1. Approve the enclosed Instructions for use by highways, roads of defense value.

2. To committee of highways of the Ministry for Investments and Development of the Republic of Kazakhstan (Pshembayev M. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic view on official publication in periodic printed publicity materials and information system of law of Ad_let, and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the Internet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Instructions for use highways, roads of defense value

1. General provisions

1. These rules of use of highways, roads of defense value (further - Rules) are developed according to the subitem 30) of Item 2 of article 12 of the Law of the Republic of Kazakhstan of July 17, 2001 "About highways" (further - the Law), determine procedure for use of highways, roads of defense value.

2. In these rules the following basic concepts are used:

1) users highways - physical persons and legal entities, being participants of traffic or performing other activities within right of way of highways and roadside strip;

2) the highway - the complex of the engineering constructions intended for movement of cars, providing continuous, safe motion of cars and other vehicles with the established speeds, loadings, dimensions and also the sites of lands provided for placement of this complex (the earth of transport) and airspace over them within the established dimension;

3) the National operator on management of highways (further - the National operator) - the joint-stock company with absolute participation of the state in the authorized capital performing the powers established by the Law;

4) owners of roads - physical persons or legal entities, being owners of roads or performing activities for management of roads on the right of economic maintaining or operational management;

5) road body - the authorized state body on highways exercising control of the state highways public;

6) the highway of defense value - the highway necessary for ensuring defense and operational shift of troops (forces) on strategic directions of the Republic of Kazakhstan, and also the highways connecting military, state and special facilities and intended for military transportations, evacuations of the population, subjects to economic, social and cultural assignment in the conditions of wartime.

2. Procedure for use of highways, roads of defense value

3. Users of highways:

1) is received by explanations from service employees of road body, authorized body for emergency situations or its divisions, and also from territorial subdivisions of authorized body on safety control of traffic about the reasons of the termination or traffic restriction on highways;

2) obtain complete and reliable information about traffic conditions;

3) obtain complete and reliable information about the fare and extent of paid highways (sites), about procedure for use of the paid highway (site), rates of fare, procedure and payment methods, privileges on payment of journey and other conditions;

4) perform free pass on paid highways (sites) according to article 5-2 of the Law;

5) are appealed actions (failure to act) of service employees of road body according to the procedure, established by the laws of the Republic of Kazakhstan;

6) is used by the vehicles ensuring safety of highways and road constructions and safe driving through them;

7) do not perform journey without special permission on the vehicles, on dimensions, weight and (or) axial loads exceeding established by the order of the Minister of investments and development of the Republic of Kazakhstan of February 27, 2015 No. 206 "About approval of Rules of the organization and implementation of transportations of bulky and heavy loads in the territory of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts for No. 11395);

8) do not make the actions reducing traffic safety, promoting emergence of traffic disturbances, reduction of speed of vehicles, reliability of highways and constructions, their destruction;

9) make payment of driving through paid highways (sites) at the time of crossing of Item of collection of payment;
