Licensed conditions of implementation of economic activity on production of explosive materials of industrial function

General provisions

1. These Licensed conditions establish the exhaustive list of the documents enclosed to the application for receipt of the license for implementation of economic activity on production of explosive materials of industrial function (further - the license), and also determine the organizational, personnel, production and special requirements obligatory for accomplishment when implementing of the specified activities.

2. The licensee shall fulfill requirements of these Licensed conditions, and the license applicant - it to correspond.

3. In these Licensed conditions terms are used in the values given in the Law of Ukraine "About licensing of types of economic activity" (further - the Law) and the Law of Ukraine "About the treatment of explosive materials of industrial function".

4. Places of implementation of economic activity on production of explosive materials of industrial function (further - VM) are determined by the following types:

specialized enterprise;

stationary Item in the conditions of the company which carries out explosive works;

the mobile unit in the conditions of the company which carries out explosive works.

5. The license applicant for its obtaining submits the method provided by part one of article 10 of the Law to body of licensing the statement for receipt of the license according to appendix 1.

6. To the statement for receipt of the license, except documents, the stipulated in Article 11 Laws, are attached certified in accordance with the established procedure:

copies of the documents confirming availability at workers of the corresponding education and qualification (the diploma, the certificate) necessary for implementation of economic activity on production of explosive materials;

copies of documents (the certificate on the property right, the lease agreement, the agreement of concession, the agreement of management and joint activities) confirming the property right or uses of the areas (rooms) for storage of explosive materials;

copies of documents (the certificate on the property right, the lease agreement, the agreement of concession, the agreement of management and joint activities) confirming the property right or uses of special motor transport for transportation of explosive materials;

passport copy of composition of explosive materials;

copies of production schedules of production of explosive materials;

the copy of regulations on management of the works connected with turnover of explosive materials signed by the license applicant.

The list of documents, enclosed to the application for receipt of the license, moves in duplicate according to appendix 2.

Personnel requirements to implementation of economic activity on production of explosive materials

7. The licensee shall have the number of staff of workers (contractors depending on type of the place of implementation of economic activity on production of explosive materials) who have the corresponding education and qualification.

8. Production of explosive materials is performed under the leadership of the officials having appropriate level of the higher education (on degree of the bachelor and master) on the specialties connected with the treatment of explosive materials which timely underwent training and examination in the field of the treatment of explosive materials and training and examination in labor protection.

9. The capable persons which reached 21-year age who got professional education in mining or chemical industries are allowed to production process of explosive materials, passed training at the relevant companies, training and examination in the field of the treatment of explosive materials and training and examination in labor protection.

10. The license applicant, the licensee draws up employment relationships with personnel by the conclusion of employment contracts according to Article 24 of the Labor code of Ukraine.

Organizational requirements to implementation of economic activity on production of explosive materials

11. The licensee keeps documents which copies moved to body of licensing for its obtaining during action of the license.

12. The licensee keeps during license effective period documents (their copy) confirming accuracy of the data which were specified by the license applicant in documents which were filed to body of licensing.

13. The licensee shall notify body of licensing on all changes of the data specified in its documents enclosed to the application for receipt of the license, in time, not exceeding one month from the date of approach of such changes.

14. The licensee provides presence of the head of the licensee, his deputy or other authorized person during licensing by body in the procedure for test of observance by the licensee of requirements of these Licensed conditions established by the law.

15. The licensee develops operations procedure in case of the planned or unplanned termination (in connection with impossibility of use of material and technical resources, emergence of force majeur circumstances, etc.) economic activity on production of explosive materials in general or in certain places of implementation of such activities and recovery of its production.

16. The licensee shall conduct economic activity on production of explosive materials only within the places of implementation of the economic activity which is subject to licensing, specified in the supporting documents submitted to body of licensing according to requirements of these Licensed conditions.

17. The licensee shall conduct economic activity on production of explosive materials only with use of the means of its production specified in the supporting documents submitted to body of licensing according to requirements of these Licensed conditions.
