About approval of the Regulations on procedure for assignment of diplomatic ranks

(as amended on 18-01-2021)

According to article 11 of the Law of the Republic of Kazakhstan of March 7, 2002 "About diplomatic service of the Republic of Kazakhstan" I decide:

1. Approve the enclosed Regulations on procedure for assignment of diplomatic ranks.

2. This Decree becomes effective from the date of signing.

Regulations on procedure for assignment of diplomatic ranks

1. General provisions

1. This Provision is effective according to the Law of the Republic of Kazakhstan of March 7, 2002 "About diplomatic service of the Republic of Kazakhstan" and regulates procedure for assignment of diplomatic ranks to the staff of diplomatic service (daleesotrudnik).

2. Procedure for assignment of diplomatic ranks

2. The following diplomatic ranks are appropriated to employees:

1) attache;

2) third secretary;

3) second secretary of the II class;

4) second secretary of the I class;

5) first secretary of the II class;

6) first secretary of the I class;

7) adviser of the II class;

8) adviser of the I class;

9) Minister extraordinary and plenipotentiary of the II class;

10) Minister extraordinary and plenipotentiary of the I class;

11) Ambassador extraordinary and plenipotentiary.

3. Diplomatic ranks of the Ambassador extraordinary and plenipotentiary, Minister extraordinary and plenipotentiary of I and II classes are appropriated by the President of the Republic of Kazakhstan on representation of the Minister of Foreign Affairs of the Republic of Kazakhstan.

Representation on assignment of above-mentioned diplomatic ranks is brought by the Minister of Foreign Affairs of the Republic of Kazakhstan to the President of the Republic of Kazakhstan taking into account efficiency of participation in realization of foreign policy of the Republic of Kazakhstan and efficiency of participation in realization of foreign policy initiatives of the President of the Republic of Kazakhstan.

The diplomatic rank of the Ambassador extraordinary and plenipotentiary can be appropriated to the staff of diplomatic service having years of service of diplomatic service at least two years to positions of the Ambassador extraordinary and plenipotentiary of the Republic of Kazakhstan, the Permanent representative of the Republic of Kazakhstan under the international organization.

The diplomatic rank of the Minister extraordinary and plenipotentiary of the I class can be appropriated to the staff of diplomatic service holding position of the Minister of Foreign Affairs of the Republic of Kazakhstan, the Ambassador extraordinary and plenipotentiary of the Republic of Kazakhstan, the Permanent representative of the Republic of Kazakhstan under the international organization, the deputy minister of foreign affairs of the Republic of Kazakhstan.

The diplomatic rank of the Minister extraordinary and plenipotentiary of the II class can be appropriated to the staff of diplomatic service holding position not below the chairman of committee, the ambassador at large of the Ministry of Foreign Affairs, the department director, the chargê d'affaires of the Republic of Kazakhstan, the consul general of the Republic of Kazakhstan.

Other diplomatic ranks are appropriated by the Minister of Foreign Affairs of the Republic of Kazakhstan on representation of heads of foreign institutions or structural divisions of the Ministry of Foreign Affairs of the Republic of Kazakhstan.

4. For employees the following terms of stay in diplomatic ranks are established:

1) for the attache, the third secretary, the second secretary II and I classes - two years;

2) for the first secretary II and I classes, the adviser of the II klassatra of year.

Terms of stay in diplomatic ranks from the adviser of the I class are not established above.

5. In terms of stay of employees in diplomatic ranks are set off:

1) work in the Ministry of Foreign Affairs of the Republic of Kazakhstan and its subordinated organizations;

2) work in foreign institutions;

3) work in representative offices of the Ministry of Foreign Affairs of the Republic of Kazakhstan in the territory of the Republic of Kazakhstan;

4) work in the Ministries of Foreign Affairs of the former USSR and federal republics;

5) work in the international organizations;

6) scientific or teaching activities in higher educational institutions and scientific institutions of the Ministry of Foreign Affairs of the Republic of Kazakhstan;

7) advanced training through the Ministry of Foreign Affairs of the Republic of Kazakhstan in educational and scientific institutions;

8) study temporarily sent by the Ministry of Foreign Affairs of the Republic of Kazakhstan to higher educational institutions, postgraduate study, doctoral studies and scientific institutions.

6. Assignment of diplomatic rank to the employee is made consistently in case of the positive characteristic taking into account post, length of service and qualification.

Diplomatic ranks remain for life, except as specified, provided in article 13 of the Law of the Republic of Kazakhstan "About diplomatic service of the Republic of Kazakhstan".

7. Depending on the sequence of assignment diplomatic ranks are subdivided into the first and next.

8. The first diplomatic rank is appropriated after the occupation in the procedure for established diplomatic post established by the legislation in bodies of diplomatic service taking into account knowledge, years of service and work experience in the specialty.

The diplomatic rank of the employee, as a rule, shall correspond to post of diplomatic service.

9. The next diplomatic rank is appropriated taking into account post, time of stay in former diplomatic rank, the characteristic and results of the last employee assessment.

10. The officials specified in Item part six 3 this provision shall no later than 1 (one) month before the expiration of terms of stay in the corresponding diplomatic rank, provide the employee to assignment of the next diplomatic rank.

11. For non-execution and improper execution by the employee of the obligations assigned to it, abuse of office, violation of the state and labor discipline, and for non-compliance the stipulated in Clause 20 Laws of the Republic of Kazakhstan "About diplomatic service of the Republic of Kazakhstan" restrictions for the employee authority punishment in the form of delay in assignment of diplomatic rank up to one year can equally be imposed.
