About approval of the Procedure for obtaining from the State register of physical persons taxpayers of information necessary for implementation of verification and monitoring of the state payments
According to Article 70 of Chapter 6 of the Section II of the Tax code of Ukraine, the Law of Ukraine "About personal data protection", I order to the subitem 5 of item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 375, for the purpose of establishment of procedure for receipt of information by the Ministry of Finance of Ukraine from the State register of physical persons taxpayers:
1. Approve the Procedure for obtaining from the State register of physical persons - taxpayers of information necessary for implementation of verification and monitoring of the state payments which is applied.
2. Determine that before introduction of information exchange between the Ministry of Finance of Ukraine and the Public fiscal service of Ukraine with use of National system of confidential communication such interaction is performed with use of electronic media using the digital signature according to the legislation together with the cover letter.
3. In accordance with the established procedure to provide to management of the organization of exchange and information analysis of the Ministry of Finance of Ukraine:
provision of this order on state registration in the Ministry of Justice of Ukraine;
promulgation of this order.
4. This order becomes effective from the date of, its official publication following behind day.
5. To impose control over the implementation of this order on the Deputy Minister of Finance of Ukraine Marchenko S. M. and the Chairman of the Public fiscal service of Ukraine Nasirov R. M.

1. This Procedure No. 136 "About approval of the Procedure of verification and monitoring of the accuracy of the information provided by physical persons for charge and receipt of social payments, privileges, subsidies, pensions, the salary, other payments performed at the expense of means state and local budgets, means of the Pension fund of Ukraine, funds of obligatory national social insurance" (further - the Resolution), subitem 24-1 - item 4 of the Regulations on the Ministry of Finance of Ukraine is developed for the purpose of establishment of the mechanism of obtaining from the State register of physical persons taxpayers of information necessary for implementation of verification and monitoring of the state payments according to Article 70 of Chapter 6 of the Section II of the Tax code of Ukraine, the Laws of Ukraine "About personal data protection", "About National system of confidential communication", the resolution of the Cabinet of Ministers of Ukraine of February 18, 2016, the Cabinet of Ministers of Ukraine approved by the resolution of August 20, 2014 No. 375, the subitem 37 of item 4 of the Regulations on the Public fiscal service of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of May 21, 2014 No. 236, Procedure for processing of personal data in base of personal data - the State register of physical persons of taxpayers, the approved order of the Ministry of Finance of Ukraine of February 24, 2015 No. 210 and registered in the Ministry of Justice of Ukraine on March 12, 2015 for No. 278/26723.
2. Subjects of information relations according to this Procedure is the Ministry of Finance of Ukraine and the Public fiscal service of Ukraine.
3. In this Procedure terms are used in the values given in the Resolution.
4. This Procedure regulates exchange of information between subjects of information relations, rules of creation and submission by the Ministry of Finance to GFS of requests for obtaining from the State register of physical persons taxpayers (further - the State register) information necessary for implementation of verification and monitoring of the accuracy of the information provided by physical persons for charge and receipt of social payments, privileges, subsidies, pensions, the salary, other payments performed at the expense of means state and local budgets, means of the Pension fund of Ukraine, funds of obligatory national social insurance and forming and provision of GFS of responses to such requests.
5. The structure and formats of requests and responses to such requests, requirements to protection, terms of forming and amounts of information, transmitted data, form of registers of requests and answers are determined jointly by the Ministry of Finance and GFS and drawn up by the separate protocols prepared according to this Procedure.
1. Information exchange between the Ministry of Finance and GFS is performed at the central level electronically by means of National system of confidential communication.
2. The Ministry of Finance and GFS register requests and replies to the requests in registers of requests and replies to the requests.
3. In case of circumstances which make impossible accomplishment of provisions of this Procedure subjects of information relations shall inform on this each other within two working days from the date of emergence of these circumstances.
1. The Ministry of Finance quarterly (in 60 calendar days after the termination of reporting quarter) or in case of need creates and provides in GFS requests for obtaining information on physical persons who are receivers of the state payments.
