About the Strategy of development for cross-border space of trust

According to Item 13 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix № 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) the Board of the Eurasian economic commission decided:

1. Approve the enclosed Strategy of development for cross-border space of trust.

2. To the governments of state members of the Eurasian Economic Union for the purpose of preparation and approval of the actions plan by Board of the Euroasian economic commission on the step-by-step strategy implementation approved by this Decision in a month from the date of the introduction of this Decision in force to provide submission by the authorized bodies to the Eurasian economic commission of relevant proposals.

3. This Decision becomes effective after 30 calendar days from the date of its official publication.

Strategy of development for cross-border space of trust

I. General provisions

This Strategy is developed for the purpose of realization of Item 13 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix № 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) taking into account international standards and recommendations in the field of information technologies and information security and determines main objectives, tasks and the principles of development of cross-border space of trust for use of services and effectual in law electronic documents in case of interstate information exchange of state members of the Eurasian Economic Union (further respectively - state members, the Union), including physical persons and legal entities, officials of public authorities of state members, officials and the staff of bodies of the Union, and also priorities of development institutional, legal, organizational and technical supply of cross-border space of trust.

This Strategy considers and develops provisions of the Concept of use in case of interstate information exchange of services and effectual in law electronic documents approved by the Decision of Council of the Eurasian economic commission of September 18, 2014 №73.

This Strategy is directed only to realization of conditions of providing trust in case of interstate data exchange and electronic documents and does not interfere with state members to take the measures necessary for ensuring the external and internal security.

II. Total characteristic of cross-border space of trust

According to the Agreement on the Eurasian Economic Union of May 29, 2014 the cross-border space of trust is understood as set legal, organizational and the specifications approved by state members for the purpose of providing trust in case of interstate data exchange and electronic documents between authorized bodies of state members.

Practical actions for creation of cross-border space of trust began to be implemented within implementation of the Agreement on use of information technologies in case of exchange of electronic documents in foreign and mutual trade on single customs area of the Customs union of September 21, 2010 during creation of the integrated information system of foreign and mutual trade of the Customs union.

Results of performance of works on providing trust in case of interstate data exchange and electronic documents between authorized bodies of state members shall become basis for development of cross-border space of trust during creation of the integrated information system of the Union (further - the integrated system) on the basis of development and expansion of functionality of the integrated information system of foreign and mutual trade of the Customs union.

Development of cross-border space of trust within creation of the integrated system shall be performed according to the strategy of development for the integrated system which shall consider provisions of this Strategy for the principles of development of cross-border space of trust and mechanisms of their realization, and also the Concept of use in case of interstate information exchange of services and effectual in law electronic documents.

Information support of integration processes in the spheres defined by the Agreement on the Eurasian Economic Union of May 29, 2014 is implemented by means of forming of the circle of information exchange with use of information and communication technologies and cross-border space of trust within the Union.

Data exchange and electronic documents between subjects of electronic interaction in case of realization of general processes within the Union is performed with use of the integrated system providing integration of geographically distributed state information resources and information systems of authorized bodies of state members, and also information resources and information systems of the Eurasian economic commission (further - the Commission).

Subjects of electronic interaction within cross-border space of trust are public authorities of state members (their officials and employees), physical persons and legal entities (representatives of legal entities), the officials and the staff of bodies of the Union interacting within the relations arising in the course of creation, departure, transfer, obtaining, storage and use of electronic documents and also information in electronic form.

Public authorities of the third states (their officials and employees), physical persons and legal entities (representatives of legal entities), officials and employees of integration associations, the international organizations on condition of the conclusion of the corresponding international treaties can also become subjects of electronic interaction.

III. Purposes, tasks and elements of cross-border space of trust

Main objectives are:

forming of favorable and confidential conditions for implementation of the interstate information exchange providing use by subjects of electronic interaction of effectual in law electronic documents;

increase in efficiency of electronic interaction within the Union;

increase in efficiency of functioning of the integrated system;

cost reduction on ensuring electronic interaction of public authorities of state members with physical persons and legal entities.

For achievement of the specified purposes on the basis of joint approaches of state members to forming of legal, technical and organizational support of cross-border space of trust it is necessary to solve the following key problems:
