About classification of wood and polymeric composite of WPC

(as amended of the Order of Customs Service of the Republic of Moldova of 20.07.2017 No. 276)

For the purpose of single classification of homogeneous goods, effective customs control of the goods crossing border of the Republic of Moldova, their identification according to the Combined commodity nomenclature approved by the Law No. 172 of July 25, 2014 (Monitorul oficial al Republicii Moldova, 2014, No. 231-237/529), and also based on Article 141-2 of the Customs code of the Republic of Moldova No. 1149-XIV of 20.07.2000 (переопубликован in Monitorul oficial al Republicii Moldova; special release of January 1 2007), with subsequent changes and amendments, I ORDER:

1. Approve Methodology of classification of wood and polymeric composite of WPC (according to appendix).

2. To assign execution of this order to chiefs of customs.

3. This order becomes effective from the date of publication in Monitorul oficial al Republicii Moldova.

Methodology of classification of wood and polymeric composite of WPC

This Methodology is developed based on the Combined commodity nomenclature approved by the Law No. 172 of 25.07.2014 (Monitorul oficial al Republicii Moldova, 2014, No. 231-237/529), the explanations to the Harmonized commodity description and coding system developed by World Customs Organization, one of the parties of which is the Republic of Moldova.

The wood and polymeric composite of WPC (Wood Polymer Composite) represents the composition material consisting of wood flour (of 40-90%), thermoplastic polymers (polyvinylchloride, polypropylene, polyethylene, etc.), stabilizers, dyes, etc. Wood flour turns out from wood sawdust or vegetable fibers, such as hemp, straw, peel, nutshell, production wastes of vegetable oils, etc.

The wood and polymeric composite is made as follows:

the wood and/or vegetable elements which are thinly crushed mix up with thermoplastic polymers and additives modifiers. In the course of copolymerization the composition heats up to reach almost liquid state. At the following stage hot fusion under high pressure gets to extruder which leaves ready-made product of certain form.

According to the note 1 to group 39 of the Combined commodity nomenclature, the term "plastic" means materials of goods items 3901–3914, which are capable in case of polymerization or at any subsequent stage to take the set form under the influence of external impact (usually temperatures and pressure, and if necessary and with use of the solvent or the plasticizer) and to keep it after elimination of external impact, such as pressing, casting, extruding, mangling or another.

According to explanations to the Harmonized system to group 39, the Section "Primary Forms", Item (2) "Powders, granules and flakes", these materials can include fillers, for example wood flour. In Item (1) these explanations it is specified that "liquids and pastes may contain also other materials, such as plasticizers, stabilizers, fillers and dyes".

Considering that the wood and polymeric composite is made partially of plastic and it can be created (extrusion method) directly in shape which it keeps, this product has the main characteristics of plastic (the note 1 to group 39).

In spite of the fact that the high share of wood flour is added (as filler), the ready-made product foreign similar to wood (see the image below), keeps characteristics of plastic, such as rigidity, stability of the sizes, resistance to weather conditions, durability, etc.

Respectively, the wood and polymeric composite of WPC consisting of wood flour, plastic, stabilizers, dyes, etc. is classified by application of the rule of 1 interpretation of the Combined commodity nomenclature in goods item 3916 "by Mononit with size of cross section more than 1 mm, rods, cores and profiles shaped, with the processed or raw surface, but not undergone to other processing, from plastic".
