requirements for ensuring transport safety, including requirements to anti-terrorist security of objects (territories) considering safety levels for different categories of objects of transport infrastructure and vehicles of road and urban land electric transport;

Requirements for ensuring transport safety, including requirements to anti-terrorist security of objects (territories) considering safety levels for different categories of objects of transport infrastructure of road economy

1. This document establishes requirements for ensuring transport safety, including requirements to anti-terrorist security of objects (territories) considering safety levels for different categories of objects of transport infrastructure of road economy (further - objects of transport infrastructure).

2. This document is applied to the objects of transport infrastructure operated in the territory of the Russian Federation and carried according to the Federal Law "About Transport Safety" to the objects of transport infrastructure which are subject to categorization.

3. This document is not applied in the relation:

1) the objects of transport infrastructure operated in the territory of the Russian Federation and carried according to part 5 of article 6 of the Federal law "About Transport Safety" to the objects of transport infrastructure which are not subject to categorization;

2) the objects of transport infrastructure which are in borders of the territories of the closed administrative-territorial educations in which industrial enterprises on development, production, storage and utilization of weapons of mass destruction, conversion of radioactive and other materials, and also military and other facilities for which the specific mode of safe functioning and protection of the state secret including special living conditions of citizens is set are located;

3) the objects of transport infrastructure which are in borders of the territory of objects which protection is assigned to internal troops of the Ministry of Internal Affairs of the Russian Federation, military facilities which protection is performed by military units and the organizations of the Ministry of Defence of the Russian Federation, and also organizations of criminal executive system of Federal Penitentiary Service.

4. The list of levels of safety and procedure for their announcement in case of change of the degree of threat to making of the act of illegal intervention in activities of transport complex (further - the act of illegal intervention) are established according to part 2 of article 7 of the Federal law "About Transport Safety".

The amount of categories of objects of transport infrastructure and vehicles and criteria of categorization of objects of transport infrastructure and vehicles are established according to part 2 of article 6 of the Federal law "About Transport Safety".

5. This document is obligatory for execution by subjects of transport infrastructure.

6. Subjects of transport infrastructure for the purpose of ensuring transport safety of objects of transport infrastructure shall:

1) to designate person responsible for ensuring transport safety in the subject of transport infrastructure;

2) to designate person (persons) responsible for ensuring transport safety of one or several objects of transport infrastructure;

To form 3) for protection of object of transport infrastructure against acts of illegal intervention (to create) and attract according to the plan of ensuring transport safety of object of transport infrastructure (further - the plan of object of transport infrastructure) the divisions of transport safety which are including the rapid response teams which are specially equipped, the mobile, round the clock carrying out tasks of response to preparation of making or making of acts of illegal intervention (further - rapid response teams) in zone of transport safety of object of transport infrastructure, its land, underground, air, deadworks for which according to this document the specific mode of pass (drive) of physical persons, vehicles and bringing (transportation) of loads, baggage, cabin baggage is set, personal belongings or movement of animals (further - zone of transport safety of object of transport infrastructure), and (or) on the critical elements of object of transport infrastructure including structures, rooms, structural, technological and technical members of object of transport infrastructure, making of the act of illegal intervention concerning which will lead to the complete or partial cessation of functioning of object of transport infrastructure and (or) emergence of emergency situations (further - critical elements of object of transport infrastructure), and also tasks of response to violations of the inside and throughput modes;

To represent 4) to Federal Highway Agency the complete and authentic information about the subject of transport infrastructure and about object of transport infrastructure for categorization and maintaining the register of objects of transport infrastructure and vehicles, the stipulated in Article 6 Federal Laws "About Transport Safety", and also complete and reliable information on quantitative indices of criteria of categorization of the objects of transport infrastructure established by the Ministry of Transport of the Russian Federation;

5) to provide evaluating vulnerability of object of transport infrastructure and representation of its results on approval in Federal Highway Agency in accordance with the established procedure within 3 months from the date of placement on the official site of Federal Highway Agency on the Internet of data on assignment of category to object of transport infrastructure which is followed by the adequate notice of the subject of transport infrastructure by e-mail and in writing;

