About measures for implementation of the Law of the Republic of Belarus "About industrial safety"

Based on paragraphs of the third or tenth of article 8 of the Law of the Republic of Belarus of January 5, 2016 "About industrial safety" the Council of Ministers of the Republic of Belarus DECIDES: No. 354-Z

1. Approve:

The regulations on procedure for carrying out identification of hazardous production facilities (are applied);

The regulations on order of registration of hazardous production facilities (are applied);

The regulations on procedure for maintaining the state register of hazardous production facilities (are applied);

The regulations on order of registration of potentially dangerous objects (are applied);

The regulations on procedure for issue of permissions (certificates) to the right of accomplishment of separate work types (rendering separate types of service) when implementing activities in the field of industrial safety (are applied);

The regulations on procedure for certification of experts in the field of industrial safety (are applied);

The regulations on procedure for expertize of industrial safety (are applied);

Regulations on procedure for development, registration and submission of the declaration of industrial safety, introduction in it of changes and (or) amendments and accounting of such declarations (are applied);

the list of potentially dangerous objects and the technical devices operated on them which are subject to examination of industrial safety (is attached).

2. No. 175 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 25.03.2022

3. In six-months time to provide to subjects of industrial safety carrying out identification of hazardous production facilities and to register hazardous production facilities, potentially dangerous objects according to the procedure, established by this resolution.

4. To the Ministry of Emergency Situations to take measures for implementation of this resolution.

5. This resolution becomes effective after its official publication.

Regulations on procedure for carrying out identification of hazardous production facilities

1. This Provision determines procedure for carrying out identification of hazardous production facilities by Department by supervision of safe operation in the industry of the Ministry of Emergency Situations (further – the Gospromnadzor), and also management of the state supervision of the main military inspection of Armed Forces of the Republic of Belarus, the Ministry of Internal Affairs, the State boundary committee, Committee for State Security, central office of the State committee of judicial examinations (further – the bodies which are carrying out identification) and subjects of industrial safety.

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus "About industrial safety" and also the following term and its determination are applied:

identification of hazardous production facility – reference of object to hazardous production facility in the course of determination and identification of borders of hazardous production facility and type of its danger by establishment of availability of dangerous substances, products, materials and (or) production factors, technical devices according to requirements of the Law of the Republic of Belarus "About industrial safety".

3. In the course of identification of hazardous production facilities the following basic principles are applied:

the principle of zoning - identification of all hazardous production facilities belonging to the subject of industrial safety at the same time as the combining criterion the building, the workshop, the site, the platform, the technical territory on which hazardous production facilities are placed and where engineering procedures are performed are used. If hazardous production facilities are located at distance less than 500 meters, belong to one subject of industrial safety and are united in single production cycle, then one identification of all hazardous production facilities is carried out;

the principle of completeness and reliability of identification - identification and fixation of all signs of danger and the type of each hazardous production facility belonging to the subject of industrial safety;

the principle of absorption by more dangerous type of hazardous production facility of less dangerous type of such object - in case of simultaneous availability on object of the signs of danger characteristic of I, II or III types of hazardous production facilities, such object concerns to more dangerous type of hazardous production facility.

4. Identification of hazardous production facility is carried out by the worker of the subject of industrial safety having the highest Identification of hazardous production facility carried out by the worker of the subject of industrial safety having the higher technical education, work experience in the corresponding industry at least 3 years, who underwent examination concerning industrial safety in the procedure established by the legislation.

In the absence of possibility of carrying out identification of such object by own forces the subject of industrial safety has the right to sign the agreement with the Gospromnadzor on its carrying out by the official the Gospromnadzor.

In the absence of possibility of carrying out by the subject of industrial safety of identification of the hazardous production facilities belonging to Armed Forces of the Republic of Belarus and transport troops, law-enforcement bodies and internal troops of the Ministry of Internal Affairs, bodies of the border service, the state security agencies, the State committee of judicial examinations, identification of these objects is carried out by the official of relevant organ.

5. The analysis of correctness of carrying out identification of hazardous production facility by the subject of industrial safety is performed by the Gospromnadzor and bodies which are carrying out identification.

6. Identification of hazardous production facility is carried out in the place of its stay based on the analysis:

constituent documents of the subject of industrial safety;

the documents confirming the property right and other corporeal rights of the subject of industrial safety to hazardous production facility;

the master plan of arrangement of the buildings, constructions, production sites and sites belonging to the subject of industrial safety;

data on appointment of hazardous production facility, the applied technologies, the main and auxiliary productions;

data on potentially dangerous objects operated as a part of hazardous production facility;

data on the name and amount of dangerous substances on hazardous production facility (in case of their availability);

project (project and technical), executive and operational documentation on potentially dangerous objects operated as a part of hazardous production facility, and their specification;

allowing documents (permissions, certificates of conformity and others) on application of potentially dangerous objects and technical devices operated as a part of hazardous production facility;

technical reports on carrying out commissioning, regime and adjustment testing of potentially dangerous objects and technical devices operated as a part of hazardous production facility and subjects to adjustment (for the objects requiring carrying out commissioning).

