AGREEMENT

of April 22, 2016

about Methodology of forming of indicative (forecast) balances of gas, oil and oil products within the Eurasian Economic Union

The Ministry of Energy and Natural Resources of the Republic of Armenia, the Ministry of Economics of the Republic of Belarus, Department of Energy of the Republic of Kazakhstan, the Ministry of Economics of the Kyrgyz Republic and the Ministry of Energy of the Russian Federation which further are referred to as with the Parties for the purpose of effective use of cumulative energy potential of state members of the Eurasian Economic Union (further - state members), optimizations of interstate deliveries of energy resources and ensuring development of indicative (forecast) balances of gas, oil and oil products of the Eurasian Economic Union (further - the Union),

agreed as follows:

Article 1

For the purposes of this agreement concepts which mean the following are used:

"indicative (forecast) balance of state member" - the balance developed by authorized body concerning respectively gas, oil and oil products in the territory of state member for the purposes of forming of indicative (forecast) balance of the Union;

"indicative (forecast) balance of the Union" - the balance created on the basis of indicative (forecast) balances of state members concerning respectively gas, oil and oil products on customs area of the Union;

"authorized body" - the executive body of state member authorized according to the legislation of state member to perform development of indicative (forecast) balances of gas, oil and oil products of state member.

Article 2

For the purpose of implementation of articles 80 and 104 of the Agreement on the Eurasian Economic Union of May 29, 2014 authorized bodies are developed and approve indicative (forecast) balance of gas of the Union, indicative (forecast) balance of oil of the Union and indicative (forecast) balances of oil products of the Union according to Methodology of forming of indicative (forecast) balances of gas, the oil and oil products within the Eurasian Economic Union according to appendix to this agreement which is its integral part.

Article 3

Authorized bodies annually develop indicative (forecast) balance of gas, indicative (forecast) balance of oil and indicative (forecast) balances of oil products (gasoline of automobile, diesel fuel, fuel oil, fuel for jet engines) the state, approve in case of need with each other separate parameters of these indicative balances and send them to the Eurasian economic commission (further - the Commission) till September 5 of the current year.

Article 4

The commission annually on the basis of the approved indicative (forecast) balances of state members provided by authorized bodies performs preparation of indicative (forecast) balance of gas of the Union, indicative (forecast) balance of oil of the Union and indicative (forecast) balances of oil products of the Union.

Article 5

Indicative (forecast) balances of the Union form the single system of indicators used within the Union and in the state members characterizing production, production, consumption, import, export and deliveries, including mutual for satisfaction of internal requirements of state members, gas, oil and oil products in the territories of state members.

Article 6

Indicative (forecast) balances of the Union are annually created for the 5-year period and include the reporting indicators for prior year expected indicators the current year and forecast indicators for three next years.

Article 7

Development of indicative (forecast) balances of state members by authorized bodies is performed on the basis of priority ensuring internal requirements of state members according to the legislation of state members and taking into account the international obligations of state members, general economic and industry forecasts and development programs of state members, forecasts and investing programs of the organizations of fuel and energy complex of state members.

Article 8

Authorized bodies of state members provide completeness and reliability of indicative (forecast) balances of state members.

Article 9

In need of carrying out adjustment of indicative (forecast) balances of gas, oil and oil products of the Union authorized bodies send the corrected indicative (forecast) balances of gas, oil and oil products of state members to the Commission.

Refining of indicative (forecast) balances of the Union can be performed once a year, till October 1 of the current year, taking into account the actual change of gas production, oil, production and gas consumption and oil products of state members.

Article 10

The commission till October 15 of the current year creates the corrected (specified) indicative (forecast) balances of gas, oil and oil products of the Union, publishes them on the official site of the Union in the Internet. The relevant information is reported on Board of the Commission.

Article 11

This agreement is the international treaty signed within the Union and enters the right of the Union.

Article 12

As agreed by the parties changes which are drawn up by separate protocols can be made to this agreement.

This agreement does not affect the rights and obligations of the state members following from other international treaties which participants they are.

Article 13

The disputes connected with interpretation and (or) application of this agreement are permitted according to the procedure, the determined article 112 of the Agreement on the Eurasian Economic Union of May 29, 2014.

Article 14

This agreement becomes effective after 30 calendar days from the date of receipt by depositary of the last written notice of accomplishment by state members of the interstate procedures necessary for the introduction of this agreement in force.

It is made in the city of Moscow on April 22, 2016 in one authentic copy in Russian.

The authentic copy of this agreement is stored in the Eurasian economic commission which, being depositary of this agreement, will send to each state member its verified copy.

