About approval of Sanitary regulations on supervision of health of persons subject to impact of factors of professional risk

(as amended of the Order of the Government of the Republic of Moldova of 18.12.2017 No. 1090)

In pursuance of provisions of articles 6 and 10 of the Law No. 10-XVI of February 3, 2009 on the state supervision of public health (The official monitor of the Republic of Moldova, 2009, No. 67, the Art. 183), with subsequent changes and amendments, article 6 of the Law No. 186-XVI of July 10, 2008 on health protection and labor safety (The official monitor of the Republic of Moldova, 2008, Art. No. 143-144, 587), with subsequent changes and amendments, DECIDES: the Government

1. Approve Sanitary regulations on supervision of health of persons subject to impact of factors of professional risk it (is applied).

2. The above-stated Sanitary regulations are applied to all legal entities and physical persons, irrespective of property type.

3. This resolution becomes effective in 3 months after publication in the Official monitor of the Republic of Moldova.

4. To impose control of execution of this resolution on the Ministry of Health, work and social protection.

Sanitary regulations on supervision of health of persons subject to impact of factors of professional risk

I. General provisions

1. These Regulations on supervision of health of persons subject to impact of factors of professional risk (further – Regulations), establish requirements to supervision of health of persons depending on risk factors (the chemical, physical, physical and chemical, biological and other factors provoked by labor process) on workplace.

2. These Regulations shift provisions of Article 14 of the Directive 89/391/EEC of June 12, 1989 on introduction of the measures promoting improvement of the safety and occupational health of workers on workplace published in the Official magazine of the European Union by L183 of June 29, 1989.

3. The stated below terms and phrases used in these Regulations have the following determinations:

observation of the state of health of persons – wide range of medical and sanitary services which provide prevention of occupational diseases, their identification at early stages, and also detection of general diseases with temporary disability, monitoring of health of persons and professional risk factors;

obligatory medical examinations of persons subject to impact of professional risk factors – component of supervision of the state of health of persons which represents the all-clinical inspections which are carried out by the pathologist with participation of profile specialists and application of laboratory researches depending on specific impact;

person – any person who performs or will perform work according to certain specialty, qualification or function which it treats:

a) person who gets a job;

b) worker, including in combination;

c) trainee and pupil;

d) temporary employee;

e) patentee;

the temporary employee – the worker hired on seasonal works for a period of up to 5 months;

professional risk factors – the factors of the production circle inherent in workplace and specific profession which can influence health, in particular, can cause occupational diseases with temporary or permanent disability;

working capacity – employee ability, from the medical point of view, to carry out activities on workplace in profession/position for which medical examination is requested;

conditional working capacity – employee ability, from the medical point of view, to carry out activities on workplace on condition of observance of certain medical recommendations;

temporary disability – inability of the worker, from the medical point of view, to carry out activities on workplace in profession/position for which medical examination, before re-examination by the pathologist is requested;

permanent disability – inability of the worker, with medical to the point of view to carry out activities on workplace in profession/position for which medical examination concerning working capacity is requested;

contraindications – the states of health which limit or interfere with activities of persons with specific risk factors on workplace, with the following features:

a) the specified contraindications are the reason for release/non-admission to work with professional risk factors;

b) there are relative and absolute contraindications which require assessment of weight of disease/disability and professional risk factors on workplace;

c) sharp diseases, before their treatment, constitute absolute contraindications;

the card of the direction on medical examination – the single document regulating the direction of persons on medical examination, except for periodic medical examination (appendix No. 2 to these Regulations);

the card of identification of factors of professional risk – the document reflecting assessment of professional risk factors in workplace (appendix No. 3 to these Regulations).

4. Supervision of health of persons subject to impact of professional risk factors in the administrative territory, is obligation of the centers of public health provided by doctors-hygienists of professional health.

5. Obligatory routine medical examinations of persons subject to impact of professional risk factors (further – medical examinations), are carried out by medical commissions of public/private medical and sanitary institutions (further – medical commissions) in coordination with the Ministry of Health, work and social protection.

6. The structure of medical commissions affirms orders of public/private medical and sanitary institutions, with appointment of the pathologist the chairman of medical commission, responsible for the organization and performing medical examinations.

7. Each person which is affected by factors of professional risk shall have medical examination according to the List of risk factors of the production circle and the obligatory preventive medical services provided to persons depending on professional impact (appendix No. 1 to these Regulations) and has the right:

1) to consult with the pathologist in connection with any changes of the state of health which connects with working conditions;
