About procedure for recalculation of pensions and adjustments of the average monthly earnings accepted for calculation of pensions

For the purpose of enhancement of the operating procedure for recalculation of pensions of citizens in connection with change of the size of minimum wage over the country and increase in average minimum wage the Government of the Republic of Moldova decides:

1. The procedure for adjustment of the average monthly earnings determined in case of appointment and recalculation of pensions in case of increase in their minimum sizes, approved by the Order of the Government of the Republic of Moldova N 864 of December 29, 1992. "About enhancement of procedure for recalculation of pensions" (with the changes made by the Order of the Government of the Republic of Moldova N 516 of August 12, 1993 - Monitor of Parliament, 1992, N 12, Art. 403), to state in the following edition and to enact since March 1, 1994:

In case of change in accordance with the established procedure of the level of minimum wage over the country all types of pensions which sizes according to the Law "About the State Provision of Pensions in the Republic of Moldova" are estimated on the established regulations as a percentage to the average monthly earnings received by citizens before the request for pension are subject to recalculation in the terms established by the legislation.

Recalculation of pensions is performed in the following procedure:

1) the individual coefficient of earnings of the pensioner which is numerical expression of ratio of average monthly actual earnings of the pensioner accepted in case of pension calculation and the size of the average monthly salary on the republic in year in which pension is granted, or for the period, taken for calculation of average monthly earnings of the pensioner is determined. The sizes of the average salary on the republic accepted for determination of individual coefficients of recalculation of pensions of the citizens working in the national economy (except kolkhozes) and in kolkhozes, are given in appendix to this Procedure.

Specific values of individual coefficients it is established:

a) to the pensioners who retired till July 1, 1993 whose average earnings were determined for settlement period till October 31, 1992 and which pension was recalculated according to the procedure, provided by the Order of the Government of the Republic of Moldova N 427 of June 23, 1992, - by division of size of the average monthly earnings of the pensioner corrected at the time of the last recalculation into the size equal to two minimum wages on the republic;

b) to the pensioners who retired in November, 1992 - June, 1993 which settlement period included months from November 1, 1992 to June 30, 1993, to the pensioners who retired after July 1, 1993, to the pensioners who submitted the application for award of pension after March 1, 1994 and also persons who submitted after the specified date the application for recalculation of earlier granted pensions according to article 60 of the Law "About the State Provision of Pensions in the Republic of Moldova" - division of the amount of earnings of the pensioner for all period taken into consideration on the amount of the average salary over the country for the same period. The size of the average salary over the country is determined by multiplication of the average monthly salary by the country for the corresponding years on number of the months taken into consideration by years and summing of the amounts received for all period taken into consideration. In case by the corresponding years the average salary over the country is specified on quarters or months, it is taken into consideration in sizes, to the respective quarters or months included in calculation.

At the same time on the months of the current year of retirement included in settlement period, the average salary over the country is accepted on statistical data of specific month, and in cases when at the time of calculation the size of the average salary over the country for the last month taken into consideration is not established yet, in case of determination of individual coefficient average earnings according to statistical data for the last month are accepted.

The individual coefficient of earnings of the pensioner is determined to within five signs after comma and brought in the personal record of the pensioner;

2) multiplication of the settlement average monthly earnings over the country accepted in the amount of three minimum wages by individual coefficient of earnings of the pensioner determines the corrected size of the average monthly earnings accepted in case of pension calculation;

3) the new size of pension is estimated proceeding from the Procedure for average monthly earnings corrected according to Item 2 presents on the regulations established by the Law "About the State Provision of Pensions in the Republic of Moldova".

If the size of the counted pension will be less minimum size of pension, established on the republic, pension is granted in the minimum size over the country".

2. To the Ministry of Labour and Social Protection:

specify values of individual coefficients for persons who retired in November, 1992 - June, 1993 which settlement period included months from November 1, 1992 to June 1, 1993 and to count their pensions since March 1, 1994;

make necessary changes to data of primary documentation and perform since March 1, 1994 recalculation of pensions according to Item 1 of this Resolution.
