About road transport

Article 1. Purpose of this Law

The purpose of this Law is forming of the legal basis of activities of road transport in the Republic of Uzbekistan.

Article 2. Basic concepts

In this Law the following basic concepts are applied:

road transport - production and technological complex with entering it legal entities and physical persons providing the needs of economy and the population for motor transportations of passengers, baggage and loads, including mails (further - passengers, baggage and loads).

vehicles - the cars, cars tractors, trail cars and semitrailer trucks intended for public conveyance, baggage, loads and accomplishment of special works;

carrier - the legal entity or physical person which is owning the vehicle on the property right or other corporeal rights, rendering on commercial basis services in public conveyance, baggage, loads and having on this special permission (license);

the client (the passenger, the consignee, the consignor) - the legal entity or physical person using services of carrier according to the signed transportation agreement.

Article 3. Legislation on road transport

The legislation on road transport consists of this Law and other acts of the legislation.

The relations in the field of road transport in the Republic of Karakalpakstan are governed also by the legislation of the Republic of Karakalpakstan.

The relations in the field of city passenger traffic are governed also by the Law of the Republic of Uzbekistan "About urban passenger transportation".

Rules of public conveyance, baggage and loads, safety control of movement affirm the Cabinet of Ministers of the Republic of Uzbekistan.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which contain in the legislation of the Republic of Uzbekistan on road transport then are applied rules of the international treaty.

Article 4. Patterns of ownership of road transport

The road transport in the Republic of Uzbekistan can act on the basis of private and public property. All owners of road transport have the equal rights and use equal protection of the law.

Article 5. Earth of road transport

Lands for ensuring activities of road transport are provided in permanent use according to the procedure, determined by the land legislation,

Article 6. Classification of vehicles

Vehicles are subdivided on passenger, cargo and special.

Buses, minibuses, cars, passenger trail cars and semitrailer trucks belong to passenger vehicles.

Cargo vehicles, cars tractors, trail cars and semitrailer trucks belong to cargo vehicles. Depending on design features and nature of use cargo vehicles are subdivided into means of general and specialized purpose.

The cars, trail cars and semitrailer trucks intended for accomplishment different special, mainly not transport works belong to special vehicles (fire trucks, cars with compressor units, truck cranes, harvest cars, etc.).

Article 7. Types of motor transportations

Motor transportations are subdivided on city, suburban, long-distance and international.

The transportations performed within borders of the city or city settlement belong to city transportations.

The transportations performed outside borders of the city or city settlement on distance to fifty kilometers inclusive belong to suburban transportations.

The transportations performed outside borders of the city or city settlement on distance more than fifty kilometers, and also the transportations performed in the territory of two and more areas of the Republic of Uzbekistan irrespective of route extent belong to long-distance transportations.

The transportations performed out of limits of frontier or because of frontier of the Republic of Uzbekistan irrespective of route extent belong to international carriages.

Article 8. International carriages of passengers, baggage and loads

The international motor transportations of passengers, baggage and loads, including transit, are performed on the highways open for the international and transit messages according to the legislation and international treaties of the Republic of Uzbekistan.

Article 9. State regulation and management of activities of road transport

State regulation of activities of road transport is performed by certification, licensing, the taxation, forming of rates for socially important transportations, single scientific and technical policy, and also other stipulated by the legislation forms.

Public administration road transport is exercised of the state body authorized by the Cabinet of Ministers of the Republic of Uzbekistan on management of road transport, and also public authorities on places.

State governing bodies have no right to interfere with economic activity of carriers, and also to distract their operating personnel for other works, except as specified, stipulated by the legislation.

Article 10. The main powers of state body on management of road transport

The main powers of state body on management of road transport are:

development of regulations on the organization and enhancement of motor transportations;

development of the concept of national development programs of road transport; development of forecasts of the state needs of the republic and the population in transportations;

forming and carrying out single investment, scientific and technical and social policy in the field of road transport;

assistance to forming and market development of motor transportation services;

organization and enhancement of licensing of public conveyance, baggage and loads; protection of the rights and interests of carriers and clients;

organization of training and advanced training of personnel;

control of compliance with law about automobile transport;

implementation of international cooperation in the field of road transport.

The state body on management of road transport according to the legislation can have also other powers.

Article 11. The main powers of public authorities on places

The main powers of public authorities on places in the field of road transport are:

development and implementation of complex regional development programs of road transport;

assistance to forming and market development of motor transportation services, to creation of equal conditions for activities of all carriers;

assistance to strengthening of material and social base of road transport.

Public authorities on places according to the legislation can have also other powers in the field of road transport.
