About approval of Rules of production and turnover of organic products

1. Approve the enclosed Rules of production and turnover of organic products.

2. To provide to department of production and conversion of animal production of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let, and also within five working days in the Republican state company "Republican Center of Legal Information" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan and the intranet portal of state bodies.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of production and turnover of organic products

Chapter 1. General provisions

Paragraph 1. Basic concepts

1. These rules of production and turnover of organic products (further - Rules) are developed according to the subitem 3) of Item 1 of article 7 of the Law of the Republic of Kazakhstan "About production of organic products" (further - the Law) and determine procedure for production and turnover of organic products.

2. These rules extend on the physical persons or legal entity performing activities for production and turnover of organic products at any stage.

3. In these rules the following basic concepts are used:

1) organic livestock production - cultivation of farm animals in the conditions providing full access to natural sources of forages with use of extensive and natural methods of cultivation;

2) production division on organic production - the territory in which products are used (materials, substances, medicines, fertilizers) applied only for organic production;

3) organic crop production - production of crops, including collection of wild plants, without use of synthetic fertilizers, pesticides and regulators of growth of plants;

4) transition period (conversion) - period in which inorganic products as a result of observance of provisions of these rules and regulations of international treaties of the Republic of Kazakhstan, will be certified as organic products.

4. These rules are applied to the following products of agricultural origin, made and (or) implemented as organic:

1) raw products rural and fishery, aquaculture;

2) the processed products rural and fishery, aquaculture, held for use as food;

3) stern;

4) vegetative planting stock.

5. The products received from wild animals are not organic.

6. Production of organic products is performed in case of observance of condition according to article 11 of the Law.
