About approval of the Procedure for the organization of interaction of National guard of Ukraine and National police of Ukraine when ensuring (protection) public (public) safety and procedure

According to article 2 of the Law of Ukraine "About National police", to part one of article 2 of the Law of Ukraine "About National guard of Ukraine", for the purpose of determination of procedure for joint attraction of forces and means of National police and National guard of Ukraine on ensuring (protection) public (public) safety and procedure I order:

1. Approve the Procedure for the organization of interaction of National guard of Ukraine and National police of Ukraine when ensuring (protection) public (public) safety and procedure which is applied.

2. To department of forming of policy for authorities and monitoring under control to the Minister (Bodnar V. E.) provide submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. This order becomes effective from the date of its official publication.

4. I reserve control of execution of this order.

Procedure for the organization of interaction of National guard of Ukraine and National police of Ukraine when ensuring (protection) public (public) safety and procedure

1. This Procedure determines the mechanism of the organization of interaction of National guard of Ukraine (further - NSU) and National police of Ukraine in the field of ensuring (protection) public (public) safety and procedure.

This Procedure is effective in peace time, except for the period of emergency state.

2. This Procedure is developed according to the Laws of Ukraine "About National guard of Ukraine", "About National police", other laws, acts of the President of Ukraine and resolutions of the Cabinet of Ministers of Ukraine concerning questions of providing (protection) of public (public) safety and procedure.

3. Are involved in ensuring (protection) public (public) safety and procedure:

from National guard of Ukraine - military units (divisions) to which functions on protection of public order are assigned (further - military units of NSU);

from National police of Ukraine - territorial authorities of National police in the Autonomous Republic of Crimea and the city of Sevastopol, areas and the city of Kiev, their separate divisions (further - police agencies).

4. Interaction between NSU and National police of Ukraine is performed in the limits determined by the legislation, including this Procedure, namely way:

joint patrol by job specifications of streets, areas, parks, squares, stations, airports, sea and river ports, other public (public) places;

ensuring (protection) public (public) safety and procedure during meetings, meetings, street processions, demonstrations, other mass and sporting events, and also during the actions in public (public) places with participation of persons concerning whom the state protection is performed;

holding joint actions for the purpose of stabilization of operational situation in case of its aggravation within the territory of one or several administrative and territorial units.

5. Interaction of NSU and National police of Ukraine on suppression of mass riots is performed according to requirements of the legislation.

6. Forces and funds of NSU are raised to ensuring (protection) public (public) safety and procedure:

1) for accomplishment of the tasks specified in the paragraph the second item 4 of this Procedure based on the Plan of attraction of forces and means of military unit 0000 to service on protection of public order (according to appendix) which is developed for a period of month, affirms the commander of military unit of NSU and is approved with the chief of relevant organ of police within the territory of its jurisdiction.

In need of the Plan of attraction of forces and means of military unit 0000 to service on protection of public order changes which affirm and approved in the procedure established above are made;

2) for accomplishment of tasks, the specified in paragraphs three and the fourth item 4 of this Procedure, - based on signed by the chief of head departments of National police in the Autonomous Republic of Crimea and the city of Sevastopol, areas and the city of Kiev of the written request addressed to the chief of territorial administration of NSU on allocation of forces and means of NSU within area where the military unit of NSU, zones of responsibility (rapid response) of this operational and territorial merging of NSU is deployed.

The chief of territorial administration of NSU in writing informs the commander of NSU for the purpose of further carrying out control measures behind accomplishment of the assigned office and fighting tasks on the made decision.

7. In the written request on allocation of forces and means of NSU the purpose of involvement of the military personnel, their quantity, necessary individual protection equipment and special means, arms, firearms, military equipment, other material means, time, the place of arrival, the responsible official of territorial authority of police who exercises control of service are specified.

8. In case of sudden aggravation of operational situation heads of head departments of National police in the Autonomous Republic of Crimea and the city of Sevastopol, areas and the city of Kiev for the purpose of timely response to threats of public (public) safety and procedure or the termination of their violation address the chief of territorial administration of NSU within its zone of responsibility (rapid response) with oral request about attraction of forces and means of military units of NSU. The request in the shortest possible time (no later than 24 hours since the beginning of service) is drawn up in writing and goes in accordance with the established procedure to territorial administration of NSU.
