About approval of the Procedure for conducting checks by the National agency according to the prevention of corruption

According to Article part one 8, to part one Item 8-1 of Article 11, to Items 5, 6 and 7 parts one of article 12 of the Law of Ukraine "About prevention of corruption", for the purpose of realization by the National agency according to the prevention of corruption of the powers on conducting checks of observance of requirements of the laws of Ukraine "About prevention of corruption" and "About political parties in Ukraine" the National agency concerning prevention of corruption SOLVED:

1. Approve the Procedure for conducting checks by the National agency according to the prevention of corruption which is applied.

2. In accordance with the established procedure to submit to department of the organization of work on the prevention and identification of corruption together with department of legal support this decision on state registration to the Ministry of Justice of Ukraine.

3. Control over the implementation of this decision to assign to the member of the National agency concerning prevention of corruption Skopich A. D.

4. This decision becomes effective from the date of its official publication.

Procedure for conducting checks by the National agency according to the prevention of corruption

I. General provisions

1. This Procedure determines the mechanism of carrying out by the National agency by the prevention of corruption (further - the National agency) checks of observance of requirements of the Laws of Ukraine "About prevention of corruption" and "About political parties in Ukraine", and also registrations and considerations of results of such checks.

2. In this Procedure terms are used in the following values:

scheduled inspection - check of activities of object of check which is carried out based on the plan of conducting checks for the corresponding year;

unscheduled inspection - the check of the possible facts of violation of requirements of the Laws of Ukraine which is not planned by the National agency "About prevention of corruption" and "About political parties in Ukraine" which is carried out without prior notice object of check.

Other terms in this Procedure are used in the values given in the Laws of Ukraine "About prevention of corruption" and "About political parties in Ukraine".

3. Objects of check are state bodies, authorities of the Autonomous Republic of Crimea, local government bodies, legal entities, including political parties, in the cases provided by the Laws of Ukraine "About prevention of corruption" and "About political parties in Ukraine".

4. The main objectives when conducting checks are:

determination of condition of the organization of work on the prevention and identification of corruption in state bodies, authorities of the Autonomous Republic of Crimea, local government bodies, in particular on preparation and accomplishment of anti-corruption programs;

establishment of the possible facts of violation of requirements of the Law of Ukraine "About prevention of corruption" objects of checks;

implementation of the state control of activities of political parties according to requirements of the Law of Ukraine "About political parties in Ukraine";

the timely prevention, identification and taking measures to elimination of the revealed violations of the anti-corruption legislation, legislation in the field of financing of political parties.

5. Are performed by the authorized persons of the National agency determined according to requirements of article 13 of the Law of Ukraine "About prevention of corruption".

6. It can be performed by the authorized person of the National agency solely or the commission which of list of members the head is appointed.

7. In conducting check authorized persons of the National agency shall not be attracted to participate if circumstances testify to availability of real, potential conflict of interest according to requirements of the legislation.

II. Organization and preparation of conducting checks

1. The national agency carries out scheduled and unscheduled inspections.

2. Scheduled inspections are carried out according to the annual plan of checks which affirms the decision of the National agency till December 01 of the year previous planned and is published on its official site.

The plan of conducting checks for the corresponding year is constituted based on offers of the structural divisions of the office of the National agency created taking into account the offers which arrived from state bodies, authorities of the Autonomous Republic of Crimea, local government bodies, subjects of managing irrespective of pattern of ownership and their officials, citizens and their associations, including political parties and also taking into account the carried-out analysis of activities of state bodies, authorities of the Autonomous Republic of Crimea and local government bodies in the field of prevention and anti-corruption and researches on studying of situation concerning condition of corruption, the analysis of reports of political parties on property, the income, expenses and obligations of financial nature.
