About approval of Rules of purchase and sale of electrical energy at net - consumers

According to subitem 10-9) of article 6 of the Law of the Republic of Kazakhstan "About support of use of renewable energy resources" PRIKAZYVAYU:

1. Approve the enclosed Rules of purchase and sale of electrical energy at net - consumers.

2. To provide to department on renewable energy resources of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan" within five working days from the date of receipt of the registered order;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of purchase and sale of electrical energy at net - consumers

Chapter 1. General provisions

1. These rules of purchase and sale of electrical energy at net - consumers are developed according to subitem 10-9) of article 6 of the Law of the Republic of Kazakhstan "About support of use of renewable energy resources" (further - the Law) and determine procedure for purchase and sale of electrical energy at net - consumers.

2. In these rules the following concepts are used:

1) small-scale object for use of renewable energy resources (further - small-scale object) - the technical devices general installed capacity to two hundred kilowatts (inclusive) intended for production of electrical and (or) heat energy with use of renewable energy resources (further - RES) and the constructions interconnected with them and the infrastructure technology necessary for operation of small-scale object;

2) authorized body - the central executive body performing management and cross-industry coordination in the field of support of use of RES;

3) net - the consumer of electrical energy (further - net - the consumer) - the physical person or legal entity providing fully or partially own consumption of electrical energy and (or) heat energy at the small-scale object belonging to it on the property right or other corporeal right, connected to distribution power network and equipped with systems of separate accounting of amounts of consumption of electrical energy from network and scopes of supply in it including the combined RES installation.

3. Other concepts used in these rules are applied according to the legislation of the Republic of Kazakhstan in the field of power industry and support of use of RES.

Chapter 2. Procedure for purchase and sale of the electric power at net - consumers

4. For connection of small-scale objects to power networks and sale of excesses of electrical energy, net - the consumer for no later than 15 (fifteen) calendar days until connection of objects for use of RES to power networks represents the notification in form, according to appendix to these rules to the power supplying and power transferring organization to which power networks connection is made.

5. Net - the consumer puts the following documents and information to the notification:

1) technical characteristics of the capital generating equipment of object for use of RES;

2) copy of the scheme of connection of small-scale object to power networks;

3) forecast annual amounts for 1 (one) of development of electrical energy with breakdown on months.

6. For the conclusion of the purchase and sale agreement of electrical energy net - the consumer provides the following documents in the power supplying organization:

the copy of the identity certificate (for physical persons);

constituent documents (for legal entities);

the passport copy on the bidirectional metering device of electrical energy with the copy of the appropriate certificate about checking;

bank details.

Based on the provided documents the power supplying organization creates and sends the draft agreement of purchase and sale of electrical energy signed by it to the address net - the consumer no more than 5 (five) working days from the moment of receipt of the documents specified in part one of this Item in time.

7. For connection of small-scale object (objects) to power networks of the power transferring organization, the power supplying organization concludes with net - the consumer the purchase and sale agreement of electrical energy according to subitem 7-2) of article 6 of the Law.

8. Net - the consumer is connected to power network of the power transferring organization in the point which is from its party to the Section of borders with receipt of specifications on connection of small-scale object to power networks according to subitem 7-1) of article 6 of the Law.

9. The power transferring organization provides free connection net - the consumer to power network of the power transferring organization in the point which is from its party to the Section of borders of the small-scale object belonging net - to the consumer.

At the same time net - consumers, are exempted from fee of the power transferring organizations on transfer of electrical energy according to Item 7 of article 9 of the Law.

Chapter 3. Procedure for settlement

10. Net - consumers observe requirements for installation of devices of commercial accounting of electrical energy according to the Instructions for use electrical energy approved by the order of the Minister of Energy of the Republic of Kazakhstan of February 25, 2015 No. 143 (it is registered in the Register of state registration of regulatory legal acts for No. 10403).
