About approval of Rules of assessment of requests, final offers of procurement participants of goods, works, services for ensuring the state and municipal needs

According to the Federal Law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" Government of the Russian Federation decides:

1. Approve the enclosed Rules of assessment of requests, final offers of procurement participants of goods, works, services for ensuring the state and municipal needs.

2. Recognize invalid:

the order of the Government of the Russian Federation of September 10, 2009 No. 722 "About approval of Rules of assessment of bids on the right to sign the public or municipal contract on deliveries of goods, performance of works, rendering services for the state or municipal needs" (The Russian Federation Code, 2009, No. 38, of the Art. 4477);

Item of 31 changes which are made to acts of the Government of the Russian Federation, approved by the order of the Government of the Russian Federation of December 17, 2010 No. 1045 "About change and recognition voided some acts of the Government of the Russian Federation" (The Russian Federation Code, 2010, No. 52, the Art. 7104);

the order of the Government of the Russian Federation of March 28, 2012 No. 265 "About modification of the order of the Government of the Russian Federation of September 10, 2009 No. 722" (The Russian Federation Code, 2012, No. 14, the Art. 1659).

3. This resolution becomes effective since January 1, 2014.

Rules of assessment of requests, final offers of procurement participants of goods, works, services for ensuring the state and municipal needs

I. General provisions

1. These rules determine evaluation procedure of requests, final offers of procurement participants of goods, works, services for ensuring the state and municipal needs (further - purchase) for the purpose of identification of the best of the offered terms of execution of the contract in case of purchase execution, and also extreme sizes of the importance of each criterion for evaluation of requests, final offers of procurement participants (further - the request, the offer).

2. These rules are applied to all purchases, except for the procurements conducted by holding the auction, request for quotation at the single supplier (the contractor, the contractor).

3. In these rules the following terms are applied:

"assessment" - process of identification in accordance with the terms of determination of suppliers (contractors, contractors) on evaluation criteria and according to the procedure, established in documentation on purchase according to requirements of these rules, the best conditions of execution of the contract specified in requests (offers) of procurement participants which were not rejected;

"the importance of evaluation criterion" - the evaluation criterion weight in total the evaluation criteria established in documentation on purchase according to requirements of these rules expressed as a percentage;

"coefficient of the importance of evaluation criterion" - evaluation criterion weight in total the evaluation criteria established in documentation on purchase according to requirements of these rules, divided on 100;

"the rating of the request (offer) on evaluation criterion" - assessment in points received by the procurement participant by results of assessment on evaluation criterion taking into account coefficient of the importance of evaluation criterion.

4. For the purpose of these rules for assessment of requests (offers) the customer establishes the following evaluation criteria in documentation on purchase:

a) characterized as cost evaluation criteria:

price of the contract or amount of the prices of commodity units, works, services;

operating expenses and repair of goods (objects), use of results of works;

life cycle cost of goods (object) created as a result of performance of work in cases, stipulated in Item 5 these rules (further - life cycle cost);

the offer on the amount of the corresponding expenses of the customer which the customer will perform or will incur according to the power service contract;

b) characterized as not cost evaluation criteria:

quality, functional and ecological characteristics of subject to purchase;

qualification of procurement participants, including availability at them the financial resources, the equipment and other material resources belonging to them on the property right or on other legal cause, the work experience connected with the subject of the contract and goodwill, specialists and other workers of certain skill level.

5. In case of implementation of purchase by results of which the contract of lifecycle is signed for assessment of requests (offers) the customer has the right to establish in documentation on purchase instead of cost criteria evaluation criterion "life cycle cost".

6. Use of evaluation criterion "operating expenses and repair of goods (objects), use of results of works" is possible only if the contract in addition to delivery of goods (performance of work) provides further operation, repair of goods (use of the object created as a result of performance of work), including delivery of consumable materials.

7. Assessment according to Item 6 of these rules regarding goods is performed on evaluation criterion "operating expenses and repair of goods (objects), and regarding works - on evaluation criterion "expenses on use of the object created as a result of performance of work".

8. In documentation on purchase the customer shall specify the evaluation criteria used for determination of the supplier (the contractor, the contractor) and sizes of the importance of evaluation criteria. At the same time the quantity used for determination of the supplier (the contractor, the contractor) of evaluation criteria when implementing purchase shall be at least two, one of which shall be the evaluation criterion "the price of the contract or the amount of the prices of commodity units, works, services", and in cases, stipulated in Item 5 these rules, - evaluation criterion "life cycle cost".

9. The amount of sizes of the importance of the evaluation criteria applied by the customer shall constitute 100 percent. The size of the importance of evaluation criterion "operating expenses and repair of goods (objects), use of results of works" shall not exceed the size of the importance of evaluation criterion "the price of the contract or the amount of the prices of commodity units, works, services".
