1. Approve the enclosed Rules of accession of networks of operators of intercity and international telecommunication to point of exchange of Internet traffic.

2. To committee of communication, informatization and information of the Ministry for Investments and Development of the Republic of Kazakhstan (? adhan? ap) provide T.B.:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in printing and electronic form on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican center of legal information within ten calendar days from the date of receipt of the registered order for inclusion in reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of accession of networks of operators of intercity and international telecommunication to point of exchange of Internet traffic

1. General provisions

1. These rules of accession of networks of operators of intercity and international telecommunication to point of exchange of Internet traffic (further - Rules) are developed according to subitem 6-1) of Item 1 of article 8 of the Law of the Republic of Kazakhstan of July 5, 2004 "About communication" and determine procedure for accession of networks of operators of intercity and (or) international telecommunication to point of exchange of Internet traffic.

2. In these rules the following basic concepts are used:

1) the telecom operator - the legal entity registered in the territory of the Republic of Kazakhstan, rendering communication services;

2) Internet traffic - information volume, transferred and accepted through connection with the Internet for certain period of time;

3) traffic transmission - implementation of process of connection establishment and information transfer between users communication services (networks of telecommunications);

4) the operator of intercity and international telecommunication - the operator of fixed telephony owning and (or) operating long and international circuits of communication, long-distance and international switching exchanges and providing services of intercity and international telephone communication in transit of traffic and provision of network resources to other telecom operators;

5) the public technical service - the republican state company on the right of economic maintaining created according to the decision of the Government of the Republic of Kazakhstan;

6) point of exchange of Internet traffic - the hardware and software according to the omission (exchange) of Internet traffic of operators of intercity and (or) international telecommunication in the territory of the Republic of Kazakhstan.

2. Procedure for accession of networks of operators of intercity and international telecommunication to point of exchange of Internet traffic

3. For accession to point of exchange of Internet traffic, operators of intercity and (or) international telecommunication direct to the public technical service the application on issue of specifications of accession to point of exchange of Internet traffic in form, according to appendix to these rules (further - the statement).

4. The public technical service after receipt of the statement, issues specifications to the operator of intercity and (or) international telecommunication within five working days.

In case of specifying of unreliable information in the statement, the public technical service, within three working days sends to the operator of intercity and (or) international telecommunication in writing the motivated answer about failure in issue of specifications of accession to point of exchange of Internet traffic with reasons for causes of failure in consideration.

5. The operator of intercity and (or) international telecommunication after receipt of specifications within seven working days in writing reports in the public technical service about readiness of accession to point of exchange of Internet traffic.

In case of null information about readiness of accession to point of exchange of Internet traffic in the terms provided in part one of this Item, the operator of intercity and (or) international telecommunication submits repeatedly the application according to Item 3 of these rules.

6. The public technical service, after receipt of information on readiness of accession to point of exchange of Internet traffic from the operator of intercity and (or) international telecommunication within seven working days signs the contract for accession to point of exchange of Internet traffic, according to the issued specifications of accession to point of exchange of Internet traffic.

7. The public technical service within five working days after agreement signature on accession to point of exchange of Internet traffic performs connection of the operator of intercity and (or) international telecommunication to point of exchange of Internet traffic.
