1. Approve Regulations on procedure for carrying out certification of workplaces for confirmation of the right to provision of preferential pensions it (is applied).

3. To the Ministry of Labour and Social Protection:

make necessary explanations to district and city departments of social security and the interested business entities concerning certification of workplaces for confirmation of preferential pensions according to the Provision approved by this resolution.

Regulations on procedure for carrying out certification of workplaces for confirmation of the right to provision of preferential pensions

I. General provisions

1. This Provision establishes single procedure for carrying out certification of workplaces for confirmation of the right to provision of preferential pensions.

2. Certification of workplaces consists in studying of condition and assessment of work by identification and comparison of quantitative and qualitative indexes of the production circle to the normative values provided by standards of labor safety and sanitary and hygienic regulations and also in determination of workplaces with adverse conditions of work.

According to this Provision of certification those workplaces where workers are engaged in productions, at the works, in the professions and positions provided by the N 1 and N Lists 2, granting the right to preferential provision of pensions (further - Lists) approved by the order of the Government of the Republic of Moldova of December 15, 1992 N 822 are subject.

In separate industries where harmful and severe conditions of work or health hazard of the person remain irrespective of condition of scientific and technical progress (appendix N 1), is inexpedient to carry out certification of workplaces for confirmation of the right to provision of preferential pensions. 3. Frequency of carrying out certification of workplaces is established by the company (at least once in three years).

4. When the company or the organization has no possibility of independent carrying out tool measurements of the specified production factors, such works are performed specially authorized on laboratories which list affirms State examination of working conditions in coordination with bodies of State sanitary inspection.

5. Certification of workplaces is carried out on the basis of the following regulations:

The N1 list of production, works, professions, positions and indicators at underground works, at works with especially harmful and especially severe conditions of work in which employment grants pension entitlement on age on favorable terms;

The N2 list of productions, works, professions, positions and indicators at works with harmful and severe conditions of work in which employment grants pension entitlement on age on favorable terms;

The hygienic classification of work (on indicators of harm and danger of factors of the production circle, weight and intensity of labor process) approved by the Ministry of Health;

the national standards of labor safety approved by State department according to standards, metrology and technical supervision;

this Provision.

II. Preparation for carrying out certification of workplaces

6. For the organization and carrying out certification of workplaces for the companies the order approved with trade-union committee in which are established is issued: terms and schedule of carrying out certification of workplaces; structure of permanent certifying commission of workplaces (further - certifying commission) and its functions, and also other questions concerning carrying out certification workplaces are raised.

7. The certifying commission performs the following main functions:

conducts organizational and methodical work on preparation for certification of workplaces;

creates necessary legal and normative and help base and will organize its studying by the experts involved to carrying out certification of workplaces;

establishes reasons for rejection of working conditions from normative, fixes them before carrying out certification, takes measures for elimination of the revealed variations;

carries out necessary work on preparation for carrying out measurements of dangerous and harmful factors;

studies results of laboratory researches on workplaces and gives their assessment;

determines the list of workplaces, professions and positions on which to workers according to Lists preferential provision of pensions is established.

III. Carrying out certification of workplaces

8. Certifying commission of the company (division):

constitutes the list of the productions, works, professions and positions referred to Lists.
