About approval of Rules of implementation of social resettlement of persons which were injured from the act of terrorism

Rules of implementation of social resettlement of persons which were injured from the act of terrorism

1. General provisions

1. These rules of implementation of social resettlement of persons which were injured from the act of terrorism (further - Rules), are developed according to the Law of the Republic of Kazakhstan "About counteraction to terrorism" and determine procedure of social resettlement of persons which were injured from the act of terrorism.

2. Social resettlement is provided to the citizens of the Republic of Kazakhstan, foreigners and persons without citizenship recognized as the victims from the act of terrorism (further - the victims) according to the procedure, established by the criminal procedure legislation of the Republic of Kazakhstan.

3. Social resettlement of the victims provides rendering free necessary legal assistance, psychological and medical recovery (further - social resettlement).

4. Social resettlement appears the state bodies performing counteraction to terrorism (further - state bodies) in the place of making of the act (acts) of terrorism, or in the place of residence of the victim for the account and within the means provided in republican and local budgets.

5. Social resettlement of the citizens of the Republic of Kazakhstan recognized as the victims from the act of the terrorism made in the territory of foreign state is performed according to the procedure, established by these rules if other is not established by international treaties.

2. Procedure of social resettlement of persons which were injured from the act of terrorism

6. The basis for implementation of social resettlement is the resolution of the body conducting criminal procedure on recognition of person by the victim.

7. For receipt of social resettlement the close relative (legal representative) who was injured or acting from his name address to territorial authority of authorized state body on coordination of activities in the sphere of counteraction to terrorism (further - territorial authority of Committee of homeland security of the Republic of Kazakhstan) with the statement with indication of surname, name, middle name (in case of its availability), the individual identification number (IIN), the residential address of the victim and type of social resettlement which he wishes to receive.

8. The territorial authority of Committee of homeland security of the Republic of Kazakhstan within two working days sends the answer to the close relative (legal representative) who was injured or acting from his name about results of consideration of the application in writing, with indication of the name of state body (organization) where it is necessary to address for receipt of required type of social resettlement, its location which specific employee the victim needs to address, numbers of office phone, the fax, the e-mail address (if necessary).

9. The legal assistance is given to the victim without delay by territorial authorities of the Ministry of Justice of the Republic of Kazakhstan within their competence of written, oral and electronic forms.

Territorial authorities of the Ministry of Justice of the Republic of Kazakhstan render assistance to the victim in issue of necessary documents.

10. The territorial authority of Committee of homeland security of the Republic of Kazakhstan sends to territorial authority of the Ministry of Justice of the Republic of Kazakhstan the copy of the application of the victim about receipt of legal assistance.

For receipt of legal assistance the following documents are in addition submitted to territorial authority of the Ministry of Justice of the Republic of Kazakhstan:

1) the copy of the identity document of person which was injured from the act of terrorism;

2) the copy of the resolution on recognition of person by the victim from the act of terrorism.

In case of the address in writing or in electronic form, certified by the digital signature, territorial authorities of the Ministry of Justice of the Republic of Kazakhstan within five working days send to the victim the answer about results of consideration of the application. In case of the address in oral form the victim receives the answer without delay.

11. The head of territorial authority of the Ministry of Justice of the Republic of Kazakhstan informs the chief of territorial authority of Committee of homeland security of the Republic of Kazakhstan on results of holding actions for rendering legal assistance to the victims from the act of terrorism.

12. Psychological recovery by the victim appears without delay in the place of making of the act (acts) of terrorism and consists in provision of the help by it by specialists of the corresponding profile (psychologists).

For implementation of psychological recovery by territorial authority of Committee of homeland security of the Republic of Kazakhstan are created interdepartmental working group.

The interdepartmental working group joins specialists: regular psychologists and the staff of divisions of psychological service of the state bodies performing counteraction to terrorism, specialists of the organizations of health care, the organizations of system of social protection of the population, the special organizations of education (psikhologo - medico-pedagogical consultations, the rehabilitation centers, offices of psychology and pedagogical correction).

The deputy chief of territorial authority of Committee of homeland security of the Republic of Kazakhstan supervising questions of counteraction to terrorism is appointed the head of interdepartmental working group on rendering psychological recovery.

13. For receipt of psychological recovery in territorial authority of Committee of homeland security of the Republic of Kazakhstan together with the statement specified in Item 7 of these rules the following documents also in addition are provided:

1) the copy of the identity document of person which was injured from the act of terrorism;

2) the copy of the resolution on recognition of person by the victim from the act of terrorism.