Methodology of forming of indicative (forecast) balances of gas, oil and oil products within the Eurasian Economic Union

I. General provisions

1. This Methodology is developed for the purpose of realization of provisions of articles 80 and 104 of the Agreement on the Eurasian Economic Union of May 29, 2014 and determines the main approaches to forming of indicative (forecast) balances of gas, oil and oil products of the Eurasian Economic Union (further - the Union).

2. Indicative (forecast) balances of gas, oil and oil products of the Union form the single system of indicators used within the Union and in state members of the Union (further - state members).

3. Indicative (forecast) balances of gas, oil and oil products of the Union are created for the 5-year period and include the reporting indicators for prior year expected indicators for the current year and forecast indicators for 3 next years.

II. Determinations

4. The concepts used in this Methodology mean the following:

"indicative (forecast) balance of state member" - the balance developed by authorized body concerning respectively gas, oil and oil products in the territory of state member for the purposes of forming of indicative (forecast) balance of the Union;

"indicative (forecast) balance of the Union" - the balance created on the basis of indicative (forecast) balances of state members concerning respectively gas, oil and oil products on customs area of the Union;

"balance" - system of the indicators characterizing production, consumption, other receipts and losses, import and gas export, oil and oil products in the territories of state members or customs area of the Union;

"automobile gasoline" - gasolines automobile all brands;

"gas" - natural gas and associated petroleum gas, and also the gas received as a result of stabilization and deethanizing of condensate gas;

"import":

in indicative (forecast) balances of gas, oil and oil products of state member - the size characterizing amount of gas, oil, the oil products imported on the state member territory therefore the amount of gas, oil and oil products in the territory of state member increases;

in indicative (forecast) balances of gas, oil and oil products of the Union - the size characterizing amount of gas, oil, the oil products imported in the territory of state members therefore the amount of gas, oil and oil products on customs area of the Union increases;

"fuel oil" - furnace fuel oil of all brands;

"oil raw materials" - crude oil and condensate gas;

"losses" - the losses of oil raw materials which are formed when transporting by pipeline transport;

"the recuperated raw materials (secondary oil raw materials)" - the liquid hydrocarbons extracted from associated petroleum gas (*), oil-containing ballast waters of tankers, sludge depots, the contaminated soil, etc.;

"diesel fuel" - diesel fuel of all brands (summer, winter, Arctic and other);

"fuel for jet engines" - fuel for use in jet aviation engines;

"export":

in indicative (forecast) balances of gas, oil and oil products of state member - the size characterizing amount of gas, oil, the oil products which are exported from the state member territory therefore the amount of gas, oil and oil products in the territory of state member decreases;

in indicative (forecast) balances of gas, oil and oil products of the Union - the size characterizing amount of gas, oil and the oil products which are exported from the territories of state members therefore the amount of gas, oil and oil products on customs area of the Union decreases.

III. Structure of indicative (forecast) balances of gas, oil and oil products

5. Indicative (forecast) balances of gas, oil and oil products consist of 2 balanced blocks:

the first block "Receipt Part — Resources" - characterizes structure of production (production) and supply of gas, oil, oil products in state member and contains the following Articles (indicators):

"Production (production)";

"Other receipts";

"Import from state members";

"Import from the third states";

the second block "Account Part — Distribution" - characterizes structure of distribution of gas, oil, oil products in state member and contains the following Articles (indicators):

"Export to state members";

"Export to the third states";

"Delivery to the domestic market";

"Losses".

6. Features of forming of individual clauses (indicators) of indicative (forecast) balances of gas, oil and oil products are determined in the Section IV of this Methodology.

7. Measure values of indicative (forecast) balances of gas, oil and oil products are given in physical units of measurement:

for gas - in billions of cubic meters;

for oil raw materials - in millions of tons;

for gasoline of automobile, diesel fuel, fuel oil and fuel for jet engines - in thousands of tons.

When forming indicative (forecast) balances of gas, oil and oil products of state members authorized bodies of state members carry out approval with each other of import indicators from state members and export to state members for satisfaction of internal requirements of state members. The indicators characterizing import from the third states and export to the third states are given in indicative (forecast) balances of gas, oil and oil products of state members and indicative (forecast) balances of gas, oil and oil products of the Union for information only and do not require approval by the Eurasian economic commission and state members.

IV. Features of forming of individual clauses (indicators) of indicative (forecast) balances

1. Indicative (forecast) balance of gas

8. The indicative (forecast) balance of gas of state member is developed in form according to appendix No. 1 to this Methodology.

9. The indicative (forecast) balance of gas of the Union is created in form according to appendix No. 2 to this Methodology.

