Regulations on procedure for approval by committees on agricultural industry and food of regional executive committees of purchase of additional amount of remedies of plants which procurement was conducted in the current year, in case of urgent need for such means

1. This Provision determines procedure for approval by committees on agricultural industry and food of regional executive committees of purchase of additional amount of remedies of plants which procurement was conducted in the current year, in case of urgent need for such means (further - additional purchase of remedies of plants).

2. For the purposes of this provision terms and their determinations in the values established in article 1 of the Law of the Republic of Belarus of July 13, 2012 "About public procurements of goods (works, services)" are used (The national legal Internet portal of the Republic of Belarus, 21.07. 2012, 2/1971).

3. For review additional purchase of remedies of plants by the organization performing activities for cultivation of crops, and also activities for cultivation of these cultures and conversion of products of agricultural industry (further - the organization), the statement with reasons for need of additional purchase of remedies of plants goes to committee on agricultural industry and food of regional executive committee (further - the statement).

4. The organization has the right to send along with the statement to committee on agricultural industry and food of regional executive committee other documents proving feasibility of additional purchase of remedies of plants.

5. The committee on agricultural industry and food can refuse to the organization adoption of the statement according to the procedure and on the bases provided in article 17 of the Law of the Republic of Belarus of October 28, 2008 "About bases of ministerial procedures" (The national register of legal acts of the Republic of Belarus, 2008, No. 264, 2/1530).

6. The statement is subject to registration in day of its receipt in committee on agricultural industry and food of regional executive committee.

7. For consideration of the applications in committee on agricultural industry and food of regional executive committee the working group which structure joins specialists of committee on agricultural industry and food of regional executive committee, public institution "Main state inspectorate for seed farming, quarantine and protection of plants" and (or) its territorial organizations is created.

8. Consideration of the application with the documents attached to it is performed by the working group specified in Item 7 of this provision within three working days from the date of its registration.

9. By results of consideration of the application with the documents attached to it by the committee on agricultural industry and food of regional executive committee makes the decision on approval or refusal in approval of additional purchase of remedies of plants within one working day.

10. The decision on refusal in approval of additional purchase of remedies of plants is made according to the procedure and on the bases provided in articles 25 and 26 of the Law of the Republic of Belarus "About bases of ministerial procedures" and also in cases of insufficient reasons for need of carrying out additional purchase of remedies of plants and (or) its economic inexpediency.

11. The organization is notified by committee on agricultural industry and food of regional executive committee on the made decision on refusal in adoption of the statement or approval (refusal in approval) additional purchase of remedies of plants within two working days from the date of adoption of the relevant decision.

12. The decision on refusal accepted by committee on agricultural industry and food of regional executive committee in adoption of the statement or approval (refusal in approval) additional purchase of remedies of plants can be appealed according to the procedure, established by the legislation.
