About approval of the Regulations on the registration fees of objects of copyright, the related rights and topology of integrated chips

For the purpose of enhancement of procedures of provision of legal protection to the intellectual property items belonging to physical persons and legal entities of the Kyrgyz Republic according to Articles 9, of 32, 37 and 38 Laws of the Kyrgyz Republic "About copyright and the related rights", article 9 of the Law of the Kyrgyz Republic "About legal protection of topology of integrated chips", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on the registration fees of objects of copyright, the related rights and topology of integrated chips according to appendix.

2. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About the registration fees of objects of copyright, the related rights and author's agreements" of May 14, 1999 No. 260;

- the order of the Government of the Kyrgyz Republic "About approval of the Regulations on the registration fees of programs for electronic computers, databases and topology of integrated chips" of May 26, 1999 No. 286;

- Item 8 of the order of the Government of the Kyrgyz Republic "About modification and recognition voided some decisions of the Government of the Kyrgyz Republic" of May 15, 2001 No. 233;

- the order of the Government of the Kyrgyz Republic "About modification and amendments in the Regulations on the registration fees of programs for electronic computers, databases and topology of integrated chips approved by the order of the Government of the Kyrgyz Republic of May 26, 1999 No. 286" of December 14, 2002 No. 850;

- the order of the Government of the Kyrgyz Republic "About entering of amendment into the order of the Government of the Kyrgyz Republic of May 14, 1999 No. 260 "About the registration fees of objects of copyright, the related rights and author's agreements" of October 20, 2003 No. 658;

- the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic of May 14, 1999 No. 260 "About the registration fees of objects of copyright, the related rights and author's agreements" of August 16, 2008 No. 461.

3. This resolution becomes effective after fifteen days from the date of official publication.

Appendix

Regulations on the registration fees of objects of copyright, related rights and topology of integrated chips

1. This Provision establishes the sizes, procedure and payment due dates of charges for the actions connected with registration of objects of copyright, including programs for electronic computers, databases (further - copyright objects), the related rights and topology of integrated chips (further - TIMS), and also agreements on the order these rights, provided by the laws of the Kyrgyz Republic "About copyright and the related rights", and "About legal protection of topology of integrated chips".

2. The amount of charges is paid in national currency of the Kyrgyz Republic and established in settlement indicators according to appendix to this Provision.

3. The following privileges on payment of charges are provided to person who is the single author of object of copyright, the related rights or TIMS asking the registration certificate for the name or the owner:

a) the participants of the Great Patriotic War or persons equated to them and also persons with limited opportunities of health having 1 group of disability are exempted from payment of charges;

b) physical persons irrespective of their residence - pay 10 percent from the amount of the charges established by this Provision.

4. If the applicants asking the certificate for the name on registration, several, then corresponding reduced rate is applied only in case all applicants belong to any category of persons specified in Item 3 this provision.

5. The document confirming payment of collection is the document provided:

- Item of 1 appendix to this Provision, it is represented in authorized state body in the field of intellectual property along with application for registration or deposition of materials of object of copyright, the related rights or TIMS;

- Items 2 and 3 of appendix to this Provision, it is represented within two months from the date of receipt by the applicant of the decision on registration of object of copyright, the related rights or TIMS;

- Items 5 and 6 of appendix to this Provision, it is represented along with filing of application about issue of the duplicate of the registration certificate of object of copyright, the related rights, TIMS or the statement for modification and amendments in the State register of objects of copyright, the related rights or TIMS;

- Item 7 of appendix to this Provision, it is represented along with filing of application about registration of the agreement on the order the rights to object of copyright, the related rights or TIMS.

6. Privileges, stipulated in Item 3 this provision, do not extend to registration of agreements on the order the rights to objects of copyright, the related rights and TIMS.

Privileges, stipulated in Item 3 this provision, are provided according to the petition of the applicant submitted to authorized state body in the field of intellectual property instead of the document confirming collection payment if privilege is exemption of this collection, or together with the specified document if privilege is reduction of its size.

7. Provision of the right to exemption of charges or on payment of charges in the reduced size according to Item 3 this provision is performed in case of presentation of the copy of the document of the established sample confirming the status of the applicant.

8. The charges established by this Provision are paid in accordance with the established procedure by transfer of the corresponding amounts to the settlement account of authorized state body in the field of intellectual property.

The document confirming collection payment is the copy of the payment order having stamp about payment or the bank receipt about collection payment by cash, or transfer from personal account.