For completeness and correctness of carrying out identification of hazardous production facility the Gospromnadzor and bodies which are carrying out identification have the right to request from the subject of industrial safety the additional information about this subject of industrial safety and hazardous production facility taking into account specifics of production organization.

7. The name and type are appropriated to hazardous production facility by results of its identification according to appendix 1 to the Law of the Republic of Belarus "About industrial safety". In the name of hazardous production facility there shall not be reducings, except for commonly accepted.

8. By results of carrying out identification of hazardous production facility the conclusion in duplicate with conclusions about its reference to hazardous production facility and establishment like its danger is drawn up.

9. Based on the conclusion specified in Item 8 of this provision, the subject of industrial safety draws up the accounting card of hazardous production facility in form according to appendix in duplicate.

The accounting card of hazardous production facility is signed by the head of the subject of industrial safety.

10. Repeated identification of hazardous production facility is carried out in the following cases attracting change like danger of hazardous production facility:

change of amount of dangerous substance on hazardous production facility;

change of types of dangerous substances, products, materials and (or) production factors, potentially dangerous objects, the technical devices used on hazardous production facility and also change owing to reconstruction, technical upgrade of hazardous production facility, change of engineering procedures;

change of regulations of the legislation in the field of industrial safety.

11. In case of reorganization or liquidation of the subject of industrial safety in case of which there do not occur the changes provided in Item 10 of this provision, of carrying out repeated identification of object it is not required.

Regulations on order of registration of hazardous production facilities

1. This Provision determines order of registration of hazardous production facilities, issues of the registration certificate of hazardous production facility, modification and (or) amendments in it, issues of the duplicate of the certificate.

2. For the purposes of this provision terms and their determinations in the values established by the Law of the Republic of Belarus "About industrial safety" are used.

3. Hazardous production facilities are registered in the location of subjects of industrial safety, except for foreign and international legal entities whose place of registration of hazardous production facilities is the location of the representation opened in accordance with the established procedure in the territory of the Republic of Belarus.

4. Registration of hazardous production facilities perform Department on supervision of safe operation in the industry of the Ministry of Emergency Situations, and concerning the hazardous production facilities belonging to Armed Forces of the Republic of Belarus and transport troops, law-enforcement bodies and internal troops of the Ministry of Internal Affairs, bodies of the border service, the state security agencies, the State committee of judicial examinations – respectively management of the state supervision of the main military inspection of Armed Forces of the Republic of Belarus, the Ministry of Internal Affairs, the State boundary committee, Committee for State Security, central office of the State committee of judicial examinations (further – registering bodies).

5. For registration of hazardous production facilities subjects of industrial safety submit in registering body the application in form according to appendix 1, and also the accounting card of object in duplicate, the conclusion by results of carrying out identification of object (in case of carrying out identification of object by the worker of the subject of industrial safety).

6. The hazardous production facility is registered from the date of entering of information about him into the state register of hazardous production facilities.

7. In case of registration the individual number consisting of the Arab figures taking into account structure of individual number of hazardous production facility according to appendix 2 is assigned to hazardous production facility. This individual number is fixed in the state register of hazardous production facilities.

8. By results of registration of hazardous production facility to the subject of industrial safety by the registering body grants the registration certificate of hazardous production facility in form according to appendix 3 (further - the certificate).

9. The certificate number consists of two groups of the signs divided among themselves by hyphen where the first group of signs corresponds to five-digit digital code of the registering body which issued it, the second group of signs - to registration certificate number in the departmental Section of the state register of hazardous production facilities which first figure designates number of the region of the Republic of Belarus (1 - the Brest region, 2 - the Vitebsk region, 3 - the Gomel region, 4 - the Grodno region, 5 - the Minsk region, 6 - the Mogilev region, 7 - the city of Minsk) where the subject of industrial safety is registered.

The code of the registering body which granted the certificate is determined based on the qualifier "State governing bodies".

10. In case of modification of the data containing in the state register of hazardous production facilities which attract need of change of the data containing in the certificate the new certificate is granted.

Number of the new certificate corresponds to certificate number instead of which it is issued.

10-1. For modification of the registration certificate of hazardous production facility subjects of industrial safety submit in registering body the application in form according to appendix 1, the original certificate about registration of hazardous production facility, the accounting card of object, the copy of the documents confirming the happened changes (including the fact of transfer of object on a leasehold basis or other corporeal right).

11. The certificate is granted to the head of the subject of industrial safety in case of presentation of the original and copy of the document certifying official position of the head (the order on position assignment of the head, or the statement from the decision of general meeting, board or other governing body of the subject of industrial safety, either the employment contract (contract), or the civil agreement), and also the original document proving his identity or to the representative of the subject of industrial safety to presentation of the original document proving his identity, warrants for receipt of the certificate.
