About approval of Rules of maintaining the register of self-regulatory organizations and about entering of amendments into the order of the Minister of national economy of the Republic of Kazakhstan of January 6, 2015 No. 4 "About approval of forms of notifications and Regulations of Admission of notifications by state bodies, and also about determination of the state bodies performing acceptance of notifications"

According to the subitem 2) article 6 of the Law of the Republic of Kazakhstan of November 12, 2015 "About self-regulation", PRIKAZYVAYU:

1. Approve Rules of maintaining the register of self-regulatory organizations according to appendix 1 to this order.

2. Bring in the order of the Minister of national economy of the Republic of Kazakhstan of January 6, 2015 No. 4 "About approval of forms of notifications and Regulations of Admission of notifications by state bodies, and also about determination of the state bodies performing the acceptance of notifications" (registered in the Register of state registration of regulatory legal acts at No. 10194, published in information system of law of Ad_let on April 01, 2015) the following amendments:

add Item 1 with subitem 3-1) of the following content:

"3-1) form of the notification on the beginning or the termination of activities of self-regulatory organization, according to appendix 3-1 to this order;";

add with appendix 3-1 according to appendix 2 to this order.

3. To provide to development department of entrepreneurship of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let, and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 3 of this order.

4. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective since May 15, 2016 and is subject to official publication.

Rules of maintaining register of self-regulatory organizations

1. General provisions

1. These rules of maintaining the register of self-regulatory organizations (further - Rules) are developed according to the subitem 2) of article 6 of the Law of the Republic of Kazakhstan of November 12, 2015 "About self-regulation" (further - the Law) and establish procedure for maintaining the register of self-regulatory organizations by regulatory state agencies.

Maintaining the register of self-regulatory organizations is performed by regulatory state agency in the respective sphere (industry) electronically.

2. In these rules the following basic concepts are used:

1) self-regulatory organization (further - SRO) - the non-profit organization in the form of association (union), public association or other form of business established by the laws of the Republic of Kazakhstan based on voluntary or obligatory membership (participation) of subjects of private entrepreneurship or subjects of professional activity by the principle of community of activities, industry, types of economic activity, market of manufactured goods (works, services);

2) rules of SRO (further - rules) - the document determining procedure for the organization of activities of SRO and its members (participants);

3) the standard of SRO (further - the standard) - the document establishing requirements for reuse by members (participants) of SRO of the single and obligatory principles, characteristics to their goods (works, services) and type of activity;

4) the register of SRO (further - the Register) - the list of SRO containing data on their details performed by them types of activity, their branches, created based on the notifications submitted according to the Law of the Republic of Kazakhstan "About permissions and notifications";

5) self-regulation - package of measures, provided by the Law, directed to independent regulation by physical persons and legal entities of the business or professional activity performed by them based on approval of rules and standards of SRO, control of their observance, and also ensuring property responsibility of subjects of self-regulation;

6) authorized body in the field of self-regulation (further - authorized body) - the central executive body performing management and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination concerning self-regulation;

7) regulatory state agencies - the state bodies performing management in separate industry or the sphere of public administration in which it is entered or self-regulation is planned to introduction;

8) the external portal of the state information system of permissions and notifications (further - the external portal) - the web portal of the state information system of permissions and notifications providing to physical persons and legal entities single point of access to services regarding licensing, allowing procedures and notifying procedure by means of the Internet.

3. Maintaining the Register includes the following stages:

1) the direction of the statement from the Register of SRO about the accepted notification on the beginning of implementation of activities of the SRO based on obligatory or voluntary membership (participation);
