Procedure of control of execution by the resident of the special economic zone of the agreement on implementation of industrial and production, technology development, tourist and recreational activities or activities in the port special economic zone

1. This Procedure establishes the procedure of control of execution by the resident of the special economic zone (further - resident) agreements on implementation of industrial and production, technology development, tourist and recreational activities or activities in the port special economic zone (further - the agreement on implementation of activities in the special economic zone).

2. 3. Within check compliance of activities of resident to terms of agreement about implementation of activities in the special economic zone is established.

4. Checks can be planned and unplanned.

5. Scheduled inspections are carried out annually based on the plan approved by the Minister of Economic Development of the Russian Federation (further - the plan of checks). The plan of checks joins the inspections which are carried out by the Ministry and executive bodies. The inspections which are carried out by executive bodies join in the plan of checks based on offers of executive bodies. The specified offers are represented to the Ministry not later than two months before the termination of the current year. The plan of checks for the next calendar year is constituted not later than month before the termination of the current year.

The first inspection concerning resident is carried out not earlier than in 24 (twenty four) months from the date of the conclusion of the agreement with it on implementation of activities in the special economic zone.

In respect of checks are specified:

a) the name of resident - the legal entity or surname, name, middle name of the individual entrepreneur concerning whom it is performed;

b) place of check;

c) check subject;

d) check period;

e) term of conducting check (start and end date of check).

6. The check of resident which is not included in the plan of checks is unplanned. Unscheduled inspection is carried out in case of obtaining by the Ministry or executive body from legal entities, citizens, including individual entrepreneurs, public authorities of written data on violation by the resident of terms of agreement about implementation of activities in the special economic zone, and also for the purpose of check of execution by the resident of instructions about elimination of the revealed violations.

7. Conducting check is drawn up by the order of the Minister of Economic Development of the Russian Federation or the relevant decision of the head of executive body containing the data specified in subitems "a" - "d" Item 5 of this Procedure (further - the act of the subject), and also surname, name, middle name and full name of position checking (checking).
