1. Approve the Instruction about procedure for carrying out tender at the choice of contractors of actions of state programs it (is applied).

2. This resolution becomes effective after its official publication.

The instruction about procedure for carrying out tender at the choice of contractors of actions of state programs

Chapter 1. General provisions

1. This Instruction determines procedure for carrying out tender at the choice of contractors of actions of state programs which responsible customer is the National academy of Sciences of Belarus (further - the state program) if other is not established by the legislation.

2. For the purposes of this Instruction terms and their determinations in the values established by the Budget code of the Republic of Belarus, Regulations on procedure for forming, financing, accomplishment and efficiency evaluation of implementation of state programs and also the following terms and their determinations are applied:

date of tender - date of meeting of the contest committee which agenda includes question of determination of the winner of tender;

the agreement - the contract for accomplishment of action of the state program (further - action) signed between the customer of the state program and the contractor of action determined by the customer of the state program by results of tender;

closed competition - method of the choice of the contractor of action from among the legal entities and individual entrepreneurs invited by the customer of the state program by the direction it notices on carrying out tender by the registered post poisoning (further - the direction by mail);

the applicant - the legal entity or the individual entrepreneur who sent the competitive offer to the customer of the state program;

the notice on carrying out tender - the document which the customer of the state program informs on carrying out tender, including repeated, constituted according to requirements of this Instruction and approved by the contest committee;

tender - tender form, won which is recognized the participant who offered according to the decision of the commission the best terms for the conclusion of the agreement in comparison with the conditions offered by other participants;

the contest committee - the permanent commission created by the customer of the state program for the organization and carrying out tender and other purposes determined by this Instruction;

the competitive offer - set of paper documents by means of which giving the legal entity (individual entrepreneur) declares participation in tender;

open tender - method of the choice of the contractor of action from among the legal entities and individual entrepreneurs invited to participation in tender by means of placement of the notice on carrying out tender on the official site of the customer of the state program on the global computer Internet (further - the official site) and (if necessary) in the printing mass media determined by the customer of the state program according to the legislation (further if other is not established, - placement in mass media);

the participant of tender - the legal entity, the individual entrepreneur allowed to participation in tender.

3. The choice of contractors of actions is performed by the customer of the state program by holding open tender by it according to the procedure, established by this Instruction. In case data on actions constitute the state secrets, the closed competition is held.

4. The customer of the state program has the right to determine need of introduction by participants of tender of deposit and its amount, procedure and conditions of its introduction, return to participants of tender taking into account requirements of the legislation.

5. Competition will be organized and carried out by the contest committee.

6. Subject of tender is the right to the conclusion of the agreement.

7. Are not allowed to participation in tender:

7.1. the legal entities who are in process of liquidation or reorganization (except for the legal entities reorganized by joining to them of other legal entities);

7.2. the individual entrepreneurs who are in activities termination stage;

7.3. legal entities or individual entrepreneurs:

on property which it is seized;

on which the court makes the decision on bankruptcy with liquidation (the activities termination) of the debtor;

included in supplier list (contractors, contractors) who are temporarily not allowed to participation in procedures of public procurements;

it is excluded

provided incomplete and (or) unreliable information about themselves.

8. The notice on carrying out tender shall contain:

8.1. the information about the customer of the state program, including its full name, the location, bank details, the e-mail address, surname, own name, middle name (if that is available) and phone number of the secretary of the contest committee;

8.2. information on tender, including tender type, tender subject, terms of submission of competitive offers, date of tender, time and venue of tender, procedure for carrying out tender;

8.3. term for refusal of the customer of the state program of carrying out tender;

8.4. amount of deposit, subject to introduction for participation in tender (in case of its establishment), procedure and terms of its introduction;

8.5. information on action:

8.5.1. the name of the state program, the subprogramme (if subprogrammes are part of the state program) and action;

8.5.2. terms of accomplishment of action, stages of accomplishment of action (if necessary);

8.5.3. possibility of separation of works on accomplishment of action into parts and submissions of competitive offers concerning such parts;

8.5.4. data on the expected results of action;

8.5.5. approximate amount of financial resources on accomplishment of action with indication of financing sources;

8.6. the list of requirements imposed to participants of tender;

8.7. information on procedure for determination of the winner of tender, including:

8.7.1. mandatory requirements and the list of the criteria characterizing competitive offers (further - criteria);

8.7.2. evaluation method of criteria (with reduction in need of formula) and algorithm of the choice of the winner of tender;
