Some questions of realization of pilot project on implementation of exterritoriality of approval of projects of land management on withdrawal of the parcel of land by territorial authorities of Public service concerning geodesy, cartography and the inventory

The Cabinet of Ministers of Ukraine decides:

1. Agree with offers of the Ministry of Agricultural Policy and Food, Public service on geodesy, cartography and the inventory on realization since October 1, 2016 in territorial authorities of Public service concerning geodesy, cartography and the inventory which provide implementation of powers under approval of projects of land management on withdrawal of the parcel of land, pilot project on implementation of exterritoriality of approval of projects of land management on withdrawal of the parcel of land by territorial authorities of Public service concerning geodesy, cartography and the inventory (further pilot project).

2. Approve the Temporary order of interaction between territorial authorities of Public service concerning geodesy, cartography and the inventory for realization of pilot project on implementation of exterritoriality of approval of projects of land management on withdrawal of the parcel of land by territorial authorities of Public service concerning geodesy, cartography and the inventory in case of approval of projects of land management on withdrawal of the parcel of land which is applied.

3. To public service concerning geodesy, cartography and the inventory according to the requirements established by the Temporary procedure approved by this resolution till October 1, 2016 to provide:

testing and determination of experts of state examination;

introduction of exterritoriality of approval of projects of land management on withdrawal of the parcel of land;

provision of administrative service in issue of the conclusion within pilot project through the centers of provision of administrative services;

creation of opportunity for check of condition by developer approval of the project of land management on withdrawal of the parcel of land by means of the official site of Public service concerning geodesy, cartography and the inventory.

4. Give to the Ministry of Agricultural Policy and Food till March 1, 2017. To the Cabinet of Ministers of Ukraine report on results of realization of pilot project.

Temporary order of interaction between territorial authorities of Public service concerning geodesy, cartography and the inventory for realization of pilot project on implementation of exterritoriality of approval of projects of land management on withdrawal of the parcel of land by territorial authorities of Public service concerning geodesy, cartography and the inventory in case of approval of projects of land management on branch land sites

1. This Temporary procedure determines the mechanism of interaction between territorial authorities of Gosgeokadastr for realization of pilot project in case of approval of projects of land management on withdrawal of the parcel of land.

2. For review the project of land management on withdrawal of the parcel of land (further the project of land management) person who according to requirements of article 26 of the Law of Ukraine "About land management" is developer of the project of land management (further developer) submits to territorial authority of Gosgeokadastr in the location of the parcel of land the original of the project of land management in paper and electronic type.

3. The project of land management in electronic form makes sure by means of the qualified digital signature of developer which confirms its compliance to the original of the project of land management in paper form.

4. Production of the project of land management in electronic form is performed taking into account the following requirements:

image format - color;

permission - 300 dots per inch;

depth of color - at least 4 bits;

format of the ready file - PDF (with text content, not scanned images);

the file size - no more than 3 megabytes.

Quality of the project of land management in electronic form shall provide accurate reading its content.

5. Territorial authority of Gosgeokadastr in day of receipt of the project of land management:

accepts the submitted documents according to the inventory and registers in electronic document management system of Gosgeokadastr with obligatory drawing barcode which includes registration number and document date;

checks compliance to the original of the project of land management in paper form of the project of land management in electronic form;

enters into electronic document management system of Gosgeokadastr the project of land management in electronic form certified by the qualified digital signature of developer, and vykopirovka from the index cadastral map (plan) in which the designed parcel of land and information on restriction is reflected (in case of their availability).

6. The copy of the inventory in which information on availability of the original of the project of land management in paper form and the project of land management in electronic form with the put barcode specified in Item 5 of this Procedure is specified is issued (goes the mailing) to developer in day of receipt of the project of land management in territorial authority of Gosgeokadastr.

7. The electronic document management system of Gosgeokadastr by the principle of accident chooses territorial authority of Gosgeokadastr which will perform approval of the project of land management, and no later than the next working day from the date of receipt of the project of land management transfers to the relevant territorial authority of Gosgeokadastr the materials specified in Item 5 of this Procedure.

8. Consideration and approval or refusal in approval of projects of land management are performed by the employees of territorial authorities of Gosgeokadastr elected by the principle of accident by electronic document management system of Gosgeokadastr.

9. The employees of territorial authorities of Gosgeokadastr performing consideration and approval of the project of land management shall:

correspond to criteria, the stipulated in Clause 23 Laws of Ukraine "About state examination of land management documentation";

pass qualification examination in Gosgeokadastr;

to be determined by experts of state examination.

10. The qualification examination is held in the form of testing by the qualification commission which is formed by Gosgeokadastr. Regulations on activities of the qualification commission and its structure affirm Gosgeokadastr. The meeting of the qualification commission at which the qualification examination is held is drawn up by the protocol which is constituted in one copy and is stored in Gosgeokadastr. The result of qualification examination is estimated as "handed over" or "did not hand over".
