ORDER OF THE MINISTER OF HEALTH AND SOCIAL DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

of February 19, 2016 No. 134

About approval of Rules of assessment and determination of need for special social services

(as amended on 22-09-2022)

According to the subitem 2) article 8 of the Law of the Republic of Kazakhstan "About special social services" PRIKAZYVAYU:

1. Approve the enclosed Rules of assessment and determination of need for special social services.

2. To provide to social services department of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within five working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order its direction for official publication in periodic printing editions and information system of law of Ad_let;

4) placement of this order on official Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Zhakupova S. K.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of assessment and determination of need for special social services

1. These rules of assessment and determination of need for special social services (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About special social services" and determine evaluation procedure and determinations of need for special social services of persons (families) which are in difficult life situation.

2. In these rules the following basic concepts are used:

1) social disadaptation – violation of interaction of the personality with social environment;

2) social deprivation – restriction and (or) deprivation of possibility of independent satisfaction with person (family) of the basic vital needs;

3) medico-social examination (further - MSE) - assessment of the restrictions of activity of osvidetelstvuyemy person caused by permanent disorder of functions of organism with establishment (not establishment) of disability and (or) extent of disability, and also determination of his needs for measures of social protection;

4) psikhologo - medico-pedagogical consultation (further – PMPK) – the organization of education performing inspection and consultation of children, assessment of special educational needs and special conditions for education, determination of the educational program, and also directing to special psychology and pedagogical support of children with limited opportunities.

3. The need for special social services within the guaranteed amount of special social services is determined by the social worker by assessment and determination of need for special social services.

4. Local executive bodies on the basis of the conclusion of the social worker by assessment and determination of need for special social services make the decision on provision of special social services.

5. Types and amount of special social services for persons (families) which are in difficult life situation, served in medico-social organizations and the organizations (further - MSO) stationary and semiportable type are determined by the specialist in social work of this MSO.

6. No. 340 is excluded according to the Order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of 20.09.2021

7. Criteria of determination of need of persons (families) which are in difficult life situation in special social services are:

1) the activity restriction determined proceeding from violations of functions of organism;

2) social disadaptation;

3) social deprivation;

4) the unsuccessful social environment which is characterized by insufficiency or lack of material, economic, social and spiritual living conditions, forming and activities of person (family).

8. Assessment of need for special social services of persons (families) which are in difficult life situation is carried out according to criteria of determination of need for special social services and on the basis:

1) determinations of capability to independence in case of violation of functions of organism according to appendix 1 to these rules;

2) determinations of capability to independence in case of social disadaptation, proceeding from individual capabilities to training, labor activity, orientation, communication and capability to control the behavior according to appendix 2 to these rules;

3) determinations of capability to independence in case of social deprivation, proceeding from individual capabilities to self-service and the independent solution of this problem family according to appendix 3 to these rules;

4) estimates of social environment, insufficiency or lack of material, economic, social and spiritual living conditions according to appendix 4 to these rules.

9. Extent of restriction of activity of persons which are in difficult life situation is determined according to the Rules of conducting medico-social examination approved by the order of the Minister of health and social development of the Republic of Kazakhstan of January 30, 2015 No. 44 (it is registered in the Register of state registration of regulatory legal acts for No. 10589).
