Approve the Payment procedure of pension to the pensioners who are in the public stationary institutions of social servicing on complete state providing it (is applied).

Payment procedure of pension to the pensioners who are in the public stationary institutions of social servicing on complete state providing

1. General provisions

1. This Procedure determines rules of pension payment and use of pension means during finding of the pensioner in the public stationary institutions of social servicing (further - organization of social servicing) systems of the Ministry of Health and Social Protection of the Republic of Tajikistan.

2. Pension payment during stay of the pensioner in organization of social servicing for aged and disabled people

2. In case of accommodation of the pensioner in organization of social servicing its administration shall notify officially in time no more than five days on it authorized state body in the sphere of provision of pensions in the location of this organization.

3. The state authorized body in the sphere of provision of pensions in the location of organization of social servicing in time no more than three days after receipt of the notification requests from authorized state body in the sphere of provision of pensions in place of registration of the pensioner its pension case.

4. After receipt of pension case the state authorized body in the sphere of provision of pensions in the location of organization of social servicing registers it and during finding of the pensioner in this organization performs payment of its pension.

5. To the persons which are staying in organization of social servicing and having the right to insurance pension, monthly pension is paid in the amount of 20 percent of the granted pension, but at least 30 percent of the established basic pension. 1

6. To the persons which are staying in organization of social servicing and having the right to social pension, monthly pension is paid in the amount of 10 percent of the granted pension, but at least 30 percent of the established basic pension.

7. Pension payment to the pensioners staying in organization of social servicing is performed on the regulations established by this Procedure by means of branches of Government savings bank of the Republic of Tajikistan of Amonatbonk.

3. Pension payment during stay of the pensioner in organization of social servicing for psychoneurological patients

8. In case of accommodation of the pensioner in organization of social servicing for psychoneurological patients its administration shall notify officially in time no more than five days on it authorized state body in the sphere of provision of pensions in the location of this organization.

9. Pension payment of the pensioners who are in organization of social servicing for psychoneurological patients is performed by authorized state body in the sphere of provision of pensions in the location of this organization by transfer of the sum of their pension determined by this Procedure to the deposit account of the organization recognized by the legislation of the Republic of Tajikistan the guardian of the patients placed in it.

10. The pension amount which arrived into the deposit account of organization of social servicing is used by the decision of the Commission on the guardianship (further - the Commission) created by the director of organization from among representatives of administration, accounts department and trade-union committee for satisfaction of personal needs of pensioners. Commission chairman is the director of organization.

11. Belong to duties of the Commission:

- monthly creation of the list of the goods and products necessary for satisfaction of personal needs of pensioners;

- the official approval of the responsible person (persons) on purchase of goods, products and their delivery to pensioners.

12. The decision of the Commission is drawn up by the protocol. Protocols affirm signatures of the director and the main bukhalter and organizations of social servicing are sealed, are registered in the separate book, their sheets are numbered and stitched.

13. Use of the pension means which are on the deposit account of organization of social servicing is made according to the decision of the Commission by its accounts department in accordance with the established procedure.

14. Purchase of goods and the products necessary for satisfaction of personal needs of pensioners is confirmed by the act to which cash orders, checks, delivery notes and other financial records are attached.

15. On distribution of the goods and products which arrived in organization of social servicing to pensioners by responsible persons the separate statement confirmed by the signature of the director of this organization is drawn up.

16. The money arriving from authorized state body in the sphere of provision of pensions in organization of social servicing by means of branches of Government savings bank of the Republic of Tajikistan of Amonatbonk is registered in the book "Cash Receipt" and on each pensioner the calculation leaf is separately got.

17. Based on the decision of the Commission in leaves of calculation records about write-off of the used means are made, and the remaining balance of unused means is specified.

18. In case of transfer of the pensioner to other organization of social servicing for psychoneurological patients, not used amount of its pension in accordance with the established procedure is transferred to the deposit account of organization to which the pensioner is transferred.

19. In case of elimination of the pensioner from organization of social servicing of the pensioner in connection with recognition its capable, the unused pension amount is paid to it.

20. In case of the death of the pensioner whose guardian is the organization of social servicing unused means of its pension, except for remaining balance of means on its individual accumulation account, in the procedure established by the legislation of the Republic of Tajikistan are subject to return into the account of authorized state body in the sphere of provision of pensions.

21. Remaining balance of means on individual accumulation account of the pensioner, in the procedure established by the legislation of the Republic of Tajikistan, is subject to payment to his heirs. In case of absence of heirs, use of the specified means is performed in accordance with the established procedure.
