Based on part two of subitem 1.15 of Item 1 and in pursuance of paragraph two of subitem 9.2 of Item 9 of the Presidential decree of the Republic of Belarus of July 14, 2016 No. 268 "About creation and activities of the open joint stock company "Asset Management Agency" Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure and terms of transfer in the republican budget of the means received by Asset Management Agency open joint stock company it (is applied).

2. This resolution becomes effective after its official publication.

Regulations on procedure and terms of transfer in the republican budget of the means received by Asset Management Agency open joint stock company

1. This Provision determines procedure and terms of transfer in the republican budget of the means received by Asset Management Agency open joint stock company (further – the Agency), according to part one of subitem 1.15 of Item 1 of the Presidential decree of the Republic of Belarus of July 14, 2016 No. 268 (further – the Decree No. 268).

2. Calculation of the means which are subject to transfer in the republican budget according to the paragraph the second parts one of subitem 1.15 of Item 1 of the Decree No. 268, is performed by the Agency quarterly accruing result since the beginning of year as the amount of the means which are actually received by the Agency since the beginning of year from repayment of principal debt and percent on the credits acquired at banks and "Development Bank of the Republic of Belarus" open joint stock company according to the Decree No. 268*.

Calculation of the means which are subject to transfer in the republican budget according to the paragraph third parts one of subitem 1.15 of Item 1 of the Decree No. 268, is performed by the Agency for accounting year as difference between other income and expenses which are actually made by the Agency in reporting year, capital investments and the amount of the funds allocated according to the solution of the supervisory board for obligation fulfillment of the Agency on bonds of own issue which are actually gained since the beginning of year (in case of lack of other sources of execution of such obligations), and also taking into account profit distribution of the Agency.

3. Calculation of the means which are subject to transfer in the republican budget for form according to appendix affirms the supervisory board of the Agency and it is represented the Agency in the Ministry of Finance:

for I–III quarters of accounting year – no later than the 20th following reporting quarter;

for the IV quarter of accounting year, accounting year – no later than 5 working days after approval by general meeting of shareholders of the Agency of the annual statement, annual individual accounting (financial) accounts and profit distribution and losses of the Agency.

4. Transfer in the republican budget of means according to Item 3 this provision is made by the Agency according to the procedure, established by the Ministry of Finance and National Bank for execution of the republican budget for the income, into accounts of the Ministry of Finance on accounting of means of the republican budget:

for I–III quarters of accounting year – no later than the 22nd following reporting quarter;

for the IV quarter of accounting year, accounting year – no later than 10 working days after approval by general meeting of shareholders of the Agency of the annual statement, annual individual accounting (financial) accounts and profit distribution and losses of the Agency.

If the amount of the means estimated according to Item 3 this provision, less or is equal to zero, transfer in the republican budget is not made.

5. If the last day of term of representation of calculation or transfer in the republican budget of means according to Items 3 and 4 of this provision falls on non-working day, the next working day following it is considered day of the termination of term.
