About approval of the Regulations on criteria and procedure for selection of banks which can be involved in stock holding of cash of the National Bank of Ukraine and implementation of transactions with them

According to Articles 7, of 15, of 33, 56 Laws of Ukraine "About the National Bank of Ukraine", for the purpose of implementation of storage by banks of Ukraine of inventories of cash of the National Bank of Ukraine the Board of the National Bank of Ukraine decides:

1. Approve Regulations on criteria and procedure for selection of banks which can be involved in stock holding of cash of the National Bank of Ukraine and implementation of transactions with them which is applied.

2. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Smoliya Ya. V.

3. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on criteria and procedure for selection of banks which can be involved in stock holding of cash of the National Bank of Ukraine and implementation of transactions with them

1. The National Bank of Ukraine (further - National Bank) performs selection of banks which can be involved in stock holding of cash of National Bank and implementation of transactions with them (further - authorized banks), by the following criteria:

1) the state owns share of the authorized capital in such bank more than 75 percent or the controlling stake of bank belongs to the international financial and bank institutions having the international rating of investment class confirmed in the bulletin of one of the leading world rating companies or bank which is included by National Bank in the list systemically of important banks.

Banks which answer this criterion will not be involved in stock holding of cash of National Bank and implementation of transactions with them if to them, sanctions by foreign states are applied to their heads or owners of essential participation in them (except the state which performs the armed aggression against Ukraine), interstate associations, the international organizations or Ukraine;

2) the bank performs collection of means and transportation of currency values and/or uses services of collection of other banks or legal entities who obtained the license of National Bank for provision to banks of services in collection.

For participation in selection banks which answer the criteria specified in Item of 1 this provision are allowed and adhere to requirements to activities of banks, stipulated in Item 2 this provision.

2. The bank for participation in selection of authorized banks submits the written address which shall contain information relatively to National Bank:

1) shares of the authorized capital which is owned by the state in the specified bank, or accessories of controlling stock of bank to the international financial and bank institutions having the international rating of investment class confirmed in the bulletin of one of the leading world rating companies or about inclusion of bank in the list of systemically important banks;

2) observance of the established economic standard rates within the last six months preceding date of submission of the address by bank;

3) observance of procedure for forming of required reserves during the last six accounting periods preceding date of submission of the address by bank;

4) the fact that there is no need for additional capitalization by results of the carried-out assessment of stability or timely accomplishment of the program of capitalization/restructuring which is approved by National Bank;

5) non-realizations of risk activities which threaten interests of investors or other creditors of bank;

6) non-use by National Bank within the last six months of corrective actions in the form of restriction, suspension or the termination of the transactions performed by bank or reference of bank to category of problem;

7) observance by bank which is included by National Bank in the list systemically of the important, established requirements to activities systemically of important banks;

8) compliance of technical condition of rooms of cash nodes (including storages and/or safes) to requirements of regulatory legal acts of National Bank and the equipment of boxes of collection (in the presence) separate divisions of bank in which stock holding of cash is planned. The bank by the written request of National Bank provides the additional information concerning technical condition of storages and/or safes, other rooms of cash node and collection of boxes (in the presence);

9) availability of extensive network of separate divisions of bank (with representation in each region) in the territory of Ukraine, including separate divisions in which cash inventories with period allocation will be stored;

10) non-use within the last 12 months foreign states (except the state which performs the armed aggression against Ukraine), interstate associations, the international organizations or Ukraine of sanctions against bank, his heads and/or owners of essential participation in it;

11) availability in property of bank of government bonds of Ukraine which are not encumbered with any other obligations which can be transferred to providing National Bank;

12) work experience of bank on the organization of cash servicing and implementation of transportation of currency values and collection of means;

13) amounts of cash turnovers of bank and implementation of transportation by bank of currency values and collection of means in three last years;

14) amounts of the received cash and the handed-over surplus of banknotes and coins from/in divisions of National Bank in three last years;

15) possible inventory quantity of cash for transfer on storage according to class of resistance of storages and/or safes and liquid providing;

16) forecast amounts of reinforcement of inventories of cash in storages and/or safes of bank, export of surplus of cash, suitable and not suitable for the address, from cash inventories stored in National Bank;

17) forecast limits of stock holding of cash by storages and/or safes of separate divisions in which stock holding of cash, taking into account compliance of technical condition of storages and/or safes is planned;

18) obligations of bank:

store inventories of cash of National Bank in the amount at least one billion hryvnias in general on bank until the end of the first year from the date of receipt of the status of authorized bank. In the years ahead activities in the status of authorized bank in the amount at least one billion hryvnias in general on bank which is calculated as the minimum average monthly amount of stock remainder of cash stored within calendar year;
