About approval of the Procedure for provision of data on the death of physical persons

According to item 4 of part one of article 20 of the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction" and for the purpose of ensuring provision of data on the death of physical persons of PRIKAZYVAYEM:

1. Approve the Procedure for provision of data on the death of physical persons which is applied.

2. Determine that information files of data on the death of physical persons are created and move in format of XML files.

3. Subjects of information relations in connection therewith the order are the Ministry of Justice of Ukraine and Public service of financial monitoring of Ukraine.

Technical support of provision of data on the death of physical persons is performed by the state company which treats the sphere of management of the Ministry of Justice of Ukraine and is administrator of the State register of acts of civil status of citizens.

4. Determine that the packet of information files of data on the death of physical persons which state registration was performed since January 1, 2015 before entry into force of this order is created according to the State register of acts of civil status of citizens on the structure determined in appendix 1 to the Procedure for provision of data on the death of physical persons approved by this order and it is once provided by the administrator of the State register of acts of civil status of citizens within thirty days from the date of entry into force of this order on the removable data carrier electronically with the cover letter.

5. To public service of financial monitoring of Ukraine and the state company which treats the sphere of management of the Ministry of Justice of Ukraine and is administrator of the State register of acts of civil status of citizens to take the measures necessary for implementation of this order.

6. To department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine (Romaniuk Yu. P.), (Davidyuk V. S.) in accordance with the established procedure to provide to Department of information technologies of Public service of financial monitoring of Ukraine:

provision of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

7. This order becomes effective in two months from the date of its official publication.

Procedure for provision of data on the death of physical persons

1. This Procedure determines the procedure of provision by the Ministry of Justice of Ukraine to Public service of financial monitoring of Ukraine (further Gosfinmonitoring) data on the death of physical persons with indication of surname, name, middle name, nationality, birth date and death, the birthplaces and death, the place of the last accommodation of the died person, data on the withdrawn documents in connection with state registration of death.

Information on state registration of death of unknown persons is not provided. In case of identification of such dead and modification of assembly record about death such information is provided Gosfinmonitoring for the accounting period in which changes are made.

2. Information files of data on the death of physical persons (further information files) are created according to the State register of acts of civil status of citizens (further - the Register) on the structure determined in appendix 1 to this Procedure.

3. Information files are provided Gosfinmonitoring monthly to the 10th following for reporting and contain the data entered in the Register during the accounting period.

4. State financial monitoring by results of processing of the information file no later than the third working day from the moment of receipt of such file creates and sends to the administrator Reestra the file message about result of processing of the information file (further - the file message) on the structure determined in appendix 2 to this Procedure.

5. If the file message it is received with nonzero code value of mistake, the administrator Reestra within three working days from the moment of receipt of such file provides Gosfinmonitoring the information file with the eliminated errors.

If for any reasons the administrator Reestra within four working days from the moment of sending the information file did not receive the file message, he addresses to Gosfinmonitoring for clarification of the reasons of failure to provide the file message.

6. Exchange of information files and files messages is performed by e-mail using means of cryptographic information security which conform to requirements of the legislation in the sphere of information security. During information exchange such e-mail addresses are used:

dracs_dfm@nais.gov.ua for sending by the administrator Reestra information files and receipt of files messages;

fm_minjustice@sdfm.gov.ua for receipt by Gosfinmonitoring of information files and transfer of files messages.

7. For identification of signer, confirmation of integrity and ensuring confidentiality of data electronically Gosfinmonitoring and the administrator Reestra use the qualified digital signature or seal using means of the qualified digital signature or seal which have the built-in hardware and software providing protection of the data which are written down on them against unauthorized access, against direct acquaintance with parameter value of personal keys and their copying compatible to the software Reestra.