10. In the article "Gas Production, including Oil Passing" the total amount of production from subsoil natural and associated petroleum gas is specified.

The amount of the associated petroleum gas burned in torches does not join in the article "Gas Production, including Oil Passing".

The amount of the gas pumped back in layer does not join in the article "Gas Production, including Oil Passing".

11. In the article "Other Receipts" are considered gas of stabilization and deethanizing of condensate gas, and also change of inventories of gas in underground gas storages and in pipeline networks.

12. In the article "Import" subarticles for display of import volumes (deliveries) of gas are selected with pipeline transport.

13. In the article "Export" subarticles for display of export volumes (deliveries) of gas with pipeline transport and in the form of liquefied natural gas are selected.

2. Indicative (forecast) balance of oil raw materials

14. The indicative (forecast) balance of oil raw materials of state member is developed in form according to appendix No. 3 to this Methodology.

15. The indicative (forecast) balance of oil raw materials of the Union is created in form according to appendix No. 4 to this Methodology.

16. In the article "Oil Extraction, including Gas Condensate" the amount of production of oil raw materials from subsoil is specified.

17. In the article "Other Receipts" the production volume of the recuperated oil raw materials, and also change of remaining balance of oil raw materials in system of the main pipeline transport, in reservoirs of oil refineries and subsoil users is considered.

18. In the article "Import" subarticles for display of import volumes (deliveries) of oil raw materials are selected with pipeline transport.

19. In the article "Export" subarticles for display of export volumes (deliveries) of oil raw materials are selected with pipeline transport.

20. Losses in case of production and stabilization of oil raw materials do not join in Articles of indicative (forecast) balance of oil raw materials, except the losses of oil raw materials which are formed when transporting by pipeline transport.

3. Indicative (forecast) balance of gasoline automobile

21. The indicative (forecast) balance of gasoline of automobile state member is developed in form according to appendix No. 5 to this Methodology.

22. The indicative (forecast) balance of gasoline of the automobile Union is created in form according to appendix No. 6 to this Methodology.

23. In the article "Production" the production volume of gasoline automobile at oil refineries is specified.

24. In the article "Other Receipts" changes of inventories of gasoline of the automobile main nefteproduktoprovodny transport in system, in reservoirs of oil refineries and companies of oil product supply are considered.

25. In the article "Import" of subarticle for display of import volumes (deliveries) of gasoline automobile are not allocated with pipeline transport.

26. In the article "Export" of subarticle for display of export volumes (deliveries) of gasoline automobile are not allocated with pipeline transport.

4. Indicative (forecast) balance of diesel fuel

27. The indicative (forecast) balance of fuel of diesel state member is developed in form according to appendix No. 7 to this Methodology.

28. The indicative (forecast) balance of fuel of the diesel Union is created in form according to appendix No. 8 to this Methodology.

29. In the article "Production" the production volume of diesel fuel at oil refineries is specified.

30. In the article "Other Receipts" changes of fuel reserves of the diesel main nefteproduktoprovodny transport in system, in reservoirs of oil refineries and companies of oil product supply are considered.

31. In the article "Import" subarticles for display of import volumes (deliveries) of diesel fuel pipeline transport are not selected.

32. In the article "Export" subarticles for display of export volumes (deliveries) of diesel fuel pipeline transport are not selected.

5. Indicative (forecast) balance of fuel oil

33. The indicative (forecast) balance of fuel oil of furnace state member is developed in form according to Appendix No. 9 to this Methodology.

34. The indicative (forecast) balance of fuel oil of the furnace Union is created in form according to appendix No. 10 to this Methodology.

35. In the article "Production" the amount of commodity production of fuel oil at oil refineries is specified. The expense on technological needs of oil refineries in balances of fuel oil does not join.

36. In the article "Other Receipts" changes of inventories of fuel oil in reservoirs of oil refineries and companies of oil product supply are considered.

6. Indicative (forecast) balance of fuel for jet engines

37. The indicative (forecast) balance of fuel is developed for jet engines of state member in form according to appendix No. 11 to this Methodology.

38. The indicative (forecast) balance of fuel for jet engines of the Union is created in form according to appendix No. 12 to this Methodology.

39. In the article "Production" the fuel production volume for jet engines at oil refineries is specified.

40. In the article "Other Receipts" changes of fuel reserves for jet engines in system of the main nefteproduktoprovodny transport, in reservoirs of oil refineries and companies of oil product supply are considered.

41. In the article "Import" subarticles for display of import volumes (deliveries) of fuel for jet engines are not selected with pipeline transport.

42. In the article "Export" subarticles for display of export volumes (deliveries) of fuel for jet engines are not selected with pipeline transport.
