institution of the Republic of Belarus, musical registration (proceeding from material opportunities of foreign institution), signing of the birth statement, delivery of the certificate of birth (without cover);

2.7. holding the ceremonies connected with scrap registration *, provided in Item 11 of the list of services includes holding the ceremonies devoted to memorials of matrimonial life which elements are the congratulatory speech of the official of body of registry office, musical registration (proceeding from material opportunities of body of the registry office or person who addressed for rendering additional paid service), delivery of the congratulatory address, congratulation of spouses by guests (in case of their presence);

* The ceremony connected with scrap registration is understood as holding the ceremony devoted to such memorials of matrimonial life as the 25 anniversary of matrimonial life (silver wedding), the 50 anniversary of matrimonial life (golden wedding), and to others.

2.8. in cases of rendering the additional paid services provided in Items 2 and 6 of the list of services, the necessary elements and attributes, including musical registration which are not contradicting regulations of public morals for holding ceremony are provided by persons who addressed for rendering additional paid service;

2.9. at the request of persons who addressed for rendering the additional paid service provided in Item 11 of the list of services, the ceremony can be added with the elements and attributes, including musical registration which are not contradicting regulations of public morals which are provided by these persons;

2.10. rendering additional paid service in providing solemn situation of the registration of marriage with departure to the venue of celebration provided in Items 5 and 6 of the list of services is performed based on agreements if departure of the official of body of registry office does not interfere with activities of body of registry office, including on providing solemn situation of registration of marriage in body of registry office;

2.11. for providing solemn situation of the registration of marriage out of premises of body of registry office provided in Items 5 and 6 of the list of services, provision of transport, and also compensation of actually made transportation expenses connected with departure of the official of body of registry office to marriage place of registration is performed by persons who addressed for rendering additional paid service;

2.12. the basis for rendering registry office by body, foreign institution of the Republic of Belarus of additional paid services is the statement of persons who addressed for:

implementation of the ministerial procedures provided in Items 5.1 and 5.2 of the list, and which submitted the corresponding application, stipulated by the legislation on which the body of registry office, by foreign institution of the Republic of Belarus makes mark about rendering additional paid service;

rendering additional paid service in holding the ceremonies connected with scrap registration;

2.13. the payment for rendering additional paid services by bodies of registry office, is made by foreign institutions of the Republic of Belarus:

persons who addressed for implementation of the ministerial procedures provided in Items 5.1 and 5.2 of the list for the additional paid services provided in Items 1-10 of the list of services in case of submission of the corresponding statements;

persons who addressed for rendering the additional paid services provided in Items 11 and 12 of the list of services before their rendering;

2.14. information on the rendered additional paid services is placed in bodies of registry office in the place, available to citizens (at information stands, board and (or) different way), and also on the official sites (in case of their availability) executive and administrative organs, foreign institutions of the Republic of Belarus on the global computer Internet.

3. Recommend to local councils of deputies to allocate if necessary the money received from rendering additional paid services by bodies of registry office for strengthening of their material and technical resources.

4. Declare invalid:

the resolution of Council of Ministers of the Republic of Belarus of December 31, 2006 No. 1793 "About some questions of rendering additional paid services by the bodies registering acts of civil status" (The national register of legal acts of the Republic of Belarus, 2007, No. 14, 5/24501);

the resolution of Council of Ministers of the Republic of Belarus of June 30, 2008 No. 967 "About entering of amendment into the resolution of Council of Ministers of the Republic of Belarus of December 31, 2006 No. 1793" (The national register of legal acts of the Republic of Belarus, 2008, No. 161, 5/27954);

the resolution of Council of Ministers of the Republic of Belarus of September 24, 2009 No. 1230 "About entering of amendments and changes into the resolution of Council of Ministers of the Republic of Belarus of December 31, 2006 No. 1793" (The national register of legal acts of the Republic of Belarus, 2009, No. 236, 5/30486);

subitem 1.5 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of June 21, 2011 No. 812 "About change and recognition voided some orders of the Government of the Republic of Belarus concerning pricing" (The national register of legal acts of the Republic of Belarus, 2011, No. 73, 5/34012).

5. This resolution becomes effective since January 1, 2017.

Providing solemn situation of registration of marriage according to the individual scenario (ceremony) with use of different elements and attributes out of premises of body of registry office (in premises of the cultural institutions, rooms located in historical and memorable places in the territory of the objects which are monuments history or architecture in architectural complexes and other places, in the rooms defined by service provision agreements on departure for registration of marriage to the venue of celebration, organizations of criminal executive system, the place of residence of person who addressed for rendering additional paid service, the place of delivery of health care in stationary conditions or in other place).
