About approval of the Procedure for accomplishment of customs formalities on sea and river transport

According to Article 246 of the Customs code of Ukraine, the Maritime Code of Ukraine, the resolution of the Cabinet of Ministers of Ukraine of May 21, 2012 "Omission questions through frontier of persons, automobile, water, railway and air vehicles of the carriers and goods moved with them" to the Procedure for customs clearance of military equipment, including the military vehicles crossing customs border of Ukraine, to No. approved by the resolution of the Cabinet of Ministers of Ukraine of January 18, 2003 63, and to the Procedure for movement of goods at the check points through frontier located in the territory of seaports of Ukraine during container transports in through mixed traffic to No. approved by the resolution of the Cabinet of Ministers of Ukraine of April 02, 2009 320, I order to No. 451:

1. Approve the Procedure for accomplishment of customs formalities on sea and river transport which is applied.

2. To department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine (Chmeruk N. A.) to provide in accordance with the established procedure:

provision of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

3. Recognize invalid:

the order of the State Customs Service of Ukraine of September 17, 2004 No. 678 "About approval of the Instruction about the organization of customs control and customs clearance of the courts and goods moved with them", registered in the Ministry of Justice of Ukraine on October 8, 2004 for No. 1286/9885;

Item 3 of the order of the State Customs Service of Ukraine of October 10, 2007 No. 842 "About introduction of amendments to some orders of State Customs Service", registered in the Ministry of Justice of Ukraine on October 31, 2007 at No. 1323/14500;

the order of the State Customs Service of Ukraine of March 11, 2010 No. 230 "About approval of Changes to the Instruction about the organization of customs control and customs clearance of the courts and goods moved with them, the State Customs Service of Ukraine approved by the order of September 17, 2004 No. 678", registered in the Ministry of Justice of Ukraine on May 18, 2010 on No. 334/17629.

4. This order becomes effective in 30 days from the date of its official publication.

5. To impose control over the implementation of this order on the Deputy Minister of Finance of Ukraine Fudashkin D. A. and vice-chairman of the Public fiscal service of Ukraine Makarenko A. V.

Procedure for accomplishment of customs formalities on sea and river transport

I. General provisions

1. This Procedure is developed according to part two of Article 246 of the Customs code of Ukraine for the purpose of determination of procedure for accomplishment of customs formalities when moving water vehicles of the carriers and goods moved with them.

2. The terms used in this Procedure have the following values:

The act notification - the document which is constituted in case of detection of any disagreements in case of acceptance of goods by port from administration of the vessel is signed by the authorized representative of administration of the vessel, representatives of port and customs;

the general act - the document determining total quantity of places and weight of the goods transferred by the vessel and accepted by port;

customs of departure - customs in the territory of Ukraine where movement of the goods which are under customs control begins;

customs of appointment - customs in the territory of Ukraine where movement of the goods which are under customs control comes to an end;

the port operator (the stevedoring company) - subject of managing which performs operation of maritime terminal carries out handling works, servicing and storage of goods, servicing of courts and passengers, and also other types of economic activity connected with it;

the tallyman's receipt - source accounting document in which data on the number of places and the weight of the goods unloaded from the vessel and accepted by port are reflected.

Other terms are applied in the values provided in the Convention on simplification of international maritime traffic 1965, the Customs code of Ukraine, the Maritime Code of Ukraine, the Law of Ukraine "About seaports of Ukraine", the Standard technological scheme of the omission through frontier of persons, automobile, water, railway and air vehicles of the carriers and goods moved with them (further - Typical by TS of the omission), and the Standard technological scheme of implementation of customs control of water vehicles of the carriers and goods moved with them, at the check points through frontier (further - Typical TS of control) approved by the resolution of the Cabinet of Ministers of Ukraine of May 21, 2012 No. 451, the Procedure for customs clearance of military equipment, including the military vehicles crossing customs border of Ukraine No. 63 approved by the resolution of the Cabinet of Ministers of Ukraine of January 18, 2003 (with changes).

3. Customs at check points for sea, river and ferry connection interacts with the state bodies performing sanitary and epidemiologic, veterinary and sanitary, phytosanitary, radiological and environmental control (further - monitoring bodies), coordinates their work in customs control zones according to the procedure, established by the Customs code of Ukraine and other acts of the legislation of Ukraine.

In case of implementation in sea (river) ports of the Information system of port community (further - ISPS) monitoring bodies, freight forwarders, marine agents, other participants of process of registration of goods and vehicles use it according to requirements of Items 7 and 10 the Standard CU of the omission.

4. Application for the vessel of free practice is performed according to requirements of the Convention on simplification of international maritime traffic of 1965, Item 10 the Standard CU of the omission.

5. The parking lot of courts of foreign swimming, landing and disembarkation of passengers is determined by port administration in coordination with customs and body of protection of frontier.

Change of the parking lot of the vessel is carried out with the consent of customs and body of protection of frontier, except as specified accidents or actions of force majeure circumstances. At the same time the port administration immediately reports about it to customs.

The port administration does not allow the ship master of foreign swimming to leave the port water area without mark of customs in the general declaration.

6. The vessels performing cabotage swimming are under customs control during the whole time of cabotage. Customs formalities concerning the vessel of the cabotage swimming floating under National Flag of Ukraine come to an end after completion of cabotage transportation by it and in case of lack on it of the goods and vehicles which are under customs control, and/or ship rooms or other specially equipped places with the imposed customs providing.

7. Customs formalities concerning the courts of foreign swimming and goods moved with them through customs border of Ukraine are performed by customs at moorings, in water areas of ports or on site the anchor parking on raid. Customs control in water areas of ports on site of the anchor parking on raid is exercised in coordination with body of protection of frontier.

8. Customs formalities concerning the vessel which arrives to customs area of Ukraine or is disposed out of its limits can documentary be performed in premises of monitoring bodies before arrival (departure) of the vessel in (from) port.