To represent 6) based on the approved results of assessment of vulnerability of object of transport infrastructure to Federal Highway Agency the plan of object of transport infrastructure within 3 months from approval date of results of assessment of vulnerability of object of transport infrastructure;

7) to realize the plan of object of transport infrastructure step by step, no later than 2 years from the date of assignment of category to object of transport infrastructure;

8) to provide the address with data on results of the carried-out assessment of vulnerability of objects of transport infrastructure and the data containing in the plan of object of transport infrastructure which is information of limited access, according to the procedure, established by the Government of the Russian Federation according to part 8 of article 5 of the Federal law "About Transport Safety";

To approve 9) within one month from the date of approval of results of assessment of vulnerability of object of transport infrastructure the following organizational and administrative documents which are directed to implementation of measures for ensuring transport safety of object of transport infrastructure, are certified by the subject of transport infrastructure and which copies are attached to the plan of object of transport infrastructure:

regulations (charter) on division of transport safety in case of its attraction of transport infrastructure by the subject for protection of object of transport infrastructure against acts of illegal intervention, the agreement according to which the specified division of transport safety is attracted;

organizational structure (scheme) of management of forces of ensuring transport safety;

the list of established posts of the workers of the subject of transport infrastructure who are directly connected with ensuring transport safety of object of transport infrastructure;

the list of established posts of the workers of the subject of transport infrastructure performing activities in zone of transport safety of object of transport infrastructure and on critical elements of object of transport infrastructure;

the list of established posts of workers of the legal entities and (or) individual entrepreneurs performing on legal causes activities in zone of transport safety of object of transport infrastructure and (or) on critical elements of object of transport infrastructure, except for authorized divisions of federal executive bodies;

procedure for response of forces of ensuring transport safety to preparation for making of the act of illegal intervention or making of the act of illegal intervention;

procedure for bringing to forces of ensuring transport safety of information on change of levels of safety of objects of transport infrastructure, and also response to such information;

order of interaction between forces of ensuring transport safety of objects of transport infrastructure and (or) forces of safety control of objects of transport safety with which there is technological interaction;

procedure (scheme) for informing Federal Highway Agency and authorized divisions of bodies of Federal Security Service of the Russian Federation, law-enforcement bodies and Federal Service for the Oversight of Transport about direct direct threats and the facts of making of acts of illegal intervention;

the scheme of placement and structure of equipment of check-points and posts of object of transport infrastructure on borders of zone of transport safety of object of transport infrastructure and (or) its part, sectors, critical elements of object of transport infrastructure and posts of object of transport infrastructure, except for sectors of open entry of zone of transport safety of object of transport infrastructure (further - the sector of open entry);

the scheme of placement of technical systems and means of the examination including the actions for ensuring transport safety, inspection of the physical persons, vehicles, loads, baggage, cabin baggages and personal belongings which is at physical persons, and other material objects, directed to detection of weapon, explosive substances or other devices, objects and substances, concerning which according to the rules of carrying out examination, additional examination and repeated examination for the purpose of ensuring transport safety established according to part 13 of article 12.2 of the Federal law "About Transport Safety" (further - rules of carrying out examination) the prohibition or restriction for moving to zone of transport safety of object of transport infrastructure or its part (further - objects and substances which are prohibited or limited for movement), and also on identification of persons is provided, not having legal basis for pass (journey) to zone of transport safety of object of transport infrastructure (except for sectors of open entry) or its part (further - examination), on object of transport infrastructure for identification of objects and substances which are prohibited or limited for movement;

the procedure for product transmission from technical means of ensuring transport safety to authorized divisions of bodies of Federal Security Service of the Russian Federation, law-enforcement bodies and Federal Service for the Oversight of Transport approved with authorized divisions of bodies of Federal Security Service of the Russian Federation, law-enforcement bodies and Federal Service for the Oversight of Transport, including providing product transmission from technical means of ensuring transport safety of object of transport infrastructure by provision by the subject of transport infrastructure of rooms to the specified divisions of federal executive bodies for accomplishment of tasks (according to the established powers) on object of transport infrastructure, in other cases, the providing access to data from technical means of ensuring transport safety of object of transport infrastructure (further - procedure for product transmission);

