About restrictions and conditions of the admission of the separate types of radio-electronic products coming from foreign states for the purposes of implementation of purchases for ensuring the state and municipal needs

According to article 14 of the Federal law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" Government of the Russian Federation decides:

1. Approve the enclosed list of the separate types of radio-electronic products coming from foreign states concerning which restrictions and conditions of the admission for the purposes of implementation of purchases for ensuring the state and municipal needs are set (further - the list).

Determine that for the purposes of implementation of purchases of the separate types of radio-electronic products included in the list, the customer rejects all requests (final offers) containing offers on delivery of the separate types of radio-electronic products included in the list and coming from foreign states (except for state members of the Eurasian Economic Union) provided that on participation in determination of the supplier it is given at least 2 the notice on implementation of purchase and (or) documentation on purchase of requests (final offers) meeting requirements, which at the same time:

contain offers on delivery of the separate types of radio-electronic products included in the list and made in the territories of state members of the Eurasian Economic Union;

do not contain offers on delivery of the same type of radio-electronic products of one producer.

4. If the request (final offer) which contains the offer on delivery of the separate types of radio-electronic products included in the list and coming from foreign states is not rejected according to the restrictions set by this resolution, the admission conditions for the purposes of implementation of purchases of the goods coming from foreign state or group of foreign states established by the federal executive body performing functions on development of state policy and normative legal regulation in the sphere of implementation of purchases of goods, works, services for ensuring the state and municipal needs are applied.

5. Determine that for the purposes of restriction of the admission of the separate types of radio-electronic products coming from foreign states there cannot be subject of one contract (one lot) types of radio-electronic products included in the list and not included in it.

6. Determine that the separate types of radio-electronic products included in the list are recognized products made in the territory of the Russian Federation in case of compliance to one of the following conditions:

a) creation or upgrade and (or) development of production of such products within the special investment contract signed between the investor and the Russian Federation or the Russian Federation and the subject of the Russian Federation. At the same time for the purposes of this resolution such products are equated to products made in the territory of the Russian Federation within no more than 5 years from the date of the conclusion of the special investment contract and no more than 3 years from the date of the beginning of its production by the party - the investor of the special investment contract;

b) compliance to requirements to industrial output imposed for the purpose of its reference to products made in the Russian Federation, the provided appendix to the order of the Government of the Russian Federation of July 17, 2015 No. 719 "About confirmation of production of industrial output in the territory of the Russian Federation";

c) compliance to parameters according to which values the status of the telecommunication equipment of the Russian origin can be given to the telecommunication equipment made in the territory of the Russian Federation;

d) confirmation of the Russian Federation (state member of the Eurasian Economic Union) as products countries of source according to the Agreement on Rules of determination of the country of goods' origin in the Commonwealth of Independent States of November 20, 2009 (in the cases which are not falling under action of subitems "a", "b" and "v" of this Item).

7. Determine that for confirmation of recognition of separate types of radio-electronic products by products made in the territory of the Russian Federation in the request (final offer) which contains the offer on delivery of the separate types of radio-electronic products included in the list the copy of one of the following documents shall be provided:

a) the special investment contract in the case established by the subitem "an" of Item 6 of this resolution;

b) confirmation of production by the Ministry of Industry and Trade of the Russian Federation in the territory of the Russian Federation the separate types of radio-electronic products offered in the request (final offer), in the case established by the subitem "b" of Item 6 of this resolution;

c) the notification on assignment of the status of the telecommunication equipment of the Russian origin issued by the Ministry of Industry and Trade of the Russian Federation and the notification on confirmation of the status of the telecommunication equipment of the Russian origin issued by the Ministry of Industry and Trade of the Russian Federation (in the presence) in the case established by the subitem "v" of Item 6 of this resolution;

d) the certificate of ST-1 on the separate types of radio-electronic products offered in the request (final offer) in the case established by the subitem "g" of Item 6 of this resolution.

8. Determine that the separate types of radio-electronic products included in the list are recognized products made in the territories of state members of the Eurasian Economic Union (except for to the Russian Federation), according to the procedure, provided by the corresponding regulatory legal acts of state members of the Eurasian Economic Union (except for the Russian Federation).
