About approval of the Regulations on sample and procedure for certification of the translator or simultaneous interpreter having permission to activities in the sector of justice
Based on part (6) article 13 of the Law No. 264 of December 11, 2008 on the status, issue of permissions to activities and the organizations of activities of the simultaneous interpreter and the translator in the sector of justice and Item 7 of the Order of the Government No. 736 of October 3, 2012 about the organization and functioning of the Ministry of Justice (The official monitor of the Republic of Moldova, 2012, 799) I ORDER to Art. No. 212-215,:
1. Approve Regulations on sample and procedure for certification of the translator or the simultaneous interpreter having permission to activities in the sector of justice according to appendix.
2. Publish this order in the Official monitor of the Republic of Moldova.

Appendix
to the Order of the Minister of Justice of the Republic of Moldova of December 4, 2016 No. 952
1. This Provision establishes sample and procedure for certification of the translator and/or simultaneous interpreter having permission to activities (further - the certificate).
2. The certificate represents the official document which confirms profession of its owner and is the non-transferable document.
3. The certificate is issued after payment of fees which amount is established by the Order of the Government.
4. The certificate is drawn up on the plastic card by the 8,5 size of cm x 5,5 see.
5. On the face of the certificate the following elements and information contain:
1) name of the country;
2) the name of the body which issued the certificate;
3) coat of arms of the Republic of Moldova;
4) coat of arms of the Ministry of Justice;
5) photo of the owner;
6) name of the document;
7) series, number of the certificate;
8) surname, name of the translator and/or simultaneous interpreter;
9) name of profession "simultaneous interpreter" and/or "translator";
10) date of issue of the certificate;
11) surname, name of the Minister of Justice;
12) signature of the Minister of Justice;
13) seal of the Ministry of Justice.
6. The elements listed in Item 5, are positioned according to appendix No. 1 to this Provision.
7. On the back certificates contain the following elements and information:
1) the name of the body which issued the certificate;
2) the name of language for which the simultaneous interpreter and/or the translator has permission to activities;
3) the name of profession "simultaneous interpreter" and/or "translator" for whose implementation the owner of the certificate has permission to activities;
4) name of the document;
5) series, number of the certificate.
8. The elements listed in Item 7, are positioned according to appendix No. 2 to this Provision.
9. For certification the simultaneous interpreter or the translator having permission to activities files the following documents on the location of the Ministry of Justice:
1) the statement for certification, with obligatory specifying what photo shall be used in the certificate (the photo from its identity certificate or the passport);
2) the document testimonial of payment of fees for certification, in the original.
10. The Ministry of Justice issues certificates and keeps their account in the special register numbered and registered in the Register of accounting of activities of specialized division.
11. The register of accounting of certificates of the simultaneous interpreters and/or translators having permission to activities is filled and updated by the specialist appointed from specialized division as a part of the Ministry of Justice which joins the following data:
1) sequence number;
2) series, number of the certificate;
3) surname, name of the translator or simultaneous interpreter;
4) series, number and date of issue of permission to activities;
5) language concerning which the translator or the simultaneous interpreter got permission to activities;
6) the signature of the owner which confirms the fact of receipt of the certificate.
12. If the owner of the certificate gets additional permission to activities concerning other language and/or profession, to it, on demand, the new certificate, according to the same rules is issued. In this case the simultaneous interpreter and/or the translator shall return to the Ministry of Justice earlier issued certificate.
13. If the owner of the certificate has permissions to activities for several professions, or concerning one or several languages and refuses one or several of them, to it, on demand, the new certificate, according to the same rules is issued, and the simultaneous interpreter and/or the translator shall return to the Ministry of Justice earlier issued certificate.
14. In case of theft, loss, destruction or damage of the certificate the owner shall notify without delay on it the Ministry of Justice and provide publication of the announcement in the Official monitor of the Republic of Moldova. The evidence about publication of the announcement is produced to the Ministry of Justice.
15. Necessary marks in connection with issue to the owner of the new certificate after payment of new duty, if necessary, are brought in the register of accounting of certificates of the simultaneous interpreters and/or translators having permission to activities.
16. In case of suspension of operations the simultaneous interpreter and/or the translator having permission to activities shall return the certificate to the Ministry of Justice within three working days. After elimination of the reasons which led to suspension of operations of the owner of the certificate, the translator and/or the simultaneous interpreter having permission to the activities having the right to file petition for certification.
17. In case of the activities termination the translator and/or the simultaneous interpreter having permission to activities shall return the certificate to the Ministry of Justice within three working days.
18. If the translator and/or the simultaneous interpreter refuses to return the certificate the Ministry of Justice having the right to start its cancellation, having provided the publication in the Official monitor of the Republic of Moldova of the announcement of cancellation of validity of the certificate.
