About approval of Rules of formation of fishery reserved zones

1. Approve the enclosed Rules of formation of fishery reserved zones.

2. Recognize invalid:

the order of the Government of the Russian Federation of August 12, 2008 No. 603 "About approval of Rules of formation of fishery reserved zones" (The Russian Federation Code, 2008, No. 33, the Art. 3865);

Rules of formation of fishery reserved zones

1. These rules establish procedure for formation of fishery reserved zones.

2. Fishery reserved zone is water object or its part with the territory adjoining to them on which the specific mode of economic and other activity for the purpose of preserving water biological resources and creation of conditions for development of aquaculture and fishery is set.

3. Fishery reserved zones are formed in internal waters of the Russian Federation, including internal sea waters of the Russian Federation, and also in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation and in exclusive economic zone of the Russian Federation.

In the territories of the national natural parks, national parks and the state natural wildlife areas of federal importance fishery reserved zones are not formed.

4. The Ministry of Agriculture of the Russian Federation makes the decision on formation of fishery reserved zone (further - the decision), and also establishes types of economic and other activity which are prohibited or limited in such fishery reserved zone, according to the list according to appendix.

5. In case of establishment of the size, borders of fishery reserved zones, and also types of economic and other activity which are prohibited or limited in fishery reserved zones it is considered:

a) value and structure of water biological resources;

b) fishery value of water biological resources;

c) social and economic development of the subject of the Russian Federation in the territory of which formation of fishery reserved zone is planned;

d) results of carrying out the state monitoring of water biological resources;

e) biological reasons for creation of fishery reserved zone which criteria and procedure for preparation are established by the Ministry of Agriculture of the Russian Federation.

6. The Ministry of Agriculture of the Russian Federation taking into account provisions, stipulated in Item 5 these rules, develops the draft decision and the passport of fishery reserved zone (further - the passport).

7. The passport contains:

a) reasons for need of formation of fishery reserved zone;

b) the schematic map with indication of the sizes and borders of fishery reserved zone;

c) data on the protected valuable types of water biological resources;

d) data on types of economic and other activity which are prohibited or limited in fishery reserved zone.

8. The form of the passport is established by the Ministry of Agriculture of the Russian Federation.

9. The draft decision and the passport are sent for approval:

a) in the Ministry of Natural Resources and Environmental Protection of the Russian Federation;

b) in executive bodies of subjects of the Russian Federation in the territory of which formation of fishery reserved zones is supposed;

c) in Federal Security Service of the Russian Federation if formation of fishery reserved zone is supposed in the border territory (including internal sea waters of the Russian Federation and the territorial sea of the Russian Federation), the continental shelf of the Russian Federation and in exclusive economic zone of the Russian Federation;

d) in the Ministry of Transport of the Russian Federation, the Ministry of Industry and Trade of the Russian Federation, the Ministry of Energy of the Russian Federation, Federal Agency for Subsoil Management and State Atomic Energy Corporation "Rosatom" if in fishery reserved zone it is supposed to prohibit or limit the types of economic and other activity provided by appendix to these rules.

10. The public authorities specified in Item 9 of these rules consider the draft decision and the passport and in 30-day time from the date of their obtaining approve them or represent to the Ministry of Agriculture of the Russian Federation motivated refusal in approval of appendix of notes.

11. The draft decision and the passport approved with the public authorities specified in Item 9 of these rules affirm the Ministry of Agriculture of the Russian Federation.

12. In case of representation of motivated refusal in approval of the draft decision and passport the Ministry of Agriculture of the Russian Federation finishes the draft decision and the passport taking into account notes and sends them for repeated approval in the public authorities specified in Item 9 of these rules.

13. The Ministry of Agriculture of the Russian Federation within 5 working days from the date of entry into force of the decision places information on formation of fishery reserved zone, its borders, types of economic and other activity which are prohibited or limited in fishery reserved zone, on the official site on the Internet and in accordance with the established procedure in federal state information system of territorial planning.

14. Abolition of fishery reserved zones, change of borders and types of economic and other activity which are prohibited or limited in fishery reserved zone are performed according to the procedure, established by these rules for formation of fishery reserved zones.

Appendix

to Rules of formation of fishery reserved zones

The list of types of economic and other activity which can be prohibited or limited in fishery reserved zones

1. Exploration and production of minerals.

2. Navigation.

3. Oil transportation and oil products, gases and products of their conversion by the main pipeline transport.

4. Wood alloy on waterways and reservoirs by all methods.

5. The activities involving changes of the hydrological mode, except for works on fishery melioration.

6. Dumping waste, including drainage, waters in water object.

7. Construction of hydroelectric power stations.

8. Cabin of forest plantings.
