About approval of the Technical regulation of low-voltage electric equipment

According to article 5 of the Law of Ukraine "About technical regulations and assessment of conformity" the Cabinet of Ministers of Ukraine decides:

1. Approve the Technical regulation of low-voltage electric equipment which is attached.

2. Provide to the Ministry of economic development and trade implementation of the Technical regulation approved by this resolution.

3. Determine that provision in the market of low-voltage electric equipment which conforms to requirements of the Technical regulation of the low-voltage electric equipment approved by the resolution of the Cabinet of Ministers of Ukraine of October 29, 2009 No. 1149 (The Official Bulletin of Ukraine, 2009, No. 83, of Art. 2822; 2012, No. 66, the Art. 2702), it was also introduced into circulation before entry into force of this resolution, it cannot be forbidden or limited for the reasons of discrepancy of such equipment to requirements of the Technical regulation approved by this resolution.

4. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

5. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

6. This resolution becomes effective in six months from the date of its publication.

Technical regulation of low-voltage electric equipment

General part

1. This Technical regulation establishes requirements for protection of health and safety of people and pets and property to which low-voltage electric equipment shall answer (further - materials) for the purpose of its provision in the market of Ukraine.

This Technical regulation is developed on the basis of the Directive 2014/35/EU of the European Parliament and Council of February 26, 2014 about harmonization of the legislation of state members on provision in the market of the electric equipment, held for use in certain limits of tension.

2. Action of this Technical regulation extends to electric equipment, held for use with rated voltage from 50 to 1000 V of alternating current and from 75 to 1500 V of direct current, except the equipment and the phenomena specified in appendix 1.

3. The terms used in this Technical regulation have the following value:

introduction into circulation - provision of electric equipment in the market of Ukraine for the first time;

retirement - any action directed to prevention of provision in the market of electric equipment which is in products supply chain;

the producer - any physical person or legal entity (the resident or the nonresident of Ukraine) which makes electric equipment or charges its development or production also realizes this equipment under the name or trademark;

response - any action aimed at providing return of electric equipment which was already provided to the consumer (user);

the harmonized European standard - the standard accepted by one of the European standardization organizations on the basis of the request made by the European Commission and number and which name it is published in "The official magazine of the European Union";

mark of conformity to technical regulations - marking by means of which the producer specifies that electric equipment conforms to requirements which are applied to the specified electric equipment and are determined in technical regulations which provide drawing this marking;

the importer - any physical or legal resident person of Ukraine who introduces into market circulation of Ukraine electric equipment origin from other country;

provision in the market - any paid or free delivery of electric equipment for distribution, consumption or use in the market of Ukraine in the course of implementation of economic activity;

assessment of conformity - process of the proof that the purposes connected with safety, specified in item 4 of this Technical regulation and the concerning electric equipments determined in appendix 2,, were executed;

the distributor - any other, than the producer or the importer, physical person or legal entity in products supply chain which provides materials in the market of Ukraine;

subjects of managing - the producer, the authorized representative, the importer and the distributor;

the technical specification - the document establishing technical requirements to which shall satisfy electric equipment;

the authorized representative - any physical or legal resident person of Ukraine who received the written order from the producer to act from his name in relation to the tasks determined in this order.

In this Technical regulation the terms "risk", "technical regulation" are used in the value given in the Law of Ukraine "About technical regulations and assessment of conformity"; the term "inadequate application of mark of conformity to technical regulations" - in the value given in the Law of Ukraine "About the state market supervision and control of non-food products"; the term "products supply chain" - in the value given in the Law of Ukraine "About general safety of non-food products"; the terms "international standard", "national standard" - in the value given in the Law of Ukraine "About standardization".

4. Electric equipment can be provided in the market of Ukraine only in case after production according to proper engineering practice on safety issues which is applied in Ukraine it does not pose health hazard and safety of people and pets or to property on condition of proper installation, servicing and application according to the destination.

Basic elements of the purposes connected with safety for electric equipment are specified in appendix 2.

5. Provision in the market of electric equipment meeting the requirements of this Technical regulation cannot be forbidden or limited concerning those aspects which are covered by this Technical regulation.

Delivery of electrical energy

6. Electric power suppliers cannot establish more strict requirements on the safety of electric equipment, than the purposes connected with safety, specified in item 4 of this Technical regulation and determined in appendix 2 (further the purposes connected with safety), concerning accession to power network or delivery of electrical energy to users of electric equipment.
