Procedure of package of measures within the mechanism of redirection of the victims of human trafficking

1. General provisions

1. Procedure of package of measures within mechanisms. redirections of the victims of human trafficking (further - the Procedure) it is developed according to articles 12 of the Law of the Republic of Tajikistan "About counteraction to human trafficking and assistance to the victims of human trafficking" and determine procedure for identification, redirection of rehabilitation and reintegration of the victims of human trafficking, interaction of authorized bodies, non-state and international the organizations for settlement the relation with the victims of human trafficking, and also with specialized agencies.

This Procedure determines measures for realization of protection and assistance to the victims of human trafficking, vulnerable migrants, and also provides availability of such components as provision of the unconditional help to the victims during observation, provision of special status of protection throughout the entire period of criminal investigation, respect for anonymity, personal data protection, etc.

This Procedure is based on the Constitution of the Republic of Tajikistan, the Law of the Republic of Tajikistan "About counteraction to human trafficking and assistance to the victims of human trafficking" and other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.

4. Main objectives of this Procedure are effective, ensuring compliance with the rights of the victims of human trafficking and their redirection for rendering by it complex of the help and services, and also enhancement of national policy and the procedures concerning the victims of human trafficking including normative provisions on residence in the country and repatriation, payment to the victims of compensations and witness protection, and also development of the national plans of action and determination of control indicators for assessment of achievement of effective objectives.

5. The state subjects performing counteraction of human trafficking and giving help to the victims of human trafficking fulfill the obligations on protection of the rights of the victims of human trafficking, coordinating with the international, non-state organizations and civil society.

2. Fundamental principles of the mechanism of redirection of the victims of human trafficking

6. The state subjects, non-governmental organizations on assistance to the victims of human trafficking shall observe the following fundamental principles:

a) unconditional support to the victims of human trafficking - i.e. all victims of human trafficking have the right to support within the legislation after human trafficking counteraction, to these Procedure, directly after their identification;

b) safety and security of the victims of human trafficking:

- criteria of determination of the victims of human trafficking;

- criteria and standards of provision of social services to the victims of human trafficking.

The assistance measures provided in this Procedure are performed after careful risks assessment;
