About approval of the Technical regulation on electromagnetic compatibility of the equipment

According to article 5 of the Law of Ukraine "About technical regulations and assessment of conformity" the Cabinet of Ministers of Ukraine decides:

1. Approve the Technical regulation on electromagnetic compatibility of the equipment which is attached.

2. Provide to the Ministry of economic development and trade implementation of the Technical regulation approved by this resolution.

3. Determine that provision in the market and/or commissioning of the equipment meeting the requirements of the Technical regulation for electromagnetic compatibility of the equipment approved by the resolution of the Cabinet of Ministers of Ukraine of July 29, 2009 No. 785 (The Official Bulletin of Ukraine, 2009, No. 58, the Art. 2028), and it was introduced into circulation about day of entry into force of this resolution, it cannot be forbidden or limited for the reasons of discrepancy of such equipment to requirements of the Technical regulation approved by this resolution.

4. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

5. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

6. This resolution becomes effective in six months from the date of its publication.

The technical regulation on electromagnetic compatibility of the equipment

General part

1. This Technical regulation establishes requirements to the equipment for the purpose of representation in the market of Ukraine of the equipment answering to the due level of electromagnetic compatibility.

This Technical regulation is developed on the basis of the Directive 2014/30/EU of the European Parliament and Council of February 26, 2014 about harmonization of the legislation of state members on electromagnetic compatibility.

2. Action of this Technical regulation extends to any equipment or stationary installation.

3. Action of this Technical regulation does not extend on:

1) the equipment to which action of the Technical regulation of the radio equipment approved by the resolution of the Cabinet of Ministers of Ukraine of May 24, 2017 No. 355 (The Official Bulletin of Ukraine, 2017, No. 45, of the Art. 1396) extends;

2) products of the aircraft equipment in the value given in Item 27 parts one of article 1 of the Air code of Ukraine;

2-1) aviation components and equipment: any device, the equipment, the mechanism, detail, the equipment, the extra, program providing or the auxiliary device, including the communication equipment, used or held for use in case of operation of the aircraft or control of the aircraft in flight; it includes parts of glider of the aircraft, the engine or the air screw, and also the equipment which is used for control of the aircraft from the earth;

3) the radio equipment used by radio fans according to the definitions given in the regulations of radio communication accepted according to the Charter and the Convention of International union of telecommunication ratified by the Law of Ukraine of July 15, 1994 No. 116/94-BP except cases when such equipment is provided in the market. Sets of the components intended for creation by radio fans and provided in the market of the radio equipment that was modified by radio fans for own use are not considered as the radio equipment provided in the market;

4) the equipment, which on the physical characteristics:

it is not capable to create electromagnetic radiations or to lead to emergence of the electromagnetic radiations exceeding the level in case of which radio - telecommunication and other equipment functions to destination;

functions without inadmissible deterioration in characteristics in the presence of electromagnetic hindrances which usually arise in case of its proper use;

5) the estimative sets made by the special order or according to special requirements of the customer and held for use specialists only in the organizations which are engaged in researches and developments for the specified purposes.

4. If for certain equipment the essential requirements determined in appendix 1, were fully or partially determined in other technical regulations, this Technical regulation is not applied to this equipment to such requirements from the date of entry into force of the specified technical regulations.

5. This Technical regulation does not influence application of the legislation regulating the questions connected with safety of the equipment.

6. In this Technical regulation the following basic concepts are used:

1) the equipment - any structurally finished device or the combination of devices provided in the market as single functional unit, intended for the consumer (user) can also create electromagnetic hindrances or functioning of which such hindrances can influence.

For the purposes of this Technical regulation as the equipment are also considered:

the components or assembly nodes intended for embedding in the equipment by the consumer (user) can also create electromagnetic hindrances or functioning of which such hindrances can influence;

mobile installations - equipment combination, and in certain cases also other devices intended for movement and operation in various places;

2) introduction into circulation - provision of the equipment in the market of Ukraine for the first time;

3) retirement - any action directed to prevention to provision in the market of the equipment which is in products supply chain;
