Approve the enclosed Rules of implementation by the Federal Service of troops of national guard of the Russian Federation and its territorial authorities of federal state control (supervision) of safety of objects of fuel and energy complex.

Rules of implementation by the Federal Service of troops of national guard of the Russian Federation and its territorial authorities of federal state control (supervision) of safety of objects of fuel and energy complex

I. General provisions

1. These rules establish procedure the Federal Service of troops of national guard of the Russian Federation and its territorial authorities of actions for federal state control (supervision) of safety of objects of fuel and energy complex (further respectively - the state control (supervision), state control (supervision) body.

2. Actions for the state control (supervision) include actions of the official (persons) of state control (supervision) body for consideration of documents of the subject of fuel and energy complex, check of objects of fuel and energy complex regarding compliance of their condition to requirements of safety of objects of fuel and energy complex and anti-terrorist security of objects of fuel and energy complex according to the Federal Law "About Safety of Objects of Fuel and Energy Complex" (further respectively - requirements of safety, check).

3. The state control (supervision) is exercised by conducting documentary and exit checks which can have planned and unplanned character.

4. It can be performed only by the official (persons) of state control (supervision) body which is specified in the instruction conducting planned inspection or the order of the head (person, it replacing) of state control (supervision) body about carrying out unscheduled inspection.

5. Duration of conducting check shall not exceed 20 working days. In exceptional cases, the difficult and (or) long researches connected with need of carrying out, testing, special examinations and investigations, based on motivated proposals of the official (persons) of the state control (supervision) body performing scheduled inspection, the head (person, it replacing) state control (supervision) body the term of its carrying out can be prolonged, but no more than for 20 working days.

6. Conducting checks concerning object of fuel and energy complex on which works with use of the data which are the state secret are carried out and acquaintance with such data are performed taking into account requirements of the legislation of the Russian Federation about the state secret.

7. Under the organization of verifications of the information about subjects of fuel and energy complex, including allowing documents, available other state bodies, local government bodies or subordinated to state bodies or local government bodies of the organizations, are requested by means of interdepartmental information exchange.

II. Organization and conducting planned inspection

8. Subject of scheduled inspection is observance by subjects of fuel and energy complex of requirements of safety.

9. Scheduled inspection concerning objects of fuel and energy complex is carried out not more often than once a year for objects of fuel and energy complex of high and average category of danger and once in 3 years for objects of fuel and energy complex of low category of danger, since end date of the previous check.

10. The annual plan of conducting planned inspections is developed and affirms till November 1 of the year preceding year of conducting planned inspections, the head of state control (supervision) body in the subject of the Russian Federation in coordination with the anti-terrorist commission in the subject of the Russian Federation.

11. The standard form of the annual plan of conducting planned inspections is established by the Federal Service of troops of national guard of the Russian Federation.

12. The approved annual plan of conducting planned inspections goes till December 1 of the year preceding year of conducting planned inspections to the Federal Service of troops of national guard of the Russian Federation for forming of the consolidating annual plan of conducting planned inspections.

13. The annual plan of conducting planned inspections is placed till December 31 of the year preceding year of conducting planned inspections on the official site of state control (supervision) body on the Internet, except for information which free distribution is forbidden or limited in accordance with the legislation of the Russian Federation.

14. The annual plan of conducting planned inspections contains the following information:

a) name and location of object of fuel and energy complex, category of danger of object of fuel and energy complex and end date of the last check;

b) start date of conducting the planned check;

c) term of conducting check;

d) purpose and bases of conducting check;

e) the information about the subject of fuel and energy complex (the name of the legal entity or surname, name and middle name of physical person, owning object of fuel and energy complex on the property right or other legitimate right).

15. Subjects of fuel and energy complex, either the head of the subject of fuel and energy complex, or other official of the subject of fuel and energy complex to who functions on the organization of safety of objects of fuel and energy complex are assigned and which is given authority on representation of interests of the subject of fuel and energy complex when implementing the state control (supervision) (further - authorized representatives of the subject of fuel and energy complex) are notified by relevant organ of the state control (supervision) no later than 3 working days prior to its carrying out by means of the direction on conducting planned inspection by the registered mail with the assurance of receipt or other available method allowing to confirm the fact of delivery of such notification, the information letter with appendix of the statement from the annual plan of conducting planned inspections.

16. Scheduled inspection is carried out based on the approved annual plan of conducting planned inspections and the instruction on conducting check issued by the head of state control (supervision) body. In the instruction the position, surname, name and middle name of the official who is entrusted with the conducting planned inspections, number and effective period of the instruction, and also position, surname, name and middle name of the head who issued the instruction are specified conducting check.