the regulations (instruction) on the throughput and inside modes on object of transport infrastructure consisting including from the following Sections (appendices):

procedure for the organization and carrying out:

examination;

the additional examination including actions for ensuring transport safety, inspection of subjects to examination for the purpose of recognition and identification of the objects and substances revealed during examination and also on inspection of material objects which can be used for making of acts of illegal intervention (further - additional examination);

the repeated examination including the actions performed in case of receipt by the subject of transport infrastructure of information on threat of making of the act of illegal intervention for the purpose of ensuring transport safety and identification of physical persons in which actions signs of preparation for making of acts of illegal intervention, or material objects which can be used for making of acts of illegal intervention (further - repeated examination) are seen;

observations and (or) interviews including the events held for the purpose of ensuring transport safety during examination in the cases provided by the this document, and directed to identification of physical persons in which actions signs of preparation for making of acts of illegal intervention by results of which carrying out the decision on carrying out additional examination is made (further - observation and (or) interview) are seen;

procedure for reconciliation and (or) verification of documents based on which the admission of subjects to examination in zone of transport safety of object of transport infrastructure or its part is performed (except for sectors of open entry);

accounting treatment and the admission in zone of transport safety of object of transport infrastructure or its part, on critical elements of object of transport infrastructure of subjects to examination (except for sectors of open entry);

operations procedure of forces of ensuring transport safety in case of identification at check-points and posts of objects of transport infrastructure of the subjects to examination which do not have legal basis on pass (drive) and stay in zone of transport safety of object of transport infrastructure or its part and (or) on critical elements of object of transport infrastructure;

operations procedure of forces of ensuring transport safety in case of detection of objects and substances which are prohibited or limited for movement;

the list and method of operation (functioning) of technical means of ensuring transport safety, including obstacles, anticollision devices, grids, the strengthened doors, fences, sluice chambers, customs platforms, locking devices, other constructions and devices intended for taking measures to non-admission of unauthorized penetration and making of acts of illegal intervention;

evaluation procedure of the data obtained with use of technical means of ensuring transport safety;

procedure for issue, accounting, storage, use and destruction of the omissions provided by the Rules of the admission on object of transport infrastructure of road economy given in appendix;

approved with authorized divisions of bodies of Federal Security Service of the Russian Federation and law-enforcement bodies:

procedure for transfer to authorized representatives of the divisions of bodies of Federal Security Service of the Russian Federation and law-enforcement bodies of the revealed persons who made or preparing making of acts of illegal intervention for which administrative or criminal liability is established (further - violators) and also the identified weapons, ammunition, explosive substances and destructive devices, toxic or radioactive materials in the absence of legal causes on their storage and carrying;

procedure for approval of issue of permanent omissions of authorized divisions of bodies of Federal Security Service of the Russian Federation and law-enforcement bodies and notification of authorized divisions of bodies of Federal Security Service of the Russian Federation and law-enforcement bodies on issue of one-time omissions;

10) to provide product transmission from technical means of ensuring transport safety to authorized divisions of bodies of Federal Security Service of the Russian Federation, law-enforcement bodies and Federal Service for the Oversight of Transport according to procedure for product transmission;

11) to check forces of ensuring transport safety of object of transport infrastructure for the purpose of identification of the bases provided by part 1 of article 10 of the Federal law "About Transport Safety" and not to allow to the works which are directly connected with ensuring transport safety of object of transport infrastructure, persons concerning whom the circumstances provided by part 1 of article 10 of the Federal law "About Transport Safety" will be revealed;

12) to provide preparation and certification of forces of ensuring transport safety according to article 12.1 of the Federal law "About Transport Safety" for the purpose of their admission to work on the positions which are directly connected with ensuring transport safety of object of transport infrastructure and also to fulfillment of duties on protection of object of transport infrastructure against acts of illegal intervention according to the plan of object of transport infrastructure;
